When buildings , bridges collapse and people die i don’t see contractors being arrested, but yet if those injured people are brought to the hospital and they die during efforts to save them, the doctor gets arrested ???? 😂😂😂

@@nicejokes7 political negligence may/may not lead to death. It is just a possibility. And it can be controlled with laws and regulations. But medical negligence will lead to untimely death for real. And THERE WAS NO PROPER LAW FOR MEDICAL NEGLIGENCE. And if you really look into the medical history there are cases with intentional or non intentional medical negligence and the repercussions because of it. Learn to think 360 degree not with emotions.STUPID

For people who dont understand what is happening- drs are not against a real negligent doctor being punished. The issue is that " medical negligence " is difficult to investigate correctly and many drs have had to lose license and money in false accusations. Many patient's family try to accuse hospital and doctors of negligence to avoid bill payments, out of denial etc. Also i agree with the doctor who spoke of doctors needing to take risk to save patients. And that example of gynecologist is very good.

The problem is that to implement a law, you need judges and lawyers. Now if someone files a false accusation against a doctor for personal gain, then the "right" vs "wrong" lies inthe hands of the lawyer, who is obviously working only for money. The one who gets the better lawyer wins. Truth may fail.

We need more doctor-lawyer/judges. Those who have had to have studied at least medical law and understand how medicine works for at least an year. Or a shadow work in a hospital all departments for at least an year. Like internship. But for law people.

Im a doctor...i wanted to practice in India...i wanted to do some good for my people......but after seeing whatever is happening in country...im seriously considering moving to abroad and settling in any other country than india.....and i think at this point every doctor should consider the same.... finally the government has showed us our value in this country....and yes being a doctor i can proudly say "i deserve more"

You are saying nothing wrong. This country doesn't deserve the best doctors. I do feel bad for that section of the society who still respect doctors, understand their sufferings and yes, they deserve our honest care. But the majority of public here just keep accusing doctors of being greedy and corrupt, when the fact is doctors hardly earn anything significant compared to other comparable professions. It's a sad thing that a country like India can't take care of it's doctors. I never want to leave this country, but looks like, I'm not having much of a choice now...

@@vamshikrishna8694 for your kind information medical negligence is already there in the law & every medical colleges knows this & every dr knows this this is nothing new.. but patient dies not only bcz of medical negligence only few dr do such negligence but majority of dr are skilled.. & patient death can happen by multiple reasons so u can’t blame dr if he/she trying everything best but still if patient dies then it’s not doctors responsibility bcz in county like india nobody takes health seriously they come to hospital in critical stages so dr can’t do anything even the best dr of the world can’t do anything & at the same time with a care & precaution patient can die bcz medical science is very uncertain & there are various diseases that nobody knows fully about their pathophysiology but still dr have to manage so u can’t blame if someone is trying all that they have

I do agree the with your view that there are doctors who provide exemplary services to the society. My younger brother is a doctor. I do understand the challenges faced by medical professionals in their field. Let us also look at the other side of the coin i.e., scams associated with medical profession. Let's us not kid each other that our country's medical profession is full of scams especially in corporates, be it organ donor scams, inflated medical bill scam to name few. I believe any doctor who is true to his work ethics need not to worry about the new laws, they are meant for those who deviate the norms. Medical profession is considered as next to God in our society so accountability matters a lot here and hence these laws. Yes, I do agree there is a thin line between gross medical negligence and genuine mistake commited by doctors. I hope the new laws are able to differentiate it and deliver justice as effective as possible. Since you have raised about law related to rude patients who approached hospitals under dire circumstances, remember there is no law in any country against this patients. People come to hospitals under heavy duress or under unfortunate circumstances so law favours them naturally.

Even the price of rice and chicken is increasing but the visiting fees of doctors have remained the same since the last decade. Increase the visiting fees and do you duty sincerely Then they'll shut up! Because doctors are humble bookworms and doing 36-72 hours continuous shifts they're imposing one thing after another. Doctors have to unite and keep providing the best treatment as before but with higher salary, so that culprits with notorious intension don't pass through the gate of the chamber!!!!!

