The Constitution says absolutely nothing regarding guns in schools, churches, courtrooms, police stations, etc. It simply says "shall not be infringed".

.....I have been carrying my concealed firearm for 33 years with a concealed permit. I carry it EVERYWHERE, and I mean EVERYWHERE......that there is not a medal detector. If there's a medal detector, thats the ONLY time my gun is not on me. But I am also 99% sure whertever that place may be, no bad actors have a gun on them either. No gun law is ever keeping me from carrying my gun. Hell, I'm armed in Disney World, those idiots just haven't figured out how to actually keep firearms out yet. But there's no Florida statute anyone is violating by taking a gun in to the Disney World, its just a Disney rule.

As concerns federal enforcement of the Gun Free School Zones Act of 1990: Where permitless carry exists, is there any legal principal that could be used to challenge the enforcement of a law that is rarely, if ever enforced, and that, if routinely enforced, would result in millions of arrests? Almost every permitless carrier violates the Gun Free School Zones Act at least once a week, and most everyday carriers probably violate it every day. The majority of permitless carriers probably can't cross the street in front of their home without violating the Act.

I Talk to the FL sheriff And They Told me if your driving by a school on the street, you will have no problem.. You just can drive on the grounds of the school.. now they are some stipulations on this, first off Florida doesn't enforce the Federal School Zone Laws, in other words if you drive by a school or drying in a school zone and you get pulled over for what ever reason lets just say your tail lite was out and the officer pulled you over, and you told him your are a CCW holder and have a gun on you, Even if your only 100 feet way from the school and right in front of it on the street, they will not charge you with a crime because you have a gun in a school zone, that is a federal law not a State and they do not enforce that law what so ever.. Now if you was intending to pull on to the property of the school lets say the parking lot or directly in front of the school on the property than you are in violation of having a gun at a school. Now here is the stipulation. if you happen to be driving by a school and you have been under investigation from a federal office lets say the DEA, lets say some one reported to the DEA that you was selling drugs or the ATF, lets say some one reported that you was violation federal firearms laws such as converting semit-automatic rifles into full automatic, and lets say they been following you and you happen to drive into a school zone while they followed you, they can pull you over and arrest you on having a gun in a school zone, they can do it because it is a federal law and they can enforce it. How ever they can't just pull you over to see if you have a gun randomly to check citizens if they have a gun while driving in a school zone, NO, that is out of their jurisdiction, how ever they can if they are investigating you for what ever reason. That is the only time in Florida you an be arrested and charge for having a gun with in 1000, feet of a school, other than that No you are all set.. The other thing is if they are investigating you, they must contact the local city and county of what they are doing, the state and local law enforcement supersede the Federal law enforcement unless you are in violation of a federal crime or under investigation of one, and they notified the local and state law enforcement officials.. Just like anything else just like when lets say the DEA is going to make a drug raid at a house and has a federal warrant, the federal law enforcement (DEA) must contact the local police or county, and tell them they have a warrant and are going to execute that warrant, normally the Local law enforcement will come with them for that.. They can't just storm in and raid a house with out talking to the local law enforcement unless it was an emergency situation... Some school you can go pick up your child and Drive on the school property with a handgun, if you get permission from the school administration in writing that they are allowing this, They are some situations where you can get special permission to carry a gun on you while driving on the school property to pick up your child, but you have to get that in writing from the school administration, not the principle or teachers it must be the head school administration people.. Other exception of having a gun on school property is if your a volunteer school guardian, this is something citizens sign up for to volunteer their time to protect schools, these people are exempt like police officers from this law and able to have a gun on school property and inside the school.. In Florida they are many county's that have this program, if you want to be one check your local sheriff's office and find out how to apply, you get some perks if you do this from what i was told, such as when you renew your drivers license if you volunteer 20 hours a month or more, when you go to renew your drivers license fee is waved,, that and local hunting license, and also your CCW License as well, and i believe you have to take a 1 week training program with the Sheriff's office, i believe it's like 30 hours total hours of training class room and on the gun range.. Also Some school systems in other states allow their teachers to have a gun on them while working at the school, I don't think they allowed this yet in Florida, but they should Although i think a school principle is allowed, not 100% sure on that one for sure.. Some schools also have contracted independent armed security outfits at their schools as well, and that becomes legal, actually any one can bring a gun in a school so long as they have direct permission from the school head administration, so long as they have that they are legal, but they don't give that out often, only to special circumstances, like armed school guardian's and security outfits working for them..

