Let me know in the comments what game YOU would be willing to fight to protect! (I rant about it in the episode, but for me that game is Final Fantasy 9 … Vivi is my spirit animal.) 🥰😂 Likewise, I also just want to say *thank you* to everyone for the feedback from last week’s episode. I’m still trying to find the right balance between comedy and commentary, and I just want you to know that your advice means the world to me. I hope you like today’s episode! 🙏 The topic of games preservation is incredibly important, and I’m grateful for the chance to talk about it (and make a few jokes) about the state of the industry and Nintendo’s actions on this front. More than anything else, if you’re in a position to support these types of organizations (the Internet Archive, Video Game History Foundation, Game Preservation Society, etc.), please consider doing so: Internet Archive: archive.org/donate Video Game History Foundation: gamehistory.org/donate/ Game Preservation Society: www.gamepres.org/en/support/ They need all the help they can get, and I really believe the best way to nudge the industry in a good direction is to vote with our wallets and talk about these issues publicly. Also, check out Moon Channel’s videos (www.youtube.com/@moon-channel) for insights into the legal battle that continues to rage on this and many other topics. Their videos are interesting, and highly informational! Lastly, my friend Apacalpa (www.youtube.com/@apacalpa) has given me a lot of support and feedback during my start on KZbin. Please show him some love, especially if you’re interested in repair videos and technology! Let me know in the comments what game YOU would be willing to fight to protect! (I rant about it in the episode, but for me that game is Final Fantasy 9 … Vivi is my spirit animal.) 😂 See y’all on the community tab! Thank you for being a friend to the channel! Clyde

Love the videos, i agree with u 100 percent. Bro I have been saying this since the switch came out, instead of virtual console we have bunch of crappy indie scam games on eshop and then Nintendo online service, wii u we still haven't got zelda wind waker and twilight princess and they could easily port those games and make a killing on switch, now 3ds is a huge disappointment, zelda ocarina of time and major majoras mask, fire emblem echoes, fates, awakening, pokemon sun and moon, zelda a link between worlds, I can go on and on with some truly crazy good games that we should be able to play on switch via virtual console, it's literally insane nintendo won't re sell these amazing games, luckily I bought a new 3ds xl and modded it so I have all the games I could ever want and retro games however I'd gladly rebuy all those games on switch if Nintendo would allow us to buy and play them, the 3ds and DS saved Nintendo from going bankrupt due to poor wii u sales and almost all the wii u games got switch ports besides zelda which is insane, but none of the 3ds and ds, which literally have some of the best Nintendo games ever made and saved nintendos company, its the craziest dumbest thing ever a 12 year old could run the company better. I really don't get Nintendo, do they not wanna make money and save these great games and make them playable on modern consoles? Ppl hate on xbox but they actually listen to gamers and have an incredible reverse compatability feature on xbox where u can play almost any xbox game ever made on the latest xbox and when u buy digital that games stays on your account why Nintendo doesn't do this is beyond stupid as well but even then at least sell the games but we can't even do that smh

Nintendo: "We need to protect and preserve our property by destroying all attempts to preserve our property, also we want to be able to sell you the same thing again and again in the future; we currently don't have any plans of doing so but we want to have the option." And that's not even getting into the aggressive control measures that do nothing but inconvenience legitimate users like how they encrypt save data so that it only functions on one specific console or the myriad of more sinister speculations for why they don't allow you to own/play games from their past.

It's all for Profit. If it were legal, Nintendo would put a kill-switch in their games and consoles, forcing you into buying the newest systems and the newest games with no guarantee that you can ever play your old games again. They see their own library of older games as an active threat to their profit margins. Hell, a big reason for this hostility is Romhacking and Console Modding, which they have successfully criminalized in Japan. It's in the interest of their profits to make these things 100% illegal in the West as well, simply because they are places where Nintendo *doesn't* have control over the consumer. They want a "Disney Vault" of sorts, where they have complete control over what games are playable and for how long. And as soon as a game isn't profitable anymore, they would very much like to be able to lock that game back in the vault, where *nobody* has access to it anymore. You get to REMEMBER the old games, not PLAY them, at least until they decide you're allowed to. Full Price, by the way, because there's no reason not to charge that much when they can un-release games.
@NotYourFriend-YT
@NotYourFriend-YT 25 күн бұрын
That's a great comparison, @BlitzkriegOmega - I hadn't even thought about this from the perspective of the "Disney Vault" and how they rotate media in and out on a cycle to maximize profits. Ngl, I tend to want to see a law that prevents a company from removing illegal roms from websites if they haven’t been selling the game for over 5 to 10 years. Companies can take it down again if they are selling the game again in a convenient fashion. But they can’t just constantly add games right before the deadline and immediately take them off without getting fined.

