NSW State Nomination - Subclass 190 and 491

You require NSW State Nomination in order to apply for the State Nominated (Subclass 190) or Regional Nominated Visa (Subclass 491) in NSW.

State/Skilled Nominated (Subclass 190):
The State Nominated is a permanent visa to Australia. You can live anywhere in NSW (including Sydney).
What occupations are eligible for this?
• In NSW to be invited for the 190, you must pass a skill assessment in a target sector.
What are the requirements:
In order to be eligible for consideration:
• have submitted an EOI in SkillSelect
• be under 45 years of age
• have at least Competent English
• have a valid Skills Assessment in a NSW target sector
• have achieved at least 65 points
• be either:
o currently employed in NSW where your employment meets the standard for claiming skilled employment in your nominated occupation, or
o have genuinely resided in NSW for a minimum period of three months

Skilled Regional (Subclass 491):
The Skilled Regional Visa (Subclass 491) is a 5 year open work visa that converts into PR after as little as 3 years. You can only live in a regional area (not in Sydney) on this visa.
What occupations are eligible for this?
Unlike the 190, there are a few different streams of eligibility for the 491 visa:
Stream 1 - I am living and working in Regional NSW
• hold a valid skills assessment for an occupation that appears on the Stream 1 Combined Occupation List.
• have been living in a designated regional area of NSW for at least the previous twelve months; and
• have been working in your nominated occupation, or a closely related occupation, in a designated regional area of NSW, for at least the previous twelve months

Stream 2 - I have recently completed study in Regional NSW
• hold a valid skills assessment for an occupation that appears on your nominated region's occupation list
• have completed study or education with an education provider, where:
o the study was completed within the previous 24 months
o the education provider is in a designated regional area in NSW
o the study meets the Australian study requirement (as determined by Home Affairs); and
o the qualification obtained from this study was assessed as closely related to your nominated occupation by the relevant assessing authority; and
• have lived in a designated regional area of NSW while completing your study
Stream 3 - I am skilled in an occupation required in Regional NSW
• hold a valid skills assessment for an occupation that appears on your nominated region's occupation list
• Be currently residing in an Australian state or territory (So you can technically apply from anywhere in Australia)
What are the requirements:
In order to be eligible for consideration:
• have submitted an EOI in SkillSelect
• be under 45 years of age
• have at least Competent English
• have a valid Skills Assessment in a relevant occupation
• have achieved at least 65 points
• Meet the stream requirements

Nomination process
NSW nomination for the Skilled Work Regional visa (subclass 491) is now by invitation only. Below are the steps to apply for NSW nomination:
1. Complete an EOI in SkillSelect
2. Register your interest during a submission window
3. Be invited to apply
4. Apply to an RDA office where your skills are required within 14 days

Hello i watched your video you say for 190 either we have a job or currently living there for 3 months will consider. I got job as a social worker and moved to NSW last month on 17th of January. I applied EOI on 21/02/2022 and I got 190 invitation as a social worker on 95 points last week. I am applying my nomination, I have there is one column for residency where I have applied my lease agreement I stated lease last month. Now question is that where I can lodged my job offer and job related documents. As I didn’t claim any points for my employment as it’s just stated last month. But there is a column saying that Australian experience points in that there is no option for less than one years. So I am so much stressed what I will do now. Please help me out.

You can certainly try for the 491, but you will have a much better chance of getting the invite if you work in NSW

I came to Sydney (NSW) on 19 Jan 2020 and left Sydney on 19 March 2020 (I was meant to stay for 3 months, though i stayed only for 2 months as I had to leave early India due to COVID. I came through Subclass 400 visa). Let me know which is the more easier visa for me to apply under NSW state sponsored one..

I have one question my situation is i am in Australia and my wife is overseas, so can i include her in the EOI points and 190 visa application if invited ? i want to claim her 5 points of english. but since she is overseas and i am in Australia, will it be a problem in claiming. If i get invited and we need to apply visa togather does both of us needa to be in Australia ? or if i am in Australia and she is overseas will it be fine ?

Generally speaking it is a lot easier to get invited if you are already living and working in NSW.

No states are inviting offshore applicants atm. This will need to change for you to have a shot

Hi, I have done a 4-year bachelor degree in mechanical engineering in South Australia. With some credit I received from my bachelor degree, I will only need to study for 1.5 years or less for a master degree at Wollongong, NSW. Will I be eligible to apply 491 under Stream 2 after my master degree?

You would most likely need to get on a temporary graduate work visa when you finish the course so you can have enough time after you finish your course to be invited.

Hi Lucas, unfortunately in Sydney you have limited options for PR. Often it is easiest for your NZ partner to apply for PR 189 and include you on the visa.
