Thanks for covering this! My heart breaks for her children. Her lawyers attempted to point the finger at her sons and she was the one who was convicted. A juror even stated that they cleared Scott during a post conviction interview. My heart breaks for her children and grandchildren…a lot of people believe her…I respect the jury. This was not the time or place for this IMO. I wish the judge had reined her in.

The prosecution waited way too long to object but I was glad she did say Scott was RULED out and he was. I feel so sorry for him-he has been maligned seemingly with no recourse. He was just waiting for the prosecution to finally object to Melody's foolishness, as they also could have done the moment Melody started "exposing" her self-serving version of Gary's demise.. The prosecution was waiting for the judge to rein her in. When finally admonshed to stop blaming Scott, Melody kept on with the nonsense, earning more responses from both the judge and DA.

@@tomvonhatten I found the judge feckless throughout trial- with regards to his manner in ruling the courtroom, my opinion. I do think it mattered. It matters to Scott-he was investigated and ruled out-if courtroom is a place of rules, procedure, and truth, then a convicted criminal should have been stopped AND severely admonished through punishment. Prosecution waited too long but judge certainly has a role, actually a responsibility to manage his courtroom

The son alibi is strong, he was with a group of friends far from his parents house, and returned when his mom called him, mentioning father was missing. At the beginning they thought he had health issues and collapsed on top of the fire. Later found a bullet. Probably he got close to the fire and at that time was struck by the bullet, collapsing on top of the fire. Mother phone call to his lover mentions the guy was on the fire. She knew it, before her son found the body.

exactly...She could have insisted in testifying but I am certain her lawyers advised her not to testify because anything she would say would be challenged in cross by the prosecution and she would have further incriminated herself. Perhaps she was told by her lawyers to be quiet; that's what they do to try to save a client. She had the right to testify and could have dismissed her legal team and hired a new team, however they probably would have also told her to be quiet.

She later had affair with Rusty, embarrassed Gary at wedding, Gary was ready to divorce her and that’s why she did this. Jury got it right.

There is always a right of appeal. But to have an appeal, you have to call out the trial court's errors and I don't think he made very many. Every case has evidence admitted that someone on the appellate court would not admit, or that was excluded and they would admit. But just because they disagree on that evidentiary point, it isn't an automatic reversal. The error has to be significant to the verdict, it has to be preserved, and there have to be a plurality of judges that agree to reverse. The statement made at sentencing has to evidentiary weight as it isn't sworn to, and more importantly, she had an opportunity to do that at the start of the case (e.g., to the police) and to testify in the case itself. She blew it. I give her a 0.1% chance of success on appeal.

This is what her lawyers did for the entire trial. Scott was an Iraqi veteran, found the recently charred remains of his Dad and sat through weeks of her lawyers pointing at him despite the fact that he was cleared by law enforcement, the phone technology clearly damned Melody who told her lover on the phone “ he’s on the burn pile” and “ that body should not have been that damaged”. She’s a master manipulator. A lot of people still believe her. I was struck how she used her last breath to her children to take a slam at her daughter Emily’s husband. Small detail but if she was truly devastated as a mother for her children she would have implored them to heal, cling to eachother and live good lives. She is maybe the most evil person I have ever seen and I’m an old person who has seen a lot. The judge allowed a traumatized family to be re-traumatized when they were expecting safety and relief at long last. Her final words were she wanted to see her own child shackled. If she hadn’t broken him by this time, she was going to deliver the final blow to destroy him. It’s bone chilling.

As soon as the police got there, when the idea was that he stroked out and fell into the burn pile, she began bad mouthing her kids and her husband. The cop uttered a sentence or two and she gave a long monologue about what a horrible person Gary was. Lots of unnecessary detail. If she didn’t do it, it’s her fault that she’s in this mess because her whole life was lying and cheating and hiding and blaming and she didn’t know how to do anything else when accused of murder.

The judge had explicitly told her not to, why did he let her go on after he had admonished her? Was he actually sympathizing with her? Her poor son; I hope her statement doesn't destroy her family. (I think the jury likely got it right.)

For me, the most interesting aspect was how Chris reacted when his mother accused Scott. He didn’t seem to buy a word of it and kept looking at his brother in a supportive way. Melody also threw shade at Chris, as well as at Emily’s husband, in a completely unnecessary way, showing that she will exploit anything and everything to make her point. Her final statement that she would do anything to bring Scott to justice, if she were set free, sounds strange, given she had 6 years already to do so….. Unless she hoped that she had a better chance to be found ‘not guilty’ by her defence team creating enough reasonable doubt, related to Scott.

It certainly didn’t help she looked pissed off the entire trial. She looked like she wanted to murder the entire courtroom. And her particular fixed facial features (especially her perennially downturned mouth) didn’t help in that regard. As an aside, I can’t believe she’s only 63 because to me, she looks at least 15 years older than that. Hard to believe she was a vixen who managed to carry on a torrid love affair (which also didn’t help her case). Apparently she must have had some sort of allure though it beats me as to what that could have been.

My understanding is that the police ruled Scott out as he had a solid alibi. I was surprised the judge let her go on but decided that it really doesn't matter. I feel bad for Scott, Chris and the daughters. If she felt so strongly, she should have testified. She could have gotten new attorneys. What a legacy...

I think she thought she would just use the opportunity to take one final jab at Scott. Surely she didn’t think the judge would set her free?? I’ve never seen anything like this woman. I’m so glad the kids are free of her but they will still spend the rest of their lives recovering from the damage she has done.

First she set up Scott to find the body of his father. She call him to return to the house because she didn't find Gary. On sentencing she try to set up Scott again, and express her wishes to see him with handcuffs. She hate him.

Her kind blames everyone and institution except herself. Melody still bends the truth at sentencing with hate and conspicuous malice. If you believe her, you just got scammed. She screwed impact statement at sentencing than sarah bonne did.

She said the night before she knew his body was in the burn pile and she also said that much damage was not meant to be done to his body. If Scott did do it she was part of it also.

She waited and waited as she believed the jury would either not make a decision and she would not be convicted. She did not or never wanted to expose her son……a primal instinct of a mother is to protect their young in 99% of cases. Then when she was convicted she knew she has a choice, She was credible in her impact statement. At the very least I hope she wins the appeal and the real truth comes out. Just feel so sorry for that jury also…..what a nightmare!!

In the macro view I can see why you wouldn’t want a convicted defendant to relitigate a guilty verdict but in the micro I can also admit that it didn’t affect one single thing. The prosecution was never going to cross examine her and the judge had already decided on a sentence.