I've recently watched a video that explained why is nintendo is so protective, it's linked to the creation of donkey kong : After the success of the first DK game, Universal attacked nintendo for copyright infringement for king kong, arguing that the plot was too similar. At the time, nintendo wasn't the giant they are now so if universal won nintendo would had probably not survivevide, they were saved because of copyright problems with the king kong movie script, basicly there was some disputes inside of universel on who owned the script, because of that the copyright wasn't renewed and had entered public domain. Nintendo won the case and learn a lesson, a terrifying lesson for a company: "no matter how big a company (you)is and how small the opponent is, one mistake can cost you everything". And so nintendo act in fear of that lesson, they flex there legal muscles so much because they're terrorized at the idea that a fan game, or fan anything for that matter, could be used as a never thought before legal loophole who would make them loose their rights to their IPs.
@ToyKeeper

Copyright used to expire after 14 years. The idea was to give creators a temporary monopoly long enough to be compensated for their labor, but short enough for the works to fall into the public domain while they're still relevant enough to add value to society. We should go back to that, or maybe even shorten it to 10 years because the world moves so much faster now. Then old media could be easily preserved and used freely, both to enjoy it as-is and to spur all sorts of innovations.

Yeah, Nintendo is always going after fan games, but the frustrating bit is that they don't stop the games while they are in development, they only go after the creator of these games after they have released their games and made them playable. I still remember one of my favorite fan games of all times was Super Mario Crossover, which was created on a website called explodingrabbits or something like that, and the thing that made that game great was that you could play as all sorts of other NES characters in the levels of the first Super Mario Bros, where my favorite character being Ryu Hayabusa from Ninja Gaiden, as you could just totally destroy the levels and wreck Bowser in all the -4 levels, and that game was very neat because not only did it have other characters from other NES games, but you could also use graphics from other systems, such as having sprites from GameBoy or even SNES versions of the Mario games, and it eventually even added sprites from like the Contra series and all the other games where the other characters came from, making it feel like the Mario levels had a different feel to them with those other sprites, but unfortunately Nintendo went after that guy and he had to stop development of his game, as he had been planning in adding in the Lost levels and a couple of other things to the games, but he was stopped from doing so. Fun fact about the development of Super Mario Crossover though, according to the creator in a few KZbin videos as he was working on the game and such, the guy actually developed the game while he was homeless, as it was his only way of basically distracting himself throughout his whole depression and stuff, and through the encouragement of people in the ROMHACK community and stuff, is how he managed to bring the game into a state he was satisfied with so he could upload it online, and he also managed to get his life somewhat together in order to stop being homeless, but I don't know what happened to that person after Nintendo went after him. Its why I get frustrated with Nintendo, because they go after everybody claiming they are only protecting their IPs, but they just cause a lot of damage in their attempts to do that, which is why I can't blame the people that turn from being fans of Nintendo, into being their biggest haters because even I have gotten tired of Nintendo's BS, I just wish that they learned from Capcom or SEGA, who are more chill about fan creations and stuff, and actually encourage people to do better, such as how Capcom published on their official websites the fan game Mega Man X Street Fighter, or how SEGA actually hired Christian Whitehead the creator of a lot of Sonic fan games, so that he could work on Sonic Mania and stuff, which is arguably one of the best Sonic games made in the last decade.

