"school zone" should be immediately around the school. i.e. the immediate perimeter around the school. NOT a huge swath of land around the school.

This was THE biggest turn off for me when this constitutional carry law came out. I also knew even before reading about it that there would inevitably be some obtuse wording in the massive law, to ensure that the regime can always get someone on something. It's how most laws are these days. I wish laws would return to plain language and not require a law degree and days of time, to read and understand. My international business law courses killed me. I found I had a head for it but ti was so convoluted and everything could be looked at in different ways to come to different (desired?) outcomes. It's the sickness of today.

In all the news for years up to the second vote, it was never reported or explained, and voters never told that registration required to get the medical MJ, meant you could NOT buy or have a gun. Forced to give up 5th and 2nd amendment rights to get medicine. Even though the terrible THC in marijuana was FDA approved and DEA rescheduled class 2 in 1985 as the pharmaceutical Marinol. And, rescheduled again as class 3 in 1999. Making the THC class 1, 2 and 3. USDOH patented medical marijuana in 2001, Pat. 6630507. And now, CBD and Hemp are legal again.What part of marijuana is still illegal? DOJ is fighting medical marijuana and declared in Court, people who use intoxicating marijuana can't be trusted to have firearms. Filing records of historical precedence of denying groups of people the right to have firearms, including Catholics, American Indians, etc. Who's next? Nikki Fried v. U.S.

While I didn't complete law school, I researched and wrote Appellate Court briefs that were highly successful for my firm. (I was also compensated like Mike Vick's dogs😅) What I found I excelled at was prevailing in hearings. I had a friend who was fired unjustly. As I was the only person he knew involved in law, he called me. I filed the relevant paperwork and prepared our battle plan. I knew the woman who made the claims about my friend could be very emotional and I was sure to place her at the top of my witness list, just in case the opposition would try to keep her out of the hearing. The day came and sure enough I triggered her on the witness stand with zero theatrics on my part. Using a calm voice, my questions began very matter-of-fact-like and became more and more pointed until she revealed, with no prompting on my part, that she'd had an affair with my friend and had never told him she was married. Her desire to have him fired was exposed and my friend was thus entitled to a severance package and unemployment benefits. Job done! At that time I was on a 9-month hiatus from my government contract position and wanted to check out other potential career paths. It was quickly clear that I much preferred what I was doing and that my pre-law days belonged as my post-law days. Not one bit of any of my history would help me in the least if I had to use one of my firearms and killed someone who was trying to kill me or someone in my family. I went through a home invasion back 30 years ago that saw me nearly charged with everything from attempted murder to riding my bicycle against the wind in a Sunday wearing green socks. It was touch and go. Since I didn't have a gun at the time, I put a samurai sword all the way through the PCP hopped up lunatic that tried to kill me and my girlfriend. It was horrific. He and I fought for at least an hour and my entire apartment was destroyed. It took running him through with the sword before I got him out of my apartment and I'm a combat vet with a lot of close quarters combat experience. Also I'm a martial artist. I fought in Judo tournaments, know BJJ, and I boxed for 3 years. When fighting someone on PCP you have no chance. They feel no pain. Thank you for this information!

It's for selective enforcement. They can modulate your actual sentence from 1 to 100 years. Each crime, even serious ones, carry a low penalty alone. It's necessary to throw the book at someone.

My father went to elementary and high school in the 1930's. He often told me stories about how he and other farm kids would take their .22 rifles with them to school, put them in the coat closet with their coats, and retrieve them after school so they could hunt on the way home. What small game they brought home was part of the family's dinner. I would speculate that this behavior was common throughout the early history of our country. That should constitute an historical president against gun free school zones if not the school carve-out.

It was also commonplace in the early 60's according to my grandfather who has some great stories with regard to the: 'In case of nuclear attack" drills they had at the time vs fire drills. Btw, talking wasn't allowed ! "As if they were going to hear us" which made me LOL.

Even in the fifties and sixties. My school, in Eastern Washington, had a graduating class of twenty-six. It was not uncommon to seem a rifle in a rack in the back window of a pickup out in the parking lot. We had fewer snow flakes back then. Too, federal agent who were sent up into the mountains to put the billies in their place didn't always come back. Probably, the like the life style and stayed. Right?

It's outlined in the federal code, but the problem is the Supreme Court doesn't simply follow the constitution. They follow the "legal climate" of the country. It's bullshit, and as citizens, we have absolutely no recourse. We pretend to be a constitutional republic, but our officials operate as if we are a democracy. Democracy is basically mob rule, and does not represent our constitution.