I was arrested last year at a city park, that has legacy signs at the entrance that state “no firearms in park”. Someone seen my pistol momentarily become exposed as my shirt blew up in the wind, and told a coach who later called. Not a school zone, but it definitely goes to show that cops don’t always know or care about the laws before they act. They snuck up behind me, pinned me against the fence & disarmed me. Then under threat of arrest they demanded ID and asked for my permit. Soon as I told them I didn’t have one, they arrested me. The thing is, I was covered by an exemption, but never got the chance to use it. Mr. Friday sure has ate em alive. I now even have an answer to a complaint that I had made on the arresting officers, in which the captain admits to the city ordinance of “no firearms in the park”. This is gonna be great!

I think one of the problems with the school zone question is what if you have a FL CCW and under reciprocity travel to another state which accepts your FL gun permit such as Georgia and are stopped in a school zone. You might be in a technical violation. However, under Bruen and other Supreme Court cases, I do not believe the school zone question would be upheld. As a prior LEO and attorney, I for one will not disarm when I am driving through such a state.

In TN we used to have to get a permit to carry and the course instructor told us just hand them our permit with our drivers licensed because the dispatcher would advise them we have the permit anyway and this was you’re out ahead of the discovery. My experiences with handing the permit with my drivers license is that they have been friendly with me and a couple times asked me “where is the gun at this time?” “Wait there.”

In FL. Concealed licenses is not public information to include law enforcement. When they run you on a traffic stop, the system only shows your Drivers License, your registration and insurance, any past tickets. But it will NOT show if the person has a concealed license or not.

Can you go over the Constitutional carrying in Florida and address these questions: 1) Carrying in National Forest - Forest Roads (Ocala websites says its illegal to have a firearm in a National Forest unless its hunting season) 2) Carrying in State Forest 3) Carrying in Wild Life Management Area - ie.. Bull Run, Tosahatchee, ect ect 4) Carrying in a Preserve. All 4 of these that I have mentioned will probably get you a charge for poaching from the Game Wardens

Each state has a law to immediately notify I have a Louisiana Permit and we have to notify upon interaction and our license plate and Drivers license is tied to our permit so the law enforcement officer will know we have a ccw when running plates or drivers license if we don’t tell me my ccw can be revoked 😊

In your discussion of the school zones, you make no distinction between carrying concealed in the vehicle, and having a firearm in a closed container in your trunk, or in the non passenger section of a vehicle without a trunk, (SUV). I think this is confusing things since I believe the latter is legal when without a CWL. If without a CWL, you might ask if the container locked in the trunk, or positioned in the back of the SUV, must be locked independent of the trunk, or rear door of the vehicle? Do you need a shade in the case of the SUV?

Less conversion less issues ,as police like to take small investigative questions and turn them into more than what it is 😂 . Invoke those rights and if they persists ,I tell them your reason for stoping me is for what probable cause, and if they state that reason . I don't answer questions further and then if they keep going I tell them I would be happy to answer your questions but not without an attorney present sir or mame. I ignored the repeated weapons question a month ago in Georgia and it provoked the cop to aggressively go hands-on and forcibly search me and remove my legally-carried firearm from beneath my clothing and then he lied after disarming me by claiming he saw a bulge. I was only being confronted (not even a traditional traffic stop) on a public sidewalk where I was standing when they initially approached and surrounded me because I had been slowly riding my electric scooter on public roads, which is legal under state law, but the cop claimed it was not allowed within the specific municipality. I was even strongly advised to only ride it on sidewalks, which is explicitly prohibited by state law. Crazy! Wasn’t my 4th amendment to be secure in my person & effects violated when I was searched without my consent and subsequently disarmed?? I was extremely mild-mannered, peaceful, soft-spoken, polite and showed zero indications of aggression or attempts to flee. I uploaded the encounter a month ago. Please watch it.

Just to clarify, local officers in Florida CAN make an arrest for a federal felony. See Arizona v. United States, 567 U.S. 387, 455 (2012) (Alito, J., Concurring in Part) (recognizing the premise that "state and local officers do have inherent authority to make arrests in aid of federal law"). Under Florida Statute 901.15(2), a law enforcement officer may arrest a person without a warrant when a "felony has been committed and he or she reasonably believes that the person committed it." This statute does not distinguish between a state felony or federal felony, and "felony" is not defined in the chapter. I still agree that this would be a very slim chance of occurring, however. It would really be more of a pretextual move if it ever did happen, I would imagine.