@@drdoom8393every country is like that only, honestly and law is like that too , I mean atleast for Indians , there was this case recently where the police themselves ran over a Indian girl in the US , and Indian students keep getting killed and bullied , pay is good for sure . I don't hate my country , I just hate the people who run it , that's why I chose to stay here . Because no other country would teach my kids our history, what our country went through . That's the only reason I chose to stay but these people are making me doubt my decisions.

Drs anyways write n number of tests even irreverent just to make a buck. A specialist Dr with 30-35 yrs experience can't figure out a simple issue apparently without writing tests for 15k-25k n nothing comes out n prescribed simple antibiotics. Drs make blood money.

I feel that being a doctor was once considered a noble profession. But in today's world does the world really deserve this noble profession? By risking one's entire life, after rigorous study and efforts of becoming a doctor, is it really worth it? Even if 1000 lives have been saved by the same doc, he or she will be punished for a humanly mistake. Doctors are also humans they are not gods

The problem is not punishment of the guilty, but persecution of the innocent.Doctors will now have to take out comprehensive medical insurance which will increase the cost to the patient because the cost of insurance will have to be added to the doctor's fees.Hospitals and nursing homes will have to do the same,increasing treatment costs still further. To the patient this is the cost side of the cost-benefit analysis.Welcome to the "Development of India."

@@anilraghu8687 You do come across decent doctors who think of costs as well and don't want patients to spend unnecessarily. Such people are in the cross hairs of the new policy and will vanish. So costs are gong to increase even furher,even more rapidly as more and more expensive tests are developed.

Doctors should play safe. They should recommend referring the patients to specialized hospitals. Let the government open many specialized hospitals with all infrastructure, medicines, machines, etc. If any hospital does not have all infrastructure, medicines, equipment, machines, labs, etc, the doctors should raise the issue by email, to the promoters of the hospitals/ Dist. collector for government hospitals and shift the accountability. .. First, he should save himself from jail so that he can continue to serve the patients.

A wrong legal opinion of a lawyer is not an offence , but any action can be attributed as a negligence for any type of loss of life from hospitals. See there are several medicine that create a side effects of serious nature. Even IV applications, there are risks.

Absolutely. No more central line (subclavian) then, because it could precipitate arrhythmia or risk of pneumothorax. Every invasive procedure in ICU is risky. Imagine losing a tooth during intubation and you get sued. Patient survives , vitals improve but you are sued for permanent loss of tooth. Grievous hurt. Funny.

Don't think pathologists and radiologists are free from medicolegal issues. At least if a practitioner makes wrong diagnosis it is not considered criminal offense. But if you make wrong diagnosis as a radiologist / pathologist you will straight away land up in jail. 😂😂😂

The problem is with the doctors always finding treasure and not pleasure in the profession.All the Governments ,either state or central,are paying good salaries for the doctors.Most Govt.doctors have private clinics where one gets better treatment-everyone knows why.

​@@s.r.3829 no offense but if your not doctor please don't talk about finding pleasure in our job . I worked a single yr in private hospital and was exhausted by the end . India is a large country and we don't have enough patient to doctor ratio and on top the entrance exams are made extremely tough that 90 percent don't make it . And once you do we toil day and night , compromising our health to study in mbbs and when we start practicing 50 percent act hostile to us for no reason . So all that happiness of being a doctor goes down the drain yet we show up every day even on sick days coz ppl need us . And despite everything try our best to give the best treatment for each patient . So is asking for us to be protected wrong . The government seems to have an vendetta against allopathic doctors yet has no issues with illegal medicinal practitioners and quacks who practice with 0 medical knowledge. But the government chooses to ignore that .Why . I am not saying that all doctors are good ,no their are bad doctors who exploit th system as well , but we can't generalise every doctor in India as good or bad. At the end of the day we for doctors not god's we do what we can with the best of our ability , but bringing this rule means we no longer can take risks in the profession due to endangering our profession. So the outrage is justified . Next time u generalise an entire profession pls do think from our side as well.

When any judges gives wrong judgements and real victim dies of suicide then no judges will be held responsible for abetment of suicide. When lawyers keep giving hopes and running cases for long it's not accountable. Judges and lawyers should be the first thing to be scrutinized.

