Just a quick question? well before I start with my question let me make it clear that I support the LGBTQ community. Now my question is, if reservation is ensured for Trans, and Trans people won't have to go for a certification. How will you ensure that only trans are getting their reserved seats? Minorities have to get an SC/ST certificate which is attached when filing any form for an institution with reservation. How can we make sure no cis person abuses the system and marks himself as a trans only to get the job???

Bro no cis person will ever want to be called to trans to get jobs because trans people themselves only have jobs related to prostitution and begging. So if we were to implement reservation it would be on the presumption that they have the basic facilities to even be allowed to employment and higher education. Trans people don't even have that. Most of them don't even live with their biological parents and have no means of achieving any kind of opportunity to access education, least of all jobs. This is derived from the first person testimonies of trans people who have gone through the screening committee process that Tamil Nadu Aravanigal/Transgender Welfare Board used to. This bill's earlier version was a cut copy paste from that model. And was opposed and protested against by the transgender community vehemently across India. They watered it down, but yet by giving power to district magistrate & chief medical officer by insisting on surgery and it's certification, they essentially put in a screening process without actually calling or terming it a screening committee. That is why we oppose it. No third person has power over your gender identity. Then why should any third person have over ours? Especially the state?

The bill explicitly mentions the word 'satisfied'. If that is not screening process for you wherein we are physically 'checked', because how is the district magistrate going to be 'satisfied'? And this has enough evidentiary precedent from many of us Trans people themselves. Just because rules are not made yet, doesn't mean the injustices are no there.

@Ray I dont agree with gender being a spectrum - gender is either man or woman. But a human can identify themself as either of them. Trans woman identifies as women - that means they dress, look and groom like a woman. But the problem which appears to be with you is that you don't want to get 'identified' as a woman but want to get identified as 'trans-woman' which will make you feel and look 'different' from society. This kind of grooming - short hair, chest hair, unshaven beard, and then a saree - what are you thinking? I might be unaware about feeling of a trans person - but I do feel sorry for the discrimination. Discrimination based on God-given feature - like sex, race, parent(caste) - but I do feel if you identify yourself as woman then please dress like one. Then atleast you are not inviting unwanted 'attention'. I know ideally no one should discriminate based on looks - but we dont live in a society of intellects. People judge others based on appearance - not only in India but across the world. But the point you raised about the bill are valid - sexual assault should have been judged equally and I do think this bill can be challenged in court.

Not really. What this bill does is create a two-step hierarchical process wherein me self- identifying within the binary is not enough. Surgery is required. And not just that, a chief medical officer (unclear why), as well as district magistrate will give me certificate as a woman only after being 'satisfied'. Being 'satisfied' is no longer about self-identification, it is about arbitrariness and giving power to third persons over my gender identity.

Also, under existing system, in Delhi as such, you need the certificate of a qualified mental health professional to as such access and change your gender legally. And surgery is still insisted in passport etc which is violative of the Nalsa judgment of the Supreme Court of India. Which calls insistence on surgery or any kind of medical or hormonal treatment for recognition of one's gender identity as illegal & unconstitutional.

But to counter it, I'd like to say, District magistrate or some level of government officer is involved in giving the traditional gender certificate, but since that is too easy due to historical acceptance of male-female, ur frustration is valid. But for the government, a government official has to be appointed to sanction such decisions. Procedures or rules for him/her to be satisfied can be altered without even disturbing parliament.

We have been saying for years now, stop putting district magistrate screening process at the level of identification and recognition. If it so much as bothers you, then put it the level of disbursing welfare benefits. The govt is completely aware of our concerns and the solutions we have put up. Please don't justify them. Also since you have looked up the govt bill, see the private members' bill of Tiruchi Siva. Which was passed in Rajya Sabha, the first time a private members' bill was passed in several decades & it was far more progressive.

How can you say that, what do you know about my life, I am not a straight person, I grew up with a lot of confusion and disregard from people. Later in life I realised the problem which I was facing was not completely due to my gay sexual orientation but my obsessive identification with my sexuality.. Our society needs to change for sure, but that is less in our control, more control we have on ourselves Some have really biological hormonal peculiarities regarding sexuality But many in my circle of gays and bisexual I see it's more of over thinking and wrong thinking habits.... Madam, you don't know my struggles to survive. Neither do you know what I go through every day, the amount of violence to even live. The point being made here is the problems in the Transgender persons' Act which in the name of protecting our rights, actually violates rights of trans people like me. I respect every human being and their dignity of living and to that extent I am with you. But I don't necessarily subscribe to the notion of being gender being one thing and sex another. I understand intersex people but these people with "biologically male bodies" claiming that they "feel like a woman" is something that is utterly preposterous, because for one thing how do you know what a woman feels like? What is it that tells you that you feel like a "woman"? On close inspection it will be found that it really has a basis on someone feeling masculine or someone feeling feminine. Now of course, men can be feminine and women can be masculine, there is no doubt about that. But what I fail to come to terms with is the contradiction where it is generally said that traits do not belong to specific genders (for example, the idea toughness is associated with masculinity and tenderness is associated with femininity) and that they are merely stereotypes but on the other hand that very same narrative allowing a biological male to identify as a female based on the account that that person possesses more traits that are stereotypically female than traits that are stereotypically male. It's all kinds of crazy. And I am not sure why society is mainstreaming this delusion. The day is not far when even schizophrenia will be something "normal".