I live in Ohio. Under our concealed carry law, we had a pre-emptive notification clause which is no longer valid by virtue of our permitless carry law. The pre-emptive disclosure was not considered cause to remove nor cause for vehicle search. I can't imagine it would be under Florida law as it violates 4th Amendment rights. The Federal Gun Free zone act makes it all the more prudent for a person to obtain a permit, your feelings on the matter notwithstanding.

I do have a question and this is basically all states Walmart says that you can’t carry your firearm in the store but if someone sees it, they call the cops and have you arrested because you’re carrying a gun. I have seen this numerous times and different states these people have concealed weapons permit, but the cops still will take their gun and arrest them for having it in Walmart but Walmart policy states that you are You are legally free to carry a gun in Walmart, so anybody who takes a gun in Walmart you’re putting your life in your hand I’ve seen it happen numerous times

Safe passage for that allows people to bring their firearms across state lines should protect someone traveling through a school zone, but not someone going directly on school grounds other than pick up so if someone was going to pick up a child and be their limited, not getting out of their vehicle I do believe they would be protected under the safe passage law, as well as the carry laws in the state of Florida

I’ve had a concealed weapons permit more than thirty years. I have generally been forthcoming in serious situations where I was at fault in traffic issues. It’s been decades since, I informed the police officer that I was armed, and the cop simply asked me if I intended to shoot him. I said “ of course not”. I was clearly at fault as Florida had just passed a law that the vehicle in the rear held responsibility. This was in the 80’s. He asked me for my story, so I told him. In spite of a five car collision, he gave me a seatbelt ticket because I broke my nose and the seatbelt rules were new as well. He told me that he wouldn’t have ticketed me but he was afraid of a lawsuit, because I had followed every safety precaution outside of the new seatbelt law and I had an obvious broken nose. It was an actual accident, not a mere collision, and the police officer treated it as such. I was returning from the range, with my weapon in my glove box. Secured. At fourteen I had a hunting license and would bring my shotgun to school and lean it against the wall of the principals office, along with my satchel of necessities and my license.. It saved me a two mile walk to my hunting grounds on farmland I had permission to hunt. I fell of grid after the military for about eight years. What the hell happened ? Two teenagers walking down the street with shotguns, or rifles would be approached by numerous neighbors asking “ what’s for dinner, or what time should they come over ? We fished, hunted, crabbed, dug up oyster beds, and even chopped wood to create a feast for the neighbors to take part in the feast. Now everyone is insane ! Psychologists have convinced people that there are a zillion disorders. The only disorder is that dad has been thrown out of the house. Back in the day 9-10 doctors, clergy, parents, teachers, were all in agreement of the disease. It was called “ants in the pants”, and 9-10 agreed that the cure was to “swat those ants”. It worked. There were no psycho kids, hopped up on psychedelic drugs. You wonder about school shooting ? It has nothing to do with the guns. Outlaw psychology.

In Florida, it has to be concealed. If it isn't in a holster, and if there is an accidental discharge, you'll be up a creek. My personal opinion would be that just putting a loaded gun in your pocket is generally a bad idea, although you could mitigate that risk by being careful not to carry with one in the chamber. When a gun is being jostled around, it's pretty easy for a manual safety to be disengaged, and not impossible for a trigger to get snagged on something, but it's unlikely that you would accidentally rack the slide. (Edit: I'm assuming that you're not talking about a revolver).

Just leave your weapon in your car under those circumstances. Unless you commit some crime then a cop shouldn’t have a reason to be questioning you or asking for your consent to search your vehicle. Besides you’re only going to be there for a minute or two because once your kids get dropped off or get in your vehicle you’re getting off school property quickly anyway.

The whole school zone thing is why I keep my carry permit even in a constitutional carry state. I talked to a couple of local law enforcement officers and even they have carry permits for when they are off-duty, carrying, and driving through a school zone. And, of course, it would seem that the law for no firearms in a school zone hasn't been successful in preventing any school shootings...

as pertaining to the federal law of carrying a gun in a school zone and the exemption "unless private property", i think your car is considered your private property and as long as you are legal to possess a gun and it is not out in the open (concealed) you should be clear from any laws being broken. "provided you are rightfully permitted to carry a gun. Florida Statute § 790.06(12)(b) reads: “A person licensed under this section shall not be prohibited from carrying or storing a firearm in a vehicle for lawful purposes.” New question then arises " now that the state of florida is a permit-less carry, so now more people are exempt from this law of carrying on school grounds as long as they are not illegal of possessing"?

