As a lawyer I feel that there is a procedural irregularity here. Disciplinary hearings and sanctions hearings follow the same form as criminal proceedings. There are two phases. The first is the question of guilt ie was Rassie guilty of contravening the rules. This question is simply a comparison of what he did with what the rules are. Once it is established that Rassie did contravene the rules that is the end of the first question, ie the question of guilt. The second question is "What is the appropriate sanction?". All aggravating and mitigating circumstances should be taken into account to come to a correct decision as to the appropriate sanction. The negative effect on Rassie's actions on Nick Berry's reputation and his family life were front and centre for the panel and yet they came to the conclusion that the question of whether Rassie's criticism was right or wrong was irrelevant to the inquiry. That is irrational and procedurally unfair. The accuracy of his comments must be a relevant mitigating factor when it comes to deciding the appropriate sanction.
@markwillies43302 жыл бұрын
I agree wholeheartedly with you but it seems like these rugby judicial bodies throw up decisions by lawyers who probably earned their degrees by watching Law and Order and other TV shows.A lot of these jokers are QCs but you wouldnt think so sometimes. I'm curious to know how they dealt with Erasmus' claim that he only sent the video to people in the loop ie for official purposes only and was not responsible for its leak. What proof did they have to the contrary and if there was none how could his actions be deemed to be naughty.

My problem with this whole issue is, more often than other top teams, the Springboks get the bad end of poor refereeing. In the past we mostly "shut-uped" about it to our own detriment. I my view that is BS, the reffs are not to be placed on a pedestal and be un-touchable. If they messed up it must be made clear and open in the public domain. If not, that's what will bring the game into disrepute, nothing else. Yes maybe Rassie should have tried a more procedurally correct approach, but the fact are the facts, the ref had a piss poor game and why should that not be made "officially Public". The reffs are not holy and above criticism.

Bill Baumont and world rugby should be held to account but I won’t hold my breath

I dont agree Nick. The referee has a job to do. Not plus minus,but 100%. Apart from doing a job a referee needs to be consistent to both teams. So this is my point any action creates a reaction. The severity depends on the incompetency or competency. World rugby bacauce the referee's is crown game appointed by world rugby has not fulfilled its duty to do a job 100% and neither has they been consistently and therefor raped the laws of the game and negatively impact world rugby and put the game in disrepute by doing so. So world rugby dont want to take responsibility. But they instigated a case against RE and punished him So the verdict is rules for me but not for thee. Is this rugby.Thanks but no thanks.

As a South African you should be supporting Rassie who was only saying what most of us believe, Beaumont and International Rugby are so out of touch. You have referees making bad decisions, stopping the game to call in his two assistants, then the TMO who half the time is clueless but telling the ref what to do. Bring back Nigel Owens, he was the best ref ever!!

@brendangoosen2 жыл бұрын
Huh. He broke the rules, there are consequences and legally binding. So it is right that Rassie receives what is due to him. BUT what Nick is saying is WR never argued what Rassie proposed in the first place. Instead focussing only on what was in breach of contract. What Rassie says is completely correct. But is he allowed to say it, no. Not publicly anyway. Is WR wrong yes and should Refs be held accountable probably. Everyone says the ref was impartial and reffed the game in an unbiased manner. From my perspective he only started going after Englands repeated infringements when there wasn't much time left AND when England had momentum shift and could afford the loss of a player. However if I was a ref in that situation I would be under enormous pressure to not piss off the stadium full of England supporters who paid good money to see England take down the World Champs. What do you do? You wait for momentum to change, don't piss off the crowd and make sure the players make it clear and obvious that they leave him no choice but to send a player off. So it is tough, but is it? When the ref is dictating what he saw and what he is going to go with and the contributions from other officials is mere side show I think we have a problem. He definitely new the script yesterday. Im not sad we only lost by 1 point at Twickenham at the end of a long season. Not at all.
@jacquesliebenberg18432 жыл бұрын
The problem is: the games are tight. One “bad” call changes the outcome. Any in any testmatch there are “50/50” calls (and the public should accept ref’s judgment) , as well as plain and simple wrong calls. The reason why refs are not kept “accountable” is because if they”admit” to a wrong decision that altered the outcome on the Sunday, it will not (can not) change anything… Hence - we need to revolutionise the way the game is officiated, not get the refs to accept blame without it being able to alter match outcomes. WR needs to be creative to reduce the human factor. Give captains review opportunities as in tennis. It will slow the game - but I dont see any other way.

So the experts miss the entire point. 12 years ago, the Australian and English boards started with manipulation of rules in oder to make objective rules subjective and the opinion of a ref. The result is that matches can be manipulated. The old farts will never capitulate on effing rugby to suit the incompetent Australian &English teams. Now these so-called experts jump on the bandwagon and do not address the real issue. The deliberate move by the old farts to elevate the opinion of a ref above fair competition, has now evolved into protection of idiots rather than to admit their one-sided effing of the rules should be reversed to objective rules being applied so that no individual would negatively influence any game. Yet, if so, their pathetic teams cannot feature, and that they will never accept. So, bulshit refereeing is here to stay in the hopes that ausierules and English rugby would suffer at increased support of union. This will also never happen, and the bottom line is rugby union has been irrevocably effed for no benefit to anyone. Talking about morals, world rugby are the last to comment, but yet Mal Ed and company will still support the old farts. So much for the so-called experts.
