@@trudanimal562 ❤! The difference between an Court Appointed Attorney and a Public Pretender; is CAA, is from the private sector of law and he might care about U and his record in the court room. The PUBLIC PRETENDER is often times a fresh grad student out of law school w little to NO TRIAL experience their goal is to get u a plea deal. They work for the DA’s office. Which is a conflict of interest in my opinion. So I had a CAA during my murder trial and I was found not guilty on top of 16/18 other felonies they charged me with. We filed a motion to get my public defender/pretender off my case.

I had to show up to court over some absolute bullshit, I had done all my public defender stuff way in advance and had tried to make contact probably a dozen times before the actual court date never got a response. Finally I think maybe the last time I called I learned that they had taken an indefinitely of absence for like a year... When was someone going to tell me? They told me to call back and when I did they said someone else had been appointed to my case... When were they going to contact me? When I showed up nobody was there for me. Literally another public defender that was there for somebody else heard me talking about it and just grabbed me and pulled me into the consultation room and gave me 60 seconds to explain the situation and I did and she just shook her head. She was good enough to go over my paperwork real fast and learned my case in about 5 minutes and went up to represent me. I felt like I had been completely screwed I did everything I was supposed to where was everyone else??

In Califas, attorneys must provide atleast 50 hr of free legal advise or counsel(pro-bono)toward their certification/license. 90% percent of the time, the state appointed criminal defender will want you to plea gulity, depending on the severity of the situation, a plea deal will be considered!!!

A public defender once said in a youtube video, over 90% of his clients that are in prison wouldn't be, if they SHUT up and didn't talk to the cops. These guys are just morons and try to talk their way out of jail for the night, and talk their way in to prison. Yo Yo.

This is true, as a kid and a first time offender, you think you’re smarter than the cops, you think you could just talk your way out of it, instead you’re just talking right into their trap. I was that kid, almost got life because of that shit. Good thing my parents had a little bit of money and could actually hire me a real criminal lawyer and get me out of that mess.

@@onelifetolive4847 Even then just admitting you were there, knew a person, saying "I didn't shoot anyone" when accused of a murder, assuming that's how it happened and it happens to be. Jury eats it up, makes it easier for the cops. Thinking you are gonna convince a detective you are innocent, even if you are, is like thinking you are gonna choke out Royce Gracie experience disadvantage wise. TRUE advantage of being rich, having a family lawyer, is already knowing not to try. Parents got a billion in bank, full law team and extreme example, you confessed, game over too.

Having been through the judicial system at a young age and growing up in public housing the chances of getting a fair shake is impossible. Public defenders are flunky wanna be prosecutors. That’s ultimately what they strive for, to serve as public defenders until they can eventually become prosecutors. In a stupid way I was I guess lucky to be facing 25 to life on my first charges as an 18 year old adult. Because of the seriousness of my case I was given a state appointed attorney. When we met I told him that some business partners had me covered and since my case was bound over to superior court they planned to hire an attorney for me. My state appointed attorney said he needed my case to bolster his resume for a firm he wanted to join. As I looked at him face to face I asked him if he thought I was guilty of the charges and if so would that keep him from fighting to the end with me. He said hey listen I need you right now more than you need me but I promise to defend you with all the resources he had and he believed I was innocent of the charges against me but said I wasn’t without fault for letting myself get caught up like I did and not snitch on others. When arraignment in superior court started I told my business partners that I was sticking with my state appointed attorney. He basically kicked ass and I was out finally 9 months later

I mean you gotta think about the differences between a PD and a private attorney. PDs are paid by the state, don’t have a reputation to uphold, they have a steady stream of clients who don’t hire them but are just given to them. Paid lawyers are hired, they have to sell themselves, they need to build and maintain a reputation. They aren’t guaranteed clients and thus an income, but if they perform better than the rest they can make a lot. Yeah it’s not a fair system but what are the solutions? It’s not like taxpayers and the state are gonna wanna fund top tier representation for people, they’re only required to get them A lawyer. And if I was on trial for murder I’d much rather put myself deep in debt for a good lawyer and a chance at acquittal than take my chances with a PD

I’ve seen with my own eyes public defenders make deals and trade so many people for 1 win with the DA not even giving those people a chance at any Justice. Half the time it’s not a court room. It’s just a play where everybodys pretending except the guy in trouble with his life on the line.

God bless The public defenders who find it in their heart to give a fuck and actually do their jobs and fight for people’s lives. I’ve seen so many times good people entire lives thrown away because of one misjudgment or one mistake where they took a risk to feed their kids and now they will be robbed of decades of life behind it and they might as well of had no representation because the public defenders were so overwhelmed and underpaid they fully checked out before they even got the case. 😢💔 and I understand people need to “pay for there crimes” but so often in America we just throw people away who deserve a second chance but we let pedos slide over and over. I personally have been unfortunately involved (for the prosecution) in child mole*tation or s3x offender cases. Both times I went to Sentencing. And you sit through several other random sentencing of other crimes. And u hear people who grew weed (before it was legal) or had weed in the car going to prison for several years, I heard fathers going to jail for months for child support nonpayment, ect. Then they get to the case I’m here for and read his charges, now a/ the Child pedo he had already sat in county for about 5 months because when he went in for the lie detector he ended up not taking it and just fully admitting to everything. So the judge says criminal s3xual misconduct to a minor under the age of (I believe they law said) 12......(but at the time of the crime she was 7 yr old. He was 25.) then they ask me if I want to speak on behalf of the child. I said no. Then the judge who just easily passed out years upon years for marijuana and Child Support “crimes” tell this sick monster of a man how disgusting his behavior was, BUT since this was his first time being charged he’d get 5 months n he’d count time served n he’d be free by the end of the week. Also, he has to register as a offender for life, and he’d have a yr probation. 🤯🤯 wtf I immediately stood up n walked out while they were still speaking because I was so disgusted n in tears because I was gonna have to go back to the victim witness room and tell the victim who was still only 9 maybe he would be released this week. So the months court trips and the testimony N all of the fight she’d put up w/ so bravely was not considered enough to lock this man up for more than another few days. 😢 it still breaks my heart thinking about that. As of today she is 17, still suffering PTSD and depression behind the incident and even more so the joke of a punishment. The offender has violated parol so many times he has gone back to jail time and time again over the last 8 years but never is kept more than a couple months. But the guys I saw with the fucking marijuana charges that day are just now may be being released. It’s such a dirty system! And I won’t go into the second case that was more recent. But he got off too “due to Covid” 🤯🤬🤬

Please spend more time recognizing that there is a difference between what a law says, and how a law is applied. Everyone is not entitled to defense. Courtrooms on a regular basis means by which they can deny individuals the right to an attorney.