I started teaching high school in the early 90's. Students would bring me out to the parking lot to show me their guns that they had on their pickup truck gun racks. And of course the guns weren't allowed in the school itself. No one thought anything of it.

My grandpa tells me about it being just like that in the 50’s. Guys would sometimes stop to hunt during deer season on the way home. We’ve always had the guns, it’s only in the last 25 years or so that people started mass shooting every other day

Same here. The first high school built in our city had a shooting range in the basement. Guns at school were normal and I don't ever recall anyone ever getting hurt. We were taught gun safety.

There was a shooting sports division at my high school, sporting clays, and an indoor range target. And nearly every pickup in the parking lot had a easyrider rifle rack in the back window. And there were no school shootings. After WWII and Vietnam there were guns everywhere in this country, there were no shootings at grocery stores, malls or places of worship. We literally didn’t lock our doors to our homes and there were no home invasions.

Reminds of the fact that for years, we roll slowly through school zones, only to find that you never actually see a child. Kids haven't walked to school for years (not in my experience) and the buses load and unload out of the sight of the public. I always feel weird creeping slower than grass growth, wondering when I will finally see a kid.

Never admit to a police officer you possess a weapon. Use your right to remain silent. They can NOT force you to speak without violating your rights. If you're stopped in a school zone this is especially true. If you are carrying where or when prohibited and they ask you, even in a state where the law states you must inform the officer, if you say "yes" you have just incriminated yourself,and you have the right against self-incrimination. Stay silent. Have your license and insurance ready before the officer gets to your window. Treat it like a normal traffic stop, and it will be a normal traffic stop.

Your theory may work in some states except that in certain states when an LEO who has stopped you runs your driver's license, he knows that you have been issued a concealed carry permit. Some states require that upon contact with an LEO you must tell the officer whether or not you are carrying if you have a concealed permit and failure to do so can get you into trouble. I think you are always better off to tell the LEO you have a concealed carry permit by giving him your concealed carry license with your driver's license. Let him or her ask you if you are carrying and where the firearm is. There are a lot of poorly trained LEO's who are deathly afraid of guns. The last thing you want is to have him see it on the seat or ask you to step out and see it on your belt and react instinctively. "Officer, I am carrying tonight; please tell me what you want me to do?" is the best approach. Just do what the officer tells you and you'll be fine.

@charlesnash2748 well you forget that we have the right to remain silent, as well as the right to refrain from self-incrimination. Perhaps a person has a beer. In some states, at officer discretion, even if your BAC is below the legal limit, it is a crime to carry a weapon. If an officer decides he believes you are impaired on something else, he can deem it as a crime. If you happen to drive through a school zone in some states, carrying is a crime, even in your car. Some states they deem it a crime to have ammunition even in your weapon, ir prohibited concealed carry altogether. All of these are of course, unconstitutional, but that's beside the point. My point is that admitting to carrying a weapon may very well be admission of a crime, even if you are unaware you're committing one, or that the officer had personally decided youve committed one. You have the right not to answer, you have the right to withhold any information you wish, and ANY attorney worth his salt would be able to sort that out very quickly. My personal rule is, if I'm asked to step out of the car and I suspect a patdown, I'll probably let them know, but until then it really isn't their business or concern.

Your theory is sound but remember in many jurisdictions barbers and hairdressers are required to have more training than LEOs. Look at some of the goofy things that are chronicled about foolish cop stuff here on KZbin. I just watched a video where a cop dragged a young high school girl out of her car and cuffed her for going 37 in a 30. In Alaska, where I lived for 28 years, when you are stopped, the LEO will know by running your plate before he ever gets to you driver's window if you have a concealed carry permit. It is a state law to tell the officer whether or not you have a firearm with you. I feel way more comfortable controlling the encounter than having a poorly trained LEO who's scared of his shadow reacting when discovers my EDC and goes bonkers.

In the city I retired from there was a high school surrounded by a bad neighborhood. A man on foot tried to do business with a local recreational pharmaceutical salesman about three houses down from the front of the school. It turned into a forcible reallocation of the gentleman's funds. He fled on foot into the school, the armed businessman followed. Police in the school intervened. We responded to an out of breath individual. Police asked him why he ran to the school. He stated that the businessman was going to kill him. He ran into the school not believing it would save his life, he ran in there hoping his assailant would follow. To jam up the young entrepreneur with federal as well as state charges. The danger of these zones being that others may flee into the schools seeking refuge, thereby exposing kids in the school to violence.

