exactly this I remember seeing a video that says nintendo wants every monster tamer but pokemon in the dirt, even their fan made games, so if someone wants a creature rpg they have to buy the new official pokemon games (ItS ThE PoKeMoN CoMpAnY argument inbound) it's looking less like a theory and more like reality now

Pokémon had years upon years to make something with Palworld's scope and quality. And mind you Palworld's scope and quality aren’t even that particularly high, they are just more in line with modern standards and filled a niche that Nintendo deliberately left vacant. Nintendo/Gamefreak spent that time shitting out half baked games knowing it would sell because of the name attached, and rather than compete when another company tries to fill that gap, they resort to quash it with a legal hammer.

If they planned on suing, idk why they waited this long. They also probably chose the least credible option for a lawsuit. They're claiming Palworld took their game design when Palworld is nothing like Pokemon. Palworld is a survival, base defense, open world, RPG game. I seriously doubt they can win based on capturing monsters especially since those monsters are used in ways they arent for Pokemon. Pokemon doesnt let you kill your captures or use them as slave labor. They also dont let you apply weapons to your captures so the simple mechanic of capturing a creature isnt nearly enough to win a lawsuit over. The only way i see them winning, is by using their money to drown Palworld in documents.

People have been disillusioned with Pokemon for a long time. At least since LGPE and *certainly* since SwSh. But those always felt like Gamefreak was trying to dumb down the series because they felt like they had to in order to compete with smartphones for the kids' attention. It sucked for older fans, but it was understandable. SV was different though. They didn't just make it pathetically easy for the kids they apparently look down on. They sold people a blatantly un-finished product, and the fact that it seems like they got away with it left a sour taste in peoples' mouths.

What patent are they actually suing for ? Monster catching ? Survival strategy ? Can you even sue someone for a game mechanic(s) ? If they did that, it would be like Disney suing everybody that dreams up an imaginary princess or hero.

Yes, famously, we couldn't have any loading screen mini games for almost a decade because Namco had a game patent on them. It's rare the companies use them, because it's a grey area of copyright that make the company look bad

This lawsuit is probably due to Sony's partnership with Palworld into merchandizing. Pokemon Company is a merchandizing company, and while making a game that has characters that kinda look alike is hard to use (Pokemon, Monster Quest, Digimon, Yokai-Watch, RoboPon, etc), when you try to sell a plushie of a Pal that kinda looks similar to a Pokemon, that's when it gets rough.

The fact of the matter is that the designs are derivative and not straight copy+pasta. There are enough differences in the designs between Pals and Pokemon that it will be difficult to sue Palworld over them. If you want to have the opinion that they aren't derivative enough for you to find acceptable, then that is okay. You have the right to exercise your power as a consumer to not purchase Palworld. But as far as the court is concerned, we're not going to see a lawsuit over designs.

As a diehard pokemon fan (you can probably tell from the pfp and what my channel focuses on lol) Theyre just jealous palworld is objectively a better game, actual bug fixes and unique updates, doesnt run like Just Cause 3 on Xbox One/PS4, The design is actually good, better mechanics, its overall better than S/V im still jealous i can't play it because it just seems like such a better alternative rn

Pokemon already tried to sue for design and failed as before release, the Palworld team sat down with Pokemon to discuss design, and they got the official okay, so any argument for using because of design is already out since Pokemon gave the legal okay. And even then, they sued when the game was released and failed cause of their actions.

@cyberworld9000 @cyberworld9000 My memory was wrong on the sue they dident put it in but they investigated and almost decided to but they held off trying to find more to sue as already the dev of pal world went over base front legals and in their comment on quote their confident this scesnrio wouldent happenen and from the looks of it that attemp to sue back then dident go through as naturally design wise if the pal and pokemon wouldent hold with the fact both company went over the legals. Also soruces this is during january so filters needed if you want to see it better as ign bbc nbc kotaku during january 2024. From their article's on the subject and how pocketpairs actions and response in january.

Pokemon didn't invent the monster-collecting genre. Megami Tensei and Dragon Quest V both predate it. Anyone can make one and plenty of them exist. That said, it's still possible Palworld copied Pokemon's designs or game mechanics too closely. I don't know enough about the game to know for sure.

Mechanics not really, besides capturing in a sphere. As for design, Nintendo already swept through the game in search of reused assets from Pokemon. Everything is built from scratch or non-nintendo assets and different enough to evade legal notice. It's like if I made a yellow electric rat, named Mika. Nintendo couldn't sue me. Yellow is commonly associated with electricity, and an electric rat isn't a special thing they have claim on.

Lawsuits take a while to happen, so while it could be happening because of the Sony thing, they were probably cooking this lawsuit for a while. They could also be trying to heavily discourage pokemon-like games from being made in general.