My understanding of the 1,000 feet Federal school law: If you *don't* have a CCW, it's only legal in your car if locked in a gun case, unloaded and out of reach. The problem permitless carry is that YOU WILL drive within 1,000ft of school property even if you stay on the highway while passing through any town or city.

A Florida CCW is no good in any other state if you drive within 1000 feet of a school. /I(ii) if the individual possessing the firearm is licensed to do so by the State in which the school zone is located or a political subdivision of the State, and the law oft:he State or political subdivision requires that, before an individual obtain such a license, the law enforcement authorities of the State or political subdivision verify that the individual is qualified under law to receive the license;

Under current standards, police can do a license check on you anytime following a traffic stop. The license check will also pull up your LTC. In Texas, we are required to hand over both.

Logic requires that the thousand foot rule is an added, “Gotcha” for anyone who is apprehended, as a suspect, who is in a preexisting condition of UN-lawful possession. It does not transform the status from, otherwise, lawful into un-lawful.

Federal law trumps state law, so it's a question of enforcement, and state authorities are not required to enforce federal laws. If the federal government decided to heavily enforce the Gun Free School Zones Act of 1990, then basically everyone who carries a gun on their person would be deemed a criminal, since it's effectively impossible to travel anywhere without coming within 1,000 feet of a school. Even in the country, one would have to plot where all the schools are, and plan one's route accordingly. A huge number of people would be deemed criminals as soon as they stepped off their property, because millions of people live within 1,000 feet of a school zone.

I was pulled in a traffic stop. I kept my hands on the wheel until the cop got to my window. I disclosed that I had a weapon in the center consol and that I had a CCW. He asked me to step out of the car, checked my CCW, and then let me off with a warning for the traffic violation. I think cops appreciate disclosure of firearms during a stop. It may get you out of a ticket.

You have to carry a driver's license and present it on demand when driving. Catch is that the demand must be lawful. Same applies to ID while carrying. This has absolutely NOTHING to do with exercising a Constitutional Right Reading the new Permitless Conceal Carry law there is no contract entered into such as when you contract for a driver's license. That brings us full circle to FS 901.151 which precedes the new Carry law and no provisions to change 901.151 were added to the Bill. Given that no new exceptions were added to 901.151 , it remains that ID must only be Presented under the current standard of that statute. The ID requirement for driving and any form of Constitutional Carry are apples and oranges.

Second Circuit Court of Appeals recently ruled that a cop did NOT have Qualified Immunity for an unconstitutional search and seizure for handcuffing a man and putting him in his car and then searching his entire vehicle. The reason the cop gave? The mere presence of a fire arm, he said, gave him the authority to do all of that. Even though the driver PROVIDED his Conceal Carry Permit at the outset of the traffic stop. The cop claimed he had the right to ignore the CCP until he took the time to verify it. Under this decision, police are now on notice that a CCP MUST be treated a valid UNLESS and UNTIL it’s determined not to be. The cop tried to hide behind that the gun was a dangerous weapon but the Court didn’t buy that argument. And this is a Court that isn’t usually friendly to the 2nd Amendment. Now, thats not controlling in Florida (11th Circuit I believe) but plaintiffs can use it to show that police are on notice that this type of conduct violates the 4th and 5th Amendment and implicates the 2nd, though it wasn’t necessary for this case.

I was with a friend when he got pulled over. We were both carrying concealed but he was of course, the driver. He did choose to inform the cop and the cop got quite nervous and animated and said something to the effect of, "why are you telling me that Did I ask you that? KEEP YOUR HANDS ON THE STEERING WHEEL AND STAY IN THE CAR!!". The last sentence he was practically yelling at the guy. What I took from this is if they don't ask, I'm not voluntary anything. I will simply hand my drivers license over, and keep my hands on the wheel until to do differently.

School zones only apply to permitted people from THAT state. Reciprocity doesn’t seem to apply here. Duty to inform laws, when used in conjunction with the gun free school act are repugnant to the 5th amendment. Not enforced, cool but it’s still dangerous to have hanging over your head as you visit another state.