In most States, the CCW is an exception to State LEO enforcement of the Federal school zones. Unless the Feds patrol (and they actually have no clue on where these zones are), it's not something that I worry about.

NJ passed a law in response to bruen that made essentially the entire state into one big "sensitive location" aka "gun-free zone", with the only places you could legally carry being, your own property, the street outside, and state forests during hunting season, everywhere else including private property (unless you have special permission from the owner or they post a "guns welcome" sign) and any business that has a "no guns allowed" policy would be a no go, and stepping foot there would make you a felon. it got so bad that they actually had to make an exemption for "what if im out walking my dog and my dog takes a shit on my neighbor's lawn, am I a felon for stepping onto his lawn to clean it up?" of course, most of those restrictions have been rendered null and void due to a TRO from a federal judge, but it remains up in the air as to whether the law will be repealed or reinstated. This came directly after SCOTUS explicitly told the state of New York that they could not do this. i might add that getting a ccw permit in the first place involves a whole slew of legal requirements plus $100 a year renewal fee (it's $200 for two years), and ive heard of many cases where the judge signing off on said permit added in additional restrictions as a court order, which are independant of any state laws, leading to situations where your buddy can legally enter a location while carrying, while you cannot..

I am licensed to carry in my state but would need to think carefully before taking a gun to any other state since, of course, if I took a gun with me on a road trip the purpose would be to have it loaded and handy -- not locked in the back unloaded.

At what point did commerce end? Possession of an item purchased....days, weeks, years ago, isn't commerce. Commerce is the act of profiting, not owning an item. Feds can't have it both ways when commerce is defined by other federal laws, rules and regulations as an act of profiting.

Technically inside of a motor vehicle is private property. That would be a huge loophole in an area where technicalities are critical. I would be interested to hear your take on this, and of course on how this current bill relates to the historical traditions of the country as well.

In spite of the court trying to prohibit slapping a "Sensitive Place" label on everything, NY seems to be trying exactly that, with other gun-hating states (like NJ / CA / ...) not far behind. Must we expect twenty further years - or more? -of litigation before some clarity appears?

You have to tell the Robber or Mugger to "wait and hold on" while you unlock your carry case and load the gun before he can Rob or mug you. Hopefully he will comply.

Interesting. Interesting in that for the previous 54 years I have been living within about 40 feet of a public school. There are also many a private business and home within that 1000 feet perimeter. A 4 lane federal highway that transits the town within that 1000 ft. As well as a 2 lane state highway.

Right, that makes the 1000 ft law unconstitutional on so many levels. First, if you own a home next to a school, you wouldn't be able to own a firearm. Second, if you own a business, you wouldn't be able to protect yourself or your business. Third, people wouldn't be able to drive or walk by on a public street, again unable to defend themselves. And I can go on and on. This doesn't make sense. It is just another law that got put on the books that law-abiding citizens have to spend our money on to get the Supreme Court to rule it unconstitutional. We need a law that states any new laws need to pass the Constitutional sniff test before it can be inacted.

Actually in the State of Florida not sure what state this guy is talking about, but in Florida it is not against the law to drive by or though a school zone with a gun on you so long as you was not intending to enter the school grounds with the gun.. Just simply driving by the school even in the zone will not cause you a criminal charge at all.. I even Called My Local Sheriff Department and asks this, and the officer said, NO you can drive by a school even with in the zone of that school with a firearm so long as you was not intended to enter the school grounds with it, he said the officer would have to prove that you was intending to go on school grounds with the firearm, Also he mention many people have their house right next door to the school with in the ZONE , does that mean it's against the law to have a gun in your house, NO he said, he said some people are just uninformed about how the law is written.. he did say as well if you have a CCW permit to carry, and you are driving on the school grounds to pick up your wife who is a teacher or your child who goes to that school that is perfectly legal.. but you must have a CCW permit to enter the school grounds, you still can't enter the school building tho, and that goes for Universities.. But this guy Tom Grieve, saying you can be arrested because you drove by a school with a gun, that is NOT TRUE, not in the State of Florida at least, if he is talking about another state maybe a liberal state than they need to change that law because it is stupid.. BUT don't take my word for it call your local Florida Sheriff's Department and ask them they will tell you if you get pulled over in a school zone because you was driving by it, and had a gun on you, you will NOT be charged with a crime..