Suppose the caridiac arrest patient was a prior cardiac patient on treatment you are not a cardiologist trying to revive , unfortunately the patient dies the new law says you are not qualified enough to attend that kind of patient and charged a criminal negligence law , in fear of the consequences definitely it will happen .if you are a medical professional you will understand the situation otherwise no point in discussing

I wish u had known how these so called doctor ruining lives of people... I've seen god knows how many cases where doctors are responsible for killing people for making money out of dead people by keeping them in ICU for 2 3 days. And the most recent one... A few days ago my friend's Grampa went to hospital to get a check up and at night when he was admitted in hospital they gave him some kind of injection and he lost his voice and then they referred him to another hospital. Like wtf is that why u admitted him so u could make him lose his voice. This is absolutely reasonable to hold a doctor accountable. I agree with ashwani kumar dubey

Because we are tired of seeing patients using herbal and homeopathy and coming at the terminal stages, wishing for a miracle. The liver enzymes are botched up. You have to choose medications very carefully. The point is, one should stick to one school of thought. If Ayurveda, stick to it till last breath. Kindly do not use Modern evidence based medicine as the last resort. That's all. I have no issues with the indigenous system. But NO CROSSPATHY!

Negligence is not the correct term . Any patient who comes to a doctor for treatment and the treating doc have no personal connection beyond disease and treatment , Doctors provide treatment under the prescribed guidelines and even emergencies are also handled as per guidelines .the patient may or may not respond to treatment.So if a cancer patient dies inspite of treatment does is it because of negligence any foul play?

Somehow Mr. Ashwini Kumar seems to have not understood the medical profession. He is stuck with legality and not human considerations. As one of panellist explained it takes over two decades for a doctor to make clear decision on each patient. It is tough and a rewarding vocation. The reward is more of the wellbeing of the patient treated than any other. The law can be used to target doctors. Praying that patients who are aware of the goodness of medical profession will come to the street and join the doctors in repealing this provision from the newly enacted law.

Law was already there for punishment for giving false certificates. Doctors are taught this in forensic medicine and law in 2nd year mbbs. This is defining everything loosely. No doctor will take high risk cases. Out of 100 high risk cases, there is percentage mortality in every country. Ab kaun risk lega. Now only first aid n refer. Ya branch change to less risky practice. Already everyone i know, is thinking in this lines

Getting consent from patient is ceremonial procedure. Who is aware of procedure here?. They are many offences in criminal law, which does not have mensrea. Even though there is no mensrea, they have knowledge that patient may die.

Actually, the people of India are the ones who are going to pay money, not doctors.. in foreign countries, all hospitals and doctors have taken medical compensation insurance policies. It is the insurance companies that pays the compensation amount to the patient. And the extra cash needed to pay the premium of these policies is paid by the patients by adding it to their hospital bill. doctor or hospital is not paying the insurance premium from their own pocket. so, in foreign countries, this medical compensation only increases the cost of treatment for every patient. It does not affect the doctor or hospital in anyway because they are not paying money to anyone. only patients are actually giving money to insurance companies to pay for their own medical compensation. Same thing will happen in India also..

America's healthcare is shit. But it's beautiful for doctors sometimes. They make bag. But the insurance companies decide if a person can or cannot get a medical procedure, even a basic test done. and not everyone has insurance. It costs a lot too. People rather choose to die without treatment there too, if their insurance doesn't cover it. It's a shit exploitative system. They want the best of both worlds in India tho, where there's no cost for patients and they don't have to pay doctors either! Healthcare budget to be spent on next minister's grandson's 2nd birthday party😂 At least doctors get paid there. We won't get paid and patients won't get treatment. Lose lose ! Yay! Government!!

MBBS Seats in India: Altogether 1 lakh or 1,01,043 MBBS seats are available at present in over 660 medical colleges in the country, of which, 52,778 are in 360 Government Medical colleges and 48,265 are in 300 private Medical colleges. Private Medical colleges charge from 50 lakh to 1 crore fees.. NEET 2024 has recorded 24 lakh or 24,06,079 students applying for the exam.

