The plaintiff rented a room from the defendant, and he claims the landlord didn’t like his friends. She refuses to return his security deposit, so she’s suing. The defendant argues the plaintiff moved out on his own volition and left behind lots of damages, so she doesn’t owe him a thing.

Not even that. HAVE A WRITTEN LEASE. She would have won if it says on her lease you must have 30 days notice. This also explains why she never took pics because she felt he violated their lease. So she got screwed by her idiocy for relying on a verbal lease and thinking the plaintiff would actually agree with her and saying he knew about the verbal lease lol. He clearly lied because she would have taken pics if this was a true security deposit case that was about damages. She really thought because he left without proper notice he forfeited the Security Deposit. So that’s the real reason she didn’t have pics of the damages. But yes this lesson will insure she always has a written lease and I bet she will get her current renter to sign a paper lease after the case. But her anger at the judge when it’s her own fault is what upset me. She screwed up. What she’s really lucky about the security deposit in some states is doubled if they can’t prove why they withheld it lol. So in that regard she got damn lucky.

You can have leases on room rentals. If you want 30 days notice AND the rent by a certain time on the first, you need to get it in writing that both parties signed. Otherwise, paying it at 11:59 pm on the 1st is rent paid on time! And what kind of foolish landlord doesn't take pictures of damage??? When I was in my TWENTIES I knew, as a tenant, to take pictures of my rental when I move in and when I'm leaving. Tenants and landlords should. "It wasn't fair." Are you five?! You provided ABSOLUTELY NO PROOF!!! What did you expect?! You also need to provide a letter explaining exactly why you're keeping your tenant's security deposit. If you don't provide that letter, in some states the landlord has to pay double. I am Canadian; I've never paid a security deposit, but why do I know American law better than the landlord (and a lot of American cops). And regarding the floor, you could have taken a picture with an existing tenant. Just ask or provide at least 24 hours written notice. The tenant should want the landlord to say in court that the previous tenant caused the damage before she tries to take his security deposit too.

If you know your child has asthma then you don't invite someone to move into your house that's a smoker of anyting. As far as her not returning his deposit I guarantee the main reason is she probably financially just didn't have it. I don't doubt that he probably left some things the way that shouldn't have been when he moved out but a lot of people who rent out rooms like to find reasons why they don't have to return the deposit, simply because they're broke. Hence the reason they're renting out rooms. Because financially they can't make it on their own.
