Harvey’s comment makes no sense. There’s no way to check all units in a townhome. Does he think people will let a potential tent at in and do an inspection? The only logical option is to attempt to the HOA.

In my opinion, she did two things wrong, first she bought a property without having it properly inspected. I mean to fork out a couple hundred bucks to get somebody that specializes in property inspections would be completely worth it before purchasing a house, condo or what have you. And second she's buying a unit controlled by an HOA, no thank you!

@@thecheshirecat299 OBVIOUSLY Legalities matter. What I'm saying is people come on People's Court quite often scatterbrained and with little to no documentation to present their case. In some of those cases, they win despite their lack of preparation. This plaintiff is one of the few who did her complete due diligence including the communications between the defendant and the HOA but it didn't work out for her.

Always have an inspection done because people can be shady. This is one of the reason why I have never and will never buy a house that is attached to someone else's house. I'd also never buy a house with an HOA again. It was a nightmare, HOA, and condo associations are terrible.

Realtor here 👋 its VERY hard to prove these cases. You have to prove that the owner intentionally and purposely withheld information that now changes the value of the address. Now, if this were my seller I would tell him to disclose because we owe priority to our clients but we owe FAIRNESS to everyone.

She should have had a termite inspection, along with a standard home inspection. I have done termite inspections for each home I have purchased, except for two that I bought as-is. Termites turned up in one of them and the seller paid to remediate. Edited to add: The plaintiff was VERY well-prepared for her case. Kudos to her.

The show likely encourages the litigants to sue for random things in addition to the initial lawsuit. It adds more dramatic tension to the episodes. In other words, the defendant was encouraged by producers to countersue just so the judge could yell at him about it.

Our condo board had discussion about a special assessment regarding our roof right when we were about to sell. While we had zero obligation to mention it, we did out of a sense of honesty. We set up a special account with money in case it was needed for the new owner with a timelimit. If the condo decided not to go through with it, we would get the money back. Its is much better live life honestly instead of trying screw people over.

I was buying a condo that was coming up on a 100K assessment for each unit. The seller told me. Hey in October the board is voting and we’re pretty sure this thing will pass because they need to bring the siding to code. I thanked her and didn’t purchase. It’s terrible that someone wouldn’t do that. The house has since sold and the person is aware of what they are buying.

I feel bad for her. And the seller is a bad guy. Termites are literally the most destructive thing that can invade your home.. Worse than mice, rats, insects, etc And to all of you saying she should have got inspection before buying. Most banks dont require it and even if it was inspected many many inspectors will miss something like termites unless the termite damage is very advanced

As a property manager of a condo, this happens often. Luckily, I haven’t seen something like termites as a problem but there have been other issues that were lingering and they’re put their unit on the market and a seller will pick it up without even reviewing docs. It’s pretty bad. The defendant is morally wrong but the plaintiff should have done her due diligence before closing. Termites are serious and are a major topic when selling. She has to see if the HOA can be held responsible but I doubt it. Condos are a jungle in itself.

What more do diligence was she supposed to have done? There's a specific form in all home purchases I believe in which the owner has to certify whether there's a termite problem or not. Can a potential buyer go to the condo or building management and ask them if they know of any current issue that could result in a special assessment in the next year?

Special assessments go on for years especially buildings that are getting upwards of 20 years old . The windows need changing the siding needs replacing the roof needs to be replaced decks for some reason are always installed wrong (every condo I have ever lived in) I was paying $600 a month for years and there was no end in sight . In my opinion I will never own a condo ever again . It ends up cheaper to own a house

The verdict in this case surprises me because on the sellers disclosure it was asking whether there were termites on the property. Since that particular unit is connected then when it’s asking if any termites are on the property that should pertain to the knowledge of termites in any of the connected units. Therefore, this would make the seller liable for the damages. I disagree with the judge in this case.

The guy is smarmy. He saved his sorry ass from a special assessment and a massive amount of inconvenience. He knowingly passed this nightmare on to the buyer. What he did should be illegal. That termite form needs to be updated ASAP to include all units that share a roof, foundation, or crawl space. The whole purpose of having the form is to avoid this exact situation. I'm glad the judge told him to shut the hell up.

Why do people keep bringing up inspections? Inspections on a condo are only going to uncover potential issues within an individual unit. They can’t uncover issues that can’t be seen from within the property or common spaces (i.e. - an inspector can’t cut into a wall to see damage behind the wall). Both the plaintiff and the defendant clearly note that there’s no termite damage within this condo unit; the issue is in other condo units in the same building. The plaintiff very likely had an inspection that didn’t uncover this issue.

If I’m ever a defendant on court TV and I win, I’m going to immediately ask where the camera is, then look directly into it and say to all the youth “You can do anything in life if you want to. Always believe and you’ll be what you want to be.” Then I’ll walk my ass off.

Get a pre-purchase inspection done. And make sure the inspector is certified! I had a pre-purchase inspection done only to find out after I purchased and moved in, I had electrical issues to the tune of thousands, a wood stove that should never have passed inspection or WETT certification, plumbing issues as in broken pipes to apartment over garage. I lost the opportunity to negotiate purchase price. Needless to say a lawsuit is only recourse.

I'm in Australia and Pest and Building inspections done by the purchaser are usually standard. If anything if you are getting a mortgage banks insist on it. I just bought a house and its only 4 years old and still under a builders warranty but still paid for the Pest and Building just to make sure. No issues but if I didn't Murphy's law would I'm sure happened and there would have been something. Best to be sure.

I don't agree with this ruling. Is a defect within the condo, that will have financial implications, and he had a duty to disclose. She may not want to buy a building with known termite issues.

If she had a realtor, s/he would have insisted on a professional termite inspection. Like the Orkin Co representative testified, the rest of the building would have been taken into consideration. Issues like this are extremely common; same for fireplaces / chimneys that don't get inspected. The seller must have a miserable life to be so greedy.

Houses are Ike cars ; once you pay for them, your stuck with it ... asis. Any issues before buying , not after. Some states have disclosure forms the seller has to give the buyer; however the buyer should do the due diligence , and have the property inspected before. The seller may not know about something , or may claim so, or even disappear after. Also good advice most people give, is to make sure you have a lawyer for the closing. Fumigating is not the long term solution for termites ; new ones will come back. You have to have a underground barrier around the house.

It’s literally,LITERALLY $1k MAX to get an inspection. It can save you thousands In the end. You can get a price decrease because you have to fixABC. Idk what’s wrong with people. Spend that money. It’s not even a lot .
