No Carry Permit Needed In California If You Have A Hunting and Fishing License?

California Penal Code 25640 has made a lot of individuals question whether or not they can use this language as a valid work around for California's CCW laws. This hunting and fishing exemption in the language leads some to think they can use it for that purpose. In this video I give my opinion on this language.

Native Texan here, I would say create a situation where you are in a car but you’re clearly going hunting and are fishing then if they arrest you and you have to go to court you can present all the evidence overwhelmingly so, and get off, thereby creating a president in the courts for your fellow Californians

Yes and no: Yes in that Libs do not consider Rights to be inalienable. they consider them to be "fluid depending upon the current society and what society deems are rights and what are privileges". I took a firearms hunting class many years ago that was taught through the NRA. A head State Fish And Game officer gave a lecture on this VERY TOPIC. The following is what he taught: A person may carry a concealed hand gun ONLY OUT IN THE FIELD!!! while actually hunting or fishing. Unless you have a CCW permit, You may NOT CARRY A WEAPON on your body anywhere outside of actually fishing at a stream or lake or hunting for legal game AND you must be carrying your hunting or fishing license for immediate inspection AND YOU MUST INFORM THE OFFICER THAT ARE CARRYING!!! Your weapon MUST be transported in a locked case to and from your fishing or hunting place. You may carry concealed from your vehicle where parked to the stream or lake/hunting field WITH your fishing gear or rifle/shotgun AND your license. Unless you have obtained a valid CA CCW, DO NOT TRAVEL WITH A LOADED FIREARM ON YOUR PERSON!!! While in transit, It must be locked in a secure travel case OR have a visible CA accepted trigger lock.

Infringing rights under color of authority (without a physical or other quantifiable injury) is generally not a crime, but a civil tort. You generally can't arrest people for civil torts, You can sue them in the Federal Court System.

This is pretty common practice among actual fisherman, myself included. Especially when fishing in the backcountry. I would carry concealed up to getting back into my vehicle at which time I would unload the firearm and stow in accordance with standard transportation rules. I'd never considered it, but I was lucky to fill in for a guy that cancelled on a guided trip in the Eastern Sierra and our guide carried. And he informed me of the exemption and also shared some stories of "interactions" he'd had with various animals over the years which lead to him to ALWAYS carry while fishing.

I went to the Mearda County Sheriff and asked how I could carry my pistol in the back country of Mearda County. I was afraid of running into mountain lions. I did not have hunting license. I infact was going back there to take pictures. I was told to open carry my pistol when away from my jeep. I was only hunting with my camera. the pistol was for protection.

Until the Young v. Seems ridiculous that a permit is even required for concealed carry. There are only two ways to “bear arms”. You either bear them openly or you bear them concealed. If you’re not allowed to do one, that should mean that you are allowed to do the other. Barring both ways of bearing arms violates the second amendment in a very literal way.

Not every LEO knows this penal code either. I was approached while fishing in the CA delta and while the officer was incredibly chill about it, he did go back to his car to what I assume was run this penal code by dispatch or superiors. He came back saying everything was cool and to carry on.

@@odysseusnissan According to the Peace Officer's guide to CA firearms laws (Which was signed off by the CA AG Jerry Brown), you can carry concealed and unloaded on your person while walking or riding to or from hunting or fishing. The firearm must be unloaded while in a place where it is illegal to discharge the firearm. The common law on the matter is "directly to or from with no unreasonable or unnecessary stops." Many of these laws find their origin in Spanish Common Law, which was adopted by Mexico in 1821, then by CA in 1848 and codified beginning in the 1880's.

There's quite a few 2A KZbin channels practicing this very thing in Florida (same law really) where they will record themselves actually plan a fishing trip, then open carry outside with their gear, fish, then attempt to return. Sometimes cops will stop them, detain them, and even arrest them. It's an easy quick lawsuit for them and some have made a living off of it (KZbin + lawsuits).

As I understand from looking over the CCW rules in California only Concealed carry is allowed with a permit. Open carry is only allowed for law enforcement, private security with special permit, and government employees requiring a fire arm for their job function. Their may be a few others but I think you would know if you were in that exclusive club allowed to possess your inalienable rights.

It’s solely for animal self defense. It really needs to be better explained. It’s supposed to be a legal gray area if you are caught shooting a bear or a cougar that is actively charging and poses an immediate threat to your life and your only choice is to use a firearm. It’s ambiguous on purpose.. they don’t want you out there getting mauled by a mountain kitty, but they also don’t want you carrying a firearm. So that’s the best they could do. I think even if you could prove that the presentation and discharge of the firearm at the charging target was necessary, you’d still be on the hook for possession of a concealed firearm..

