To give further clarification this is a Patent infringement lawsuit, not Copyright infringement like everyone thought back in the day. So this lawsuit has nothing to do with artwork of character design. Instead it invovles mecahincs. The mechanics in question that Nintendo patented and are suing for is (apparently) (1) The targeting system of tossing an object at a mon in an overworld, like what we see in Legends Arceus. (2) Getting on and off a flying mount in the overworld. (3) And releasing creatures into the over world via an object. What's even crazier is that (at least the targeting system one) the patent(s) was refiled in May of this year.

Not about what you feel as a gamer is what can be proven legally and the lawsuit Nintendo has filed that’s not an easy lawsuit to prove. Because it’s OK to take something very similar to what someone has done and make slight modifications to it and turn it into your own as long as you don’t take the direct name of the character they have made. For instance, go on right now you can look up several comedians who have done comedians standup performances, and you will find clips where other people have posted them, but it is perfectly legal because they took the clip and they made slight and slight changes to it. For instance, if you take a clip of Dave Chappelle doing stand up word forward and you just insert a few moments of commentary, no lawsuit. You could take the entire clip of his comedic performance and if you animate the clip lawsuit. In order to infringe upon the copyright of someone, especially when it comes to digital media, you have to almost copy it for just slight alterations or even almost identical character in a different man that could be grounds for dismissal.

When Nintendo comes for you it's only a matter of time, they always win.

It will be interesting to see how the Palworld lawsuit plays out. The fact that it took Nintendo such a long time to do the lawsuit in the first place, makes me feel like it won't go in Nintendo's favor. You know for sure, if they had a leg to stand on Nintendo would have been hit Palworld with a lawsuit. XD
@philbarton2832

It's clear to me Nintendo have waited in the wings until Palworld has hit it's success peak so that now Nintendo will earn the most amount of money from them. A simple cease and desist back at the start of Palworld wouldn't have been anywhere near as profitable for Nintendo. Once Nintendo comes for you they come for you hard

I guess it makes sense to sit on a patent infringement until the company you're suing has become financially successful enough to actually pay Nintendo reparations. This is less likely about the infringement itself, which Nintendo knew months ago and couldve disrupted then, but more about the opportunity to acquire a giant slice of palworlds pie. Respect or disdain? Hard to place a pin in this one...

I think there's two important points -1 Copyright, IP and Patent laws work differently in Japan - where the lawsuit is being litigated - than USA, and their understanding of patent is different than ours - to the point that the final portion of TPC/Nintendo statement talks about protecting the IP. -2 Worth remembering that the CEO of PocketPair has been outspoken about designing games that sell, leveraging trends and mechanics that will help them do that. So saying that they'll defend their stance " to ensure that indie game developers are not hindered or discouraged from pursuing their creative ideas" is pure BS as it wasn't a creative endeavor, it was a money-making focused one (and yes I know every game is ALSO a money-making endeavor).
@MellowFelloh

May be money focused but they still put out a good product. Might not be your cup of tea but tons of people enjoyed it especially over most recent Pokemon games. It's a game that transforms from a survival game to a Pokemon game and late game it's almost Monster Hunter like.

@@MellowFelloh Oh for sure. I'm not denegrating the quality of the product in the slightest - and the sales speak for themselves. We need more AAA-like monster catching experiences that inovate and push the genre further to light a bit of a fire under TPC/Nintendo's ass to push the Pkmn games forward and I'm glad PalWorld started that. However that cant and shouldnt be done while circumventing the creative process and legal compliance in order to get their product to market faster/cheaper/coast on the "pokemon with guns" comparison. Bought a PS4 Pro because the original was a jet engine, and kinda badly built machine. It made sense to buy the Pro. But this time around, i dont see why to buy a console with incremental power boost, without disc drive and i dont have any issues with my current PS5, its not a jet engine or anything. I think this time around Sony made a Pro version a pointless upgrade and a money grab.

Kinda funny is getting further and further from actual games related anything. The fact that they didnt even look into what the lawsuit was (that ots about patents for game mechanics versus trademarked characters) but still talked about their opinion... maybe take some of the time talking about Ben's bday, neck shaving, and in and out to actually look into some of the news stories? I used to like the irrelavent side talk back when they actually had some insight still into news, but the actual game news side gets shallower with each year.

@Hugop_arts
@Hugop_arts Ай бұрын
That's a misrepresention of the story: -The author didn't "fake" them. What people were claiming as an admittance that they were faked was an escalation of when the author of the post confirmed they re-scaled (PROPORTIONALLY, btw) the models to be able to overlap/line them up. That is what we in the industry call "non-destructive" and you don't even need to be on a 3D modeling program to do that, you can do it in engine and it doesn’t affect the overall mesh, much less topology. The same comparisons that went viral were replicated by others and verified as such.

I think both are valid points. Ideally the success and hunger of people for a game like PalWorld shows Pokemon Company that they need to step up, and their success fosters more AAA tackles at the genre. However the need for pokemon to step up shouldn't give PalWorld a freepass to circumvent the creative process and legal compliance in order to get their product to market faster/cheaper/coast on the "pokemon with guns" comparison. Both should be held accountable

@drakedrago2339 exactly. Cassette Beasts, TemTem, Nexomon, Coromon... many others have existed - including on Nintendo platforms - just fine. The reality is that Patent/IP/Copyright laws work differently in Japan - where the case is being litigated - than in the US, so the fact that those others haven't been sued highlights that it is not about monster catching mechanics as, if it was, TPC/Nintendo would've previously sued those to contend that they're protecting their patent (in a USA view of how patent works). The thing is, Palworld isn’t Pokemon with guns. It’s Ark with Pokemon skins on the dinosaurs. Pokemon is trying to claim patent on an Ark Survival clone. Nintendo shouldn’t win this. This honestly is a case of indies fighting the cooperation. As cringe as you think that last line was, it’s 100% true. Nintendo needs to be stopped in this case. TemTem is a literal Pokemon game. Where was Nintendo? The fact it’s not a COPYRIGHT claim but rather based on PATENTS is wild.