I've said it before, I'll say it here too. The video game industry is blatantly anti-consumer. A lot of the time, the problem is that by being pro-consumer, the studio could make $$$$$ and $$$$$$$$ later, but they would rather make $$$$$$ at the moment even if it meant they lost money over time from it. Ironically a lot of the time they will turn down that money if they got to screw over consumers. The death of older videogames seems to be very much by design. "Don't think, just consume product, and get excited for next product". You see if you are playing an older game, you aren't playing a newer game and if you aren't playing a newer game you likely didn't buy said newer game (because you saw no need). That means any older game can become a threat for a newer game. As time goes on, older games make companies less and less as prices drop. If a person buys used, the company makes no money from that sale. The chances of a person buying used goes up as time goes by since less and less new copies are available. If it was impossible to DL a rom, then Nintendo would probably not sweat so much. They know that they could easily make a killing by either only selling new games or if they resold older games they could sell at a high price and still be cheaper than the used market. Unfortunately for Nintendo, Roms are a thing, and they are incredibly easy to get. Some companies seem to get it for the most part. Sega puts all of their older games on pretty much any platform you can think of. On PC, the classic games they sell for their Genesis and Master System software emulator actually come with standard roms in a folder titled "uncompressed roms". Sega also has Steam Workshop support for that to give users the ability to upload and download romhacks. The romhacks are also downloaded as roms. Both the standard and romhack roms can be played using any other compatible emulator. There is an unfortunate side effect of the romhack feature and that is that some people abuse it to post or download Sega games they didn't buy (or can no longer buy in the case of the Sonic games). I assume Sega knows but either doesn't care or think it is worth the hassle of dealing with. Valve also comes across as an exception since they allow fans to put their own mods on Steam for anybody to use. Other than the Workshop, there are mods that have their own store pages that are free to download if you own the game the mod is for.. And then there are fan games that are also on Steam such as Black Mesa. Valve generally celebrates fan efforts. Some of Valve's games started as mods and they've hired modders too. There are a couple of exceptions. Most notable is they sent a cease and desist to the man who was making Portal 64. However, they only seemed to have done so because he was using proprietary Nintendo libraries to make it and Valve did not want to be brought into a lawsuit with Nintendo or burn any bridges. SImilarly, they disallowed Dolphin on Steam for a similar reason (ironically, Retroarch is on Steam and that can emulate a bunch of Nintendo emulators). Despite my initial paragraph, I don't think Nintendo outright hates their consumers. I do however think they care more about control than most developers. They care even more about it than money at times. There have been countless examples showing that not treating consumers badly can still get you a lot of money, but it of course means there will be some control given up. To be fair, Nintendo cares deeply about how it is perceived. You or I may not think anything of a mod that gives Mario a Shotgun, but Nintendo might recoil in horror. On the other hand, if they cared so much about their image, one would think they might not be so anti-consumer at times, and also...you would think they would clean up their eshop. While everything on there has an M rating or below, there is a perception that they allow softcore p*rn. Sadly there is some truth to it. There are games on there that have little to no gameplay and only exist to show you lewd artwork (oftetimes AI-generated artwork). They technically never reach an AO rating but they aren't games like Witcher which often show more but have an actual game surrounding the lewd. It's weird to me that a company that will shut down anything they perceive as harming their public image, allows their store to be overrun with this stuff. It's like they want to be seen as an open platform, but don't want to commit all the way like Steam does. And they also don't give the user any real way to filter it out like Steam either. Steam by default hides it and it knows there is a difference between something like Huniepop and something like The Witcher 3 or Grand Theft Auto. The Eshop shows it all, and even setting up parental controls still shows the thumbnail and title and of course if you block it out you block out Witcher or Doom. I wonder how different it would have been if instead of all of the shovelware (especially the thirsty shovelware), you went on there and there were all Nintendo's old games as well as any new game. Imagine logging on and seeing they have Wind Waker on sale for 5 bucks. Maybe Ocarina of Time is on sale for 1 dollar. Maybe they have a bundle of all of the older Zelda games for a few dollars. Nah that would never happen. We all know Nintendo would try to sell them for like 60 bucks each if they could. That's what they did with Donkey Kong Returns. A full 60 dollar price for a Wii game. They know Dolphin exists. It can play most Wii and Gamecube games flawlessly on even some toaster hardware. Playable in 4K too. They packaged a wii game in 2024 and said it was worth 60 dollars. No wonder they are so against any preservation. Again, companies like Nintendo know that if people normalize the act of downloading a rom and playing it on any hardware, it becomes way harder for them to sell the most basic ports one can imagine for ridiculous prices. If you're playing an older Zelda game then you might not buy the new Zelda game when it comes out. If you're playing an old Pokemon game, you might not buy the newest Pokemon Games. Nintendo also engages in the same practice that Activision does with CoD games. The idea is that if every game is the same priice, the consumer is incentivized to buy the newest entry. Most publishers will reduce the price of older games when new ones come out in order to get new customers into the series. Not so for Nintendo. That'll be 60 bucks for that port of a 15 year old game please. If you're lucky they might cut off a few dollars. It may seem backwards, but if money was the goal, sales and cheaper prices have been consistently shown to be good for the developer, the publisher, and the consumer. Steam got so big largely because of it's use of sales. Many devs learned that when their games went on sale they actually made more money since more people were buying. And it isn't just short term either. People buying your games now lead to them buying your games later as well. It benefits everybody, but doesn't allow full control and Nintendo wants that more than the money. They would rather spite consumers than give up that little bit of control. They may not outright hate them, but they do not like or trust them either.

