In some states when you’re out in the county backup may be 20-30 mins away. Even farther once you got to real rural areas . Civilans FTW again helping out LEO’s.

Came to the comments to say this. Counties in New Mexico are absolutely massive. I don't think Daz and Gaynor know this. And the staties couldn't rely on local PDs because there are no towns in the rural parts of the state. I guess the rattlesnakes or coyotes could have helped her out?

Yes, but he was reckless in his actions. At the moment when they had the confirmed background of the person, they had to proceed to arrest him and wait for his partner to arrive. He gave her several opportunities to react and even let her return to the car. What would have happened if at that moment he made a move and took a gun.

“Homicide” can be; 1. - *Justified self-defense or defense of another who’s life was in immediate danger of serious bodily injury or death.* 2. - *Manslaughter:* _”the crime of killing a human being without malice aforethought, or otherwise in circumstances not amounting to murder.” (A car running down a pedestrian whilst the driver is not intoxicated, but incapacitated by medical reason or a store clerk shooting back at an armed robber after being shot at by the armed robber, only to accidentally kill an innocent bystander, as a couple examples.)_ 3. - *3rd Degree Murder:* _“3rd-degree murder and manslaughter are very similar, but the states in which a third-degree murder charge can apply differentiate between them in different ways.” (Being intoxicated and causing death behind the wheel versus not being intoxicated and causing death behind the wheel, for example. This charge is rarely applied and usually is manslaughter or 2nd Degree Murder.)_ 4. - *2nd Degree Murder:* _”applied to all murders that do not qualify under the category of first-degree murder.” (The charge does not include Manslaughter or 3rd Degree Murder. The wording of this law varies from state to state, so is applied differently. This law and it’s punishments are applied quite frequently, as 1st Degree Murder is harder to prove in most killings in the United States of America, which are gang and drug related.)_ 5. - *1st Degree Murder:* _“unlawful killing of a human being, or a fetus, with malice aforethought“ (Plain and simple; it has been proven you planned and intended to commit an act of unlawful homicide)._ 14:25 Actually Daz, a phone call does not need to be placed to track a cellphone. Your cellphone regularly pings nearby cellular towers to maintain its connection to receive calls/texts/email/internet. The police just need to speed dial their contacts at whichever service provider your cellphone is on and get a location on your last ping. Those pings occur within seconds, not minutes. You’d be surprised, but what does in most criminals nowadays is cellular phone location logs, and CCTV (I’m sure you’re not surprised by the CCTV part, being in the UK.) Some phones even ping cellular towers without a battery installed for a limited time using power from tiny capacitors on the circuit board, a way of attempting to track stolen phones for a short time after they’ve been stolen. You have a tracking device in your pocket at all times my friend, with some law enforcement and intelligence agencies able to look through your cellphone camera and listen through it’s microphone without you ever knowing. If you want close to 100% protection against anyone accessing your cellphone’s location, I suggest removing the battery, SIM card, and placing all pieces inside a Faraday Bag (blocks most cellphone signals).

Reasonable suspicion, probable cause, and arrest warrants are three very distinct legal thresholds for detaining someone. And yes, in large states, backup can be tens of minutes away. If there was already an arrest warrant for her, she would have been arrested immediately. I don't think out-of-state probable cause or reasonable suspicion is enough for that state's law enforcement to detain you. Even in the US, there are jurisdictional issues between state law enforcement agencies. However, an arrest warrant gets you arrested anywhere in the US.

Homicide is just taking a life, not murder, it's an umbrella term. When a cop shoots someone who is an active threat to lives, that's Justifiable Homicide, not a crime but still called homicide. It's very easy to have backup coming a long way. You guys live in a city and lived in urban areas when you were here. Often in rural areas there is one covering half a county or more. My county in NY we have at minimum 2 deputies and 2 troopers covering the entire county, then at night the two troopers are in one car instead of two. So 3-4 units for a 600sq mi county. We have 4 village PDs but they are only in the villages and can only leave for extreme circumstances. Backup being 20-60 minutes away is quite common all over the nation.

Because of our laws, she couldn't legally detain her without disclosing to her that she was suspected of a crime. She didn't want to do that alone and potentially escalate the situation, but she was forced to respond for her own safety. Thank goodness that man stopped to help. I'm sure he had no idea he was helping restrain someone who had committed murder.

Is that a new mexico law? As far as i know you don't have to disclose anything before you detain a suspect in cuffs. As long as there's justification for the detainment you just cuff them and tell them why after
@theboyfactory6
@theboyfactory6 9 ай бұрын
@Daniel-wv7lj Our 4th amendment right in the US protects us from unreasonable search and seizure. To be lawfully detained, meaning you are not free to leave, the officer has to have reasonable suspicion that you have committed a crime. To be reasonable, it has to come from a credible source and be able to be articulated by the officer what crime you are suspected to have committed. There are situations where it can get tricky, but many people do not understand their rights or the law including law enforcement. How situations are often handled or often civil rights violations. In the end, if an officer does not provide you with the crime they suspect you of committing that justifies the detainment, you are legally free to leave. It can't be something like, "We received a call that says you are acting suspicious." Being suspicious isn't a crime.
@Daniel-wv7lj
@Daniel-wv7lj 9 ай бұрын
@hul5078 idk I'm pretty sure the police do not have to state what crime they suspect you of committing in this case. This wasn't a traffic stop, and after the fact, they got word that the person is suspected in an out of state crime. At that point the justification is there to detain. They had the car description and everything, it doesn't make sense that the cops would need to verbally tell the person why they are being detained before hand. They don't even need to tell a person why they are being arrested so why would it be necessary for a simple detainment
@Daniel-wv7lj

An officer should be able to fulfill an officer's duty. At no point should we say things like, "Well that's a female officer," or "Why is she alone?" That would infer that women should be treated differently than men, and no one should be engaging in such toxic behavior in 2024.

The "good Samaritan" was stupid. You should NEVER stop to help an officer, no matter how much distress or danger they could be in. If things go south, a cop would not hesitate to throw you under the bus and charge you with obstruction. That's why If I stop it's only to film the interaction, and if they ask for help I tell them to kick rocks. It's not our job to do their job for them.