Yes there are protocols "SOPs" for treatment but if every doctor starts practicing strictly as per protocol then people without medical insurance will go bankrupt for sure....Making decisions for treatment require years of practice and clinical experience....for each symptom a patient presents with there can be atleast 100 differential diagnosis which an efficient doctor rules out and narrows down based on experience and some lab tests....this experience is not something you find in your SOPs, human body is not simple maths like 1+1=2....as per standard protocol there are multiple tests to rule out each differential diagnosis and if doctors start ordering tests for each and every suspicion you would go bankrupt without medical insurance....This argument is invalid for a resource limited and economically underdeveloped country like India....If you have a doubt you can ask any person living in any 1st world countries about how medical system works there and how much is the cost of treatment..... Harsh criminal negligence on the other hand was punishable earlier also, no one had problems with it...if this new law is bringing such controversies, there must be a something terribly wrong in it...people should understand this instead of blaming doctors for protesting against this new law..... What constitutes Gross medical negligence must be clearly defined by ammendment in the new law.........If this new law is not ammended no doctor would be willing to take up high risk patients under their treatment and would simply refer and shift the responsibility, critically ill poor patients who cannot afford treatment at big corporate hospitals will suffer the most....who would risk going to jail or harrasment at court while trying to save lives if favourable outcomes don't occur.....

Admidst neet scam, students will study their a** off and then again study more in mbbs and then again they have to clear EXIT test to get licence for practice. And again do specialisation super specialisation. And after all this rigorous efforts what they get? End up in jail for some patient dying during operation. Or also may be if the patient was already dead, who knows if the doctor can prove his or her innocence. Time to leave the country for good.

What do you mean by comparing a doctor to LEVEL of politicians??!.....we doctors go through immense amount of studies..we invest immense amount of our money and time to acquire the knowledge.. during the journey of becoming a doctor every single one of us has faces the unimaginable amount of stress, anxiety and depression at certain points....this profession is called an NOBEL profession for a reason!......and on the other hand to become a political all you need to do is gather votes..which are not even gathered by being loyal to those voters...they lie, they pay money for the votes, they distribute free alcohol for the votes, they make false promises..and most of them are even uneducated if you're comparing to a doctor!.....we doctors work for the greater good of our patients..and those politicians work only to win votes again in next term....i guess this should state who is selfless and who is selfish!

There must be a sop ( standard Operating procedure) for treating a patient in govt and private hospital. Violation of SOP is liable to punishment to medical professionals. Otherwise not.

There already is SOP for every disease. But high risk cases u can't predict who will respond to drugs given. Risk of mortality is always present. Fir eg Any obstetric case can go into DIC. it happens. Any surgery can have risk of pulmonary embolism. After year's of experience also we can't predict always. Now no doctor will take risk of jail time by treating high risk cases. They will refer. I have right to refuse case. Only common people will suffer.

Yes there are protocols "SOPs" for treatment but if every doctor starts practicing strictly as per protocol then people without medical insurance will go bankrupt for sure....Making decisions for treatment require years of practice and clinical experience....for each symptom a patient presents with there can be atleast 100 differential diagnosis which an efficient doctor rules out and narrows down based on experience and some lab tests....this experience is not something you find in your SOPs, human body is not simple maths like 1+1=2....as per standard protocol there are multiple tests to rule out each differential diagnosis and if doctors start ordering tests for each and every suspicion you would go bankrupt without medical insurance....your argument is invalid for a resource limited and economically underdeveloped country like India....If you have a doubt you can ask any person living in any 1st world countries about how medical system works there and how much is the cost of treatment.....

This would create an additional mental stress on the doctor who is already facing a complex or critical situation . It’s like holding a gun on the head of someone who is trying to save a life. This seems like a draconian law especially for such a profession which requires immense knowledge and expertise to treat an individual. Instead a law should be passed of transparency and monitoring while involving critical treatments.

