In California, I don't think there's a law stating you have to have the visor down... mainly because 'brain bucket' helmets are legal and they don't even have face shields... my Shoei face shield fogs up like crazy when it cool out. Makes it unusable when I'm riding slow or stopped... That just seems like a petty ticket to me