Thank you for sharing your knowledge and insights @AlbedoAtoned, and likewise, my apologies for the delay! I really like your point about the use of sales. Like you point out, the experience of sales on the Switch could be *SO* different, and it would be amazing to see something analogous to Steam. (I know some people feel that Steam sales as of late haven't been as strong, but I've been lucky to find some good discounts). Likewise, I think your point about Nintendo trying to exert "control" is spot-on. Not just in their pricing models, but in their lack of mod support, fan content, thrashing competitive scenes, etc. Control is a *huge* part of their intent behind many of the decisions we see today, at least, that's how I interpret their actions. If I may ask: are you mostly gaming on PC these days? (I'm on a Steam Deck myself, and it has become my favorite console as of late.) ❤️

Nintendo has gotten a lot more greedy in recent years than they ever were before (don't get me wrong, they've always been pretty scummy, but they've gotten worse). Its honestly kind of depressing, given how much I love Nintendo's games. They screw over fan games, make botched controllers that stop functioning in a fraction of the time it takes a wii remote to give out (Switch controllers can even stop working in less than a year of buying them, I've had more issues with the Switch than I have had with my Wii in the past 15 years), they hate video game preservation, they release unfinished products far more frequently then they used to, they locked basic online functionality behind a paywall (we never knew what he had until it was gone), and so so much worse... I am one of the few fans with original hardware. Every year it gets harder and harder to find retro games in playable condition. ESPECIALLY GameCube titles. The discs are literally starting to rot! Others are becoming brittle and cracking. *ROM back-ups are the only way to ensure preservation of these games.* And the worst part is, GameCube games are tricky to dump at home without specialized hardware. I can't easily buy a retro-player that connects to my PC like for GB/GBC/GBA or NES/SNES/N64 cartridges. Fans literally don't have a way to create legal (under US Law) backups of the software we physically own. I just obtained a copy of Earthbound for my SNES. The condition it was in, was boderline horrific. I worked my ass off to deep-clean and restore it. It was the most disgusting cartridge I have ever dared to try and save. Its one of the only games I would ever go through what I did to save it. Because I know how much this game matters to so many people. Nintendo's actions are indicative of Japan's extreme copyright laws and the fact the company STILL can't operate amicably in the global market. I love their games and systems. But until there is a serious culture-shift at Nintendo, I will never cut them slack. They need to be called out on their bad behavior. Thank you for continuing to shine a light on these problems.

“The unapproved use of Nintendo’s intellectual property can weaken our ability to protect or preserve it, or to possibly use it for other projects.” So what you mean is, YOU want to preserve your games yourself, not have us do it on your behalf? Then do that instead of striking down game preservation efforts. It’s your older stuff, not your newer stuff, what sales are you losing?? (Answer: None.) I don’t remember all the games that use older sprites, but I’m pretty sure NES-era Mario has been around so long, people can potentially recreate it with their eyes closed. Just because Odyssey and Mario & Sonic 2020 Olympics had Mario sprites doesn’t mean you lose sales compared to a FREE 2D Mario fangame with SNES-styled sprites.

The age of piracy has already passed. Big companies have their sights set on legacy websites like Internet Archive and other preservation sites. If you're new to retro game collecting, you've missed the boat entirely. KZbinrs who can't seem to stop talking about it aren't helping. This used to be a niche community and a niche hobby. The more it's talked about, the greater chance it grabs the attention of big companies like Nintendo. "Influencers" are the downfall of the legacy internet. It's like Nintendo truly does hate their fans, and looks down on everyone. What they're doing is malicious. They never used to be this way. Sure, there has been times when they made decisions that weren't good for consumers, but the passion was still there. I'm guessing when Sotoru Iwata passed away, Nintendo just lost its heart and it's now all about ego and profit. They used to show love to their fans, making their actions easier to swallow. Now there's nothing they do for the fans, just try to fleece them. The last thing I bought from Nintendo was a New 2DS. I sold it less than a month later. I dunno, I just felt icky and disgusted just having it in my possession. I may enjoy a Nintendo property from time to time, but definitely not the new stuff.