Main reason we don't have enough qualified doctors is that the good ones have been going to the developed countries rather than serving in their homeland. It's not for lack of jobs but for earning higher salaries. Second, corporate hospitals set targets for medical professionals who must pad up patient's bill. This includes unnecessary tests and treatments. Could such recklessness lead to patient death? If patients are seen as "customers" then yes! I know of someone who had to undergo the same surgery three times, including medical instrument accidentally left inside abdomen to be extracted!!

Ashwani Kumar is the most mindless advocate I have heard to…….at 15.17 he states that if a doctor doesn’t know how to do a thing he shouldn’t do it …..just a thing if he missed what dr. Sanjeev Bagai said….a dr. Trains 20 yrs to be where he is and this advocate thinks it is cool to say dr. Is incapable….on the other hand ….only if Ashwini Kumar knew what an emergency means…..he won’t talk about referring a patient……just talking like an illiterate person …..he actually proved dr. Bagai’s point ……advocate and police know zero about medicine and can’t be considered in stating whether it is negligence or not……

That doctors always protect fellow doctor. The result till now no doctor has been punished by law. So it's time other professionals are needed to judge the doctors and break this doctors fraternity.

In India, when patients can't be saved , people simply blame it on doctors as negligence. People don't even wait for a detailed investigation by the medical board. Today everyone is a doctor graduated from an Internet university. Doctors will simply stop treating very sick patients, and will refer them to higher centers. It would become more problematic for patients.

​@@gauravgairola9449 apart from life threatning diseases all diseases can be cured. all surgeries can be performed with 100 percent success if its done carefully and responsibly by a trained doctor.at least do the surgeries right. people going to apollo and getting cured and come back. why does same not happen everywhere. it means doctors are incapable and are untrained and medical licenses are awarded to people who haven't proven to save lives. i think for medical license the department he /she is in must prove her worth to have medical license and record of having high success rate in treatment.

@@gauravgairola9449you definitely sympathise with criminals. My grandmother was treated so badly at hospitals. They kept her on sleeping injections continuously. Even when they were not able to treat her did not ask us to take her somewhere else. Only because you are a doctor doesn’t mean you can get away with anything. In India doctors don’t even care to tell guardians of patients what treatment they doing and why. Doctors sometimes do kill patients.

Law should Specify difference between Gross Reckless MEDICAL Negligence And Failure of Treatment especially high risk procedures . Otherwise who will take up Sick CRITICAL cases ????? Why isn't legal and judicial negligence called criminal offence. The lawyers in our country openly take bribe and finish off the plaintiff s case even if he has the strongest case. There is no body that the lawyers seem to be answerable to. Even the bar council of India has a disciplinary board that is run by lawyers for the benefit of lawyers. Why? Why aren't the law officers held accountable. Even judges when found guilty, are asked to resign instead of being dishonourably discharged and they are still allowed to practice law!!?? Why? And why are lawyers allowed to join politics and still practice. Why make the bhakshak so Powerful that it is easier to be a victim without justice than to trying to get justice

Do they specified that, medical practitioners include from a ward boy to nurse, from pharmacist to doctor, from unani homeopathy to allopathy doctor all of them are medical practitioners will they also be considered equal culpable?? Many times even patient or patients attendant do negligence, tell half things many things, would their negligence be also over doctor??

@@ramm6258 they don’t pay taxes on that part of money which they use as expenses, still to some extent they must pay taxes , otherwise whole property would become black money. And black money is very difficult to deal with. Now when everything in an industry becomes costlier automatically that cost will trickle down to every sphere of that industry . Hospital fee will be costlier too. Corporates don’t like to handle black money either.

There is already a medical board to see for gross medical negligence. Board constituting of varities of super specialists. Doctors are convicted if there is gross negligence. This is different. Now high risk cases will no longer be seen by doctors for fear of false cases. Judge will decide if it's false case but until then doctor will remain in judicial custody for years Out of 100 cases, atleast 5-10 are high risk case. Doctors want to save every life but not at DAILY risk of prison time Didn't study 12 years for daily jail risk

How about hundereds of thousands of cases of corrupt or negligent doctors where people suffer every day and have no one to complaint to. Why are laws very strict in the west but any strictness against authorities in India, Doctors, Police and IAS resist with full power.