@Bobby Dang that’s amazing. Being that this is California, I just never trusted all the bureaucracy. I’ll be sure to talk to a county deputy to make sure. I’ve never felt safe fishing on my own since I was chased by a mountain kitty; not even fucking kidding. But I never really considered the thought of the homeless issue, that’s a good point. Make sure you always mention you ARE NOT a lawyer or an attorney when offering such information. You could be held accountable.

Thank you for finally addressing this code. In my case I called the Alpine County sheriffs office for their position on this, as I fish the Carson River a lot. Once they looked it up, their reply was not a problem outside of incorporated (city) areas that have local restrictions. Their basic response was, paraphrasing here, don't get stuck on stupide and there's no issue. As far as I know El Dorado County is the same. I try to stay on USFS or BLM lands. I also keep a copy of the code in my cell phone to show any officer. Remember NO SHOOTING ACROSS ROADS, RIVERS(streams) or near any buildings!!!! One last thing. If you're shooting in the high country use lead bullets (F... the environmentalists) as they're less likely to spark if the round hits a rock. It's more likely to happen with jacketed or steel rounds.

i believe placer county follows the same path as ldorado county. i live in cool and hunt and fish both counties. i dont concern myself as i have an eldorado county issued ccw, but i am very concerned for others trying to use this law as an option. follow the rules closely.

I always carry when I am fishing or hunting outside of urban areas- I have been "stopped" many times by both DFG and local (to respective area(s)) law enforcement, The big caveat is the area. If not otherwise prohibited (such as state parks=no carry) You can carry concealed. I have been told the general guidelines (from DFG and confirmed with lawyer. 1. from home to destination via vehicle= follow standard transport laws. 2. from vehicle to "location" carry unloaded. 3. at "location" load up and carry . In maybe a half dozen interactions with DFG and/or LEO I have not been cited or arrested . the worst situation was about an hour for the LEO to get confirmation it was legal.

Very informative. I go hunting often and always wondered the legality of being on public land and carrying a sidearm while using a rifle. It seems to me I can. I have talked to fish and game about laws like this before and they have been very helpful. Especially when I can say “officer ...” told me when I asked I can use an ar type rifle while hunting as long as I am under the ten round limit.

I have been through the whole process. Worst part was being on probation for two years. Pulled over once a month, cuffed, and vehicle searched.. they came to my house and saw nunchucks hanging on the wall. The gun was misdemeanor, site and release. Nunchucks was felony, immediately to jail.

@@skylerjacobs7422 they dropped felony charge. Did three days. Ventura County sheriffs were messing with me hard.They were convinced I was a drug dealer. They showed up to arrest me at work for some bullshit too. I’ve been in and out of the same community for 40 years. People know me. I happened to work with the commissioners wife. He hooked me up with his friend and most high profile lawyer in the county. For free! No more problems. It started because a tweaker chick ,that hung out at surfers point ,convince the Ventura county narcotics task unit that we were drug dealers.An operation was developed to take us down upon our return. I backed up to my spot, looked up and the van was surrounded by 15 dudes in tactical gear weapons drawn. They obviously didn’t find anything but I did have a gun. The only mistake I made was asking for a drug test. I passed the test easy, that wasn’t the problem. When I was at the station, that chick broke into my van and took my cash and valuables. It was like being caught up in a weird movie, you’re the main character, and don’t know it. The chicks name, I swear to God, was Courtney love( Obviously not THE Courtney love) but, still that’s freaking weird. The story is funny to look back on now, I learned a lot of good lessons. (6yrs ago) Got my guns back.

I really appreciate this. I have a $2,000 ebike that I strap my fishing pole to and take down to Venice Pier here in LA County. I like to go fishing right after the sun goes down, but it gets wild down there sometimes with the homeless people. It seems like I can conceal carry my firearm down there, so long as it's unloaded, then load it once fishing, and carry it back unloaded, so long as the firearm is registered in my name and I have a fishing permit. (It is, and I do.)