If you are licensed to carry BY THE STATE YOU ARE IN. So, if you're carrying in, say, Iowa with a WI license that IA recognizes, the "trap" still applies.

My house is well within 1000 feet of a public school and the street I live on terminates into the side entrance of the school parking lot (capacity = only 10 cars). I drive past the school, and a city-owned Fire House, on an (almost) daily basis. State of residence = VA (specifically the 'Peoples Republic of Northern Virginia').

The best "Gun Free School Zone" story I have is as follows: About 10 years ago I was assisting my wife, going around various schools to provide teacher training in technology. At one school in VERY rural Nebraska, there had been a mass shooter threat made. The Principal gathered all the senior class boys and ordered them to retrieve their guns from their trucks (all farm kids) and guard all the doors. LE response time there was about 30 minutes and you might only get one Deputy. The point was well made and the threat was never repeated. The school never closed or went on "lock down". That is what it should look like!

Reminds me of an incident shortly after Collumbine. A teen though to be a copy cat and loaded himself up with several guns, all that he could carry. As he approached the school's front door, a teacher observed the potential shooter's progress. Th teacher retrieved his hunting rifle from his trunk and approached the kid. When challenged, the kid immediately surrendered. Oddly enough, the incident was never widely publicized.

Great information that most people aren't aware of. This dumb and useless law is broken by thousands of people every day, but fortunately, it's a law that is nearly impossible to enforce. The only caveats are, don't get arrested in a school zone, and don't do anything that will get you or your vehicle searched.

Unless you live by me where the local small town cops will pull you over for doing 21MPH in a 20MPH school zone. It's easy to tell those who don't live in the area when they ride your bumper thru town. Next time you drive thru Westville, IN on US Hwy 421, don't say you haven't been warned:-)

IANAL; consult an atty. However, unless state law dictates otherwise, you may buy long guns in any state that permits it. Handguns are different: Federally, you may only purchase handguns in your state(s) of residence. If you are a dual/multi-state resident, during the time which you actually physically reside in that state (in which you maintain a home), you are considered a resident of that state and shall use that address for the 4473. They require proof of residence (state-issued ID with the residence's address, hunting/fishing permit with the address, or something(s) like a deed, lease (?), utilities, etc., or a certain combination thereof. Again, ask a competent atty. for exactly what proof(s) of residence they'd require if you can't present a state-issued ID. From Waco bois themselves: "May a person who resides in one state and owns property in another state purchase a firearm in either state? If a person maintains a home in two states and resides in both states for certain periods of the year, they may, during the period of time they actually reside in a particular state, purchase a firearm in that state. However, simply owning property in another state does not alone qualify the person to purchase a firearm in that state. [27 CFR 478.11]." In Texas, driving in your vehicle, you are exempt from school zones when carrying. Your vehicle is an extension of your home, and part of your property, thus making it legal to carry in your vehicle.

Tom thanks for your insight on this important matter. I live in Missouri and never see signs designating gun free zones. Not saying there isn’t any. I talked to a police officer about getting a CCW and he said we are good with the constitutional carry provision. If I travel outside the state I will get one again. Our Sheriff said I didn’t need to re-up my CCW so I didn’t.

I literally live across the street from an elementary school. I shop in my neighborhood and am almost ALWAYS within a thousand feet of that school. I checked with my lawyer and he said dad, the law is pretty vague. Most cops will make the arrest and let the DA sort it out. He actually drives by the same school going to and from work. Here in Louisiana we have Constitutional Carry Light. Active duty military, retired, veterans and guard and reserve do not have to obtain a license.

It is what government enforcement people and lawyers (sorry Tom) do with the interpretation of the law that drives me crazy. Judges will twist them to their own advantage, words will be redefined, virtue signaling will go amock based on emotional overload, and the only person punished by ANY additional "gun control law" is the person trying to obey laws, NOT criminals who use guns for their lawless deeds. BUT IF they (gun control/anti-bill of rights) can overburden us with so many undefined or loosely defined - easily misconstrued by lawyers and judges - laws that we become weary of legally owning a gun (just too much hassle) then they also accomplish their goal. Thanks for your help in this "awareness" and more details are always welcome as I am in my 70s now trying to navigate all these ridiculous lies of "gun control laws" that I never imagined as a kid growing up hunting/fishing in flyover country.

My state allows CCW holders to carry on school grounds, unless they explicitly state that no firearms are allowed.