My brother and I hiked a portion of Henry W. Coe State Park and the adjacent Orestimba Wilderness 10 years ago. It's between the 5 and 101 freeways near Morgan Hill and Gilroy. I think it's the beginning area of N. CA. We arrived there in the afternoon or late morning and ended up hiking all night till 10 AM! It wasn't our intention but when we tried to hike back the same way we came later at night, we heard a mountain lion screaming which was probably warning us to stay back. I never heard that sound and it frightened the heck out of us. At that time I wished that we had a gun even though we had knives. I didn't feel confident enough to defend myself against a mountain lion with a knife, so we took a different route back that ended up taking us way off course. It seems that hardly anyone went there because we came across wild animals several times. A fox even approached me at night when I had my red head lamp on. It was absolutely curious and dumbfounded as it approached me. It had no fear of humans it seemed. I wasn't even aware until my brother told me hold still. The same thing happened with a smaller animal that just froze as touched it. That place is like a vast wilderness, so it's easy to get lost and people have died there getting lost. At that time it didn't seem that rangers checked that area because it was one of the least visited parks in CA. In fact, when we finally reached the end of the park, there were no cars or people. My brother had gone there before and he never saw any rangers. He was also the only person there every time he hiked. I don't know if that's the case now. If I were to go there again or any similar places, I might consider taking a gun with me.

Lock box for transfer unloaded and concealed while walking to your spot, loaded and concealed at your spot, unloaded concealed back to the car, lockbox in the car unloaded. Follow those steps and you won’t ever have problems

What we were told by game wardens in San Diego county was that we were ok to carry a pistol while hunting in the field and to and from our vehicles but NOT in our vehicles or to and from our home to the field. This is ok DURING hunting seasons only and NOT allowed during archery only season.

I left California a couple of days ago for AZ. Travelling around in an RV carrying concealed everywhere we go. Also got one in the door storage and one in the back just cuz. And no guns have gone off and as I’m not a criminal I have not all of a sudden committed crimes carrying concealed. Everyone is very polite and super friendly. I was arrested last year by LBPD while headed to work “licensed guard w/ exposed permit” due to the fact that a female road rage driver lied and said I was flashing a firearm while driving. They got me for possession of a loaded firearm, brandishing firearm , concealed loaded firearm. They dropped it to loaded firearm. But lbc DA should have honored the fact that I have a loaded firearm due to my job and I had permits but they ignored it. Wish I had the hunting permit at the time cause I always carry a pole 🎣

from my understanding is if you have a CCW permit you're allowed to carry but can't go inside the buildings. Now if you don't have a CCW which I'm going to assume most don't what he said still applies and that is if you're fishing in national forest you're ok to carry or hunting. But only carry from your car to where you are fishing not driving around with it loaded you still have to follow transport guidelines.

Per city and county, discharge laws in each, as well loaded and unloaded will all pertain. Depending on where you are at the time of carry, know the laws in that specific town, city, county. Especially transport to and from, and during activity. Its legal with a valid hunting and fishing license. E.g. loaded vs unloaded, and trsnprotaion of a firearm. So cal., in san diego county, carlsbad has separate regs than that of oceanside as well pacific beach. Its legal, regarding local laws of discharge. Ultimately, distinguishing that facts of loaded vs unloaded while conducting your activities. Transport remain same.

Generally misdemeanors don't cause you to lose your 2A Rights, but communist States like CA and NY are passing laws that cause you to "lose" it at the State level for 5 or 10 years. That is to say you would pass the FBI check, but not the State DOJ check and ultimately be denied your 2A purchase. The Leftists in Congress have been pushing these for the nation, but obviously were held up by the Republican Senate. This will change if the Dems win the Senate & Presidency. Then the 28 anti-2A laws introduced in Texas will be slammed through at the national level immediately. It's fast approaching the time we use our 2A for what it was designed for.

I wasn't sure if carrying a concealed weapon without a permit is in that 10 year ban. My friend got banned 10 years for a misdemeanor brandishing charge. All these gun laws are crazy and dumb.

@@seanwatts392 - Correct. So far in CA the 10 year 2A bans are State only and require _violence_ as part of the misdemeanor violation. IE assault with a deadly weapon, battery, brandishing, DV, etc. The only redeeming thing is when you move away, the ban doesn't follow you to another State. The FBI at this time doesn't recognize any misdemeanor, except DV, as a disqualification for 2A purchase. That will change if/when the Dems control each branch of the Federal government.

I live in the bay area and do hunting and fishing all year long and i have asked dfw about this law. First you have to be engaging in the sport. 2 not every park/land allows you to carry concealed so you have to ask. 3 you cant carry concealed while driving on public roads. Hope that helps
