You failed to explain that in the Mimms decision, the judge ruled that there must be RAS that the driver is a safety risk to remove him from his car. It is the same legal standard that applies for a cop to demand ID. You really dropped the ball on this one.

If an officer claims to smell marijuana and none is found they should be held accountable, this should be recorded so that we know exactly how many times they have claimed to smell marijuana and none has been found.

That's very difficult to prove that he didn't smell it. Marijuana is very potent these days, so who's to say he didn't smell it from another vehicle, or from a nearby residence. I agree that they falsely claim smelling marijuana is mostly bullshit, especially now that it is legal in most places, so chances are they will find some, it is still difficult to prove that he didn't smell it, even if the source wasn't the vehicle.

I'm just saying track it, simply just have a log of these things so they can be referenced in court. Right now an officer can claim he smells marijuana on every single stop with no repercussions, meaning he can search whichever car he wants legally, isn't that ridiculous he can search any car he wants legally by illegally claiming he smells marijuana.

Police are trained to handle every traffic stop as if it’s a deadly threat. Police officers are mostly likely to die at domestic violence and traffic stops. Civilians just don’t understand the danger traffic stops pose to cops. That’s why you should always comply and complain later.

Is it so dangerous that police should treat every encounter with a civilian as if it is a threat to turn into life and death at any instant? No! At bare minimum, officers should be held to the same standards as a normal civilian who is untrained in these encounters.

Did you just give those cops a B+? Man I almost always agree with your grades but we were far apart on that one. They escalating things from the jump without even trying to treat Mr. Bass with any respect or professionalism. That alone aside from the fact that they made at the very least two unlawful orders when demanding he roll his window down and that he stop filming the deputy that was giving him a ticket. Anything higher than a C- for those guys I can't agree.

I agree with you about the grade. I actually only agree with his grades maybe 50 or 60% of the time. I don't grade based on what the average police officer acts like, I based on what they are REQUIRED to act like. Only a few unfortunately behave that way.

Except that sense of smell is completely faulty. In other words, he didn't smell marijuana, and none was found. They claimed they smelled pot in retaliation for Mr. Bass not licking their boots. In 46 years of driving, I've never been pulled from my car or had my car searched after getting pulled over for a minor traffic violation, because I'm white. Racism is a live and well.

I get that he wants to be objective, but pretending like they couldn't see at all inside his car and would act identically if it was a white man is nothing but ignorance. I mean that cop, wasn't just informed on marijuana laws, but all of the constantly changing recent ones and was an expert in reciting them. When I passed through I would take my pistol out of my holster, lock it in a metal lock box, unload all my magazines and put my ammunition in a separate lock box, put them in my trunk and locked it. Still, I could be arrested and charged in Maryland. Passing through. No stopping. A loaded pistol magazine or revolver speed-loader in Maryland has the same Five Year prison term, minimum, as having a loaded pistol and or revolver. I used to carry concealed in several states that recognized the spirit of the Second Amendment. Not in Maryland, DC and other jurisdictions. I used to have a special permit in Virginia to carry loaded rifles and shotguns in the front of my vehicles. Gun laws and restrictions in America are a crazy quilt of local, state and Federal Laws. Local drug dealers in my community, all small time, drive to Baltimore, Maryland to buy illegal drugs off the street and resell them here. They no fear of being caught. But, have a pistol magazine with one bullet in it and that is an automatic five years in a Maryland prison. I gun of any kind on you or in your car: you neglected to remove a magazine from your glove or trunk. Five years! You can legally open carry where I am. You need a permit for concealment. The smell of gun oil could easily be probable cause, even if the cops saw a sewing machine in the back seat. I used to lobby in my state capitol over gun rights. I'm starting to get involved again. I'm taking a hiatus while wife is going through her final stage of Alzheimer's. I look back at what my family did do the average American can have the rights they now have. The European side for 417 years, native side for a few thousand years. America is not just a country. It's my home. And a representative republic, not a democracy. Though it is treated more as a mob rule democracy. And less Federal and more national as socialist thought creeps in. Sic Semper Tyrannis!

Well, in Norway, all orders given by law enforcement officers are de facto lawful and need to be followed. You'd think this is crazy, but over here we at least have very sensible police officers. They don't abuse their positions, and they genuinely help the communities they are in. But in theory, I could be ordered to walk on the other side of the road for seemingly no reason. If I don't, they can apprehend me for up to 48 hrs, and any court would rule in the police department's favour.

The state government imposed a limit of how much of a city's budget can come from police fine or confiscation, to prevent cities from becoming speed traps and funding themselves off of tickets. The state also controls a lot of traffic enforcement laws, like police can't ticket you unless you're going more than 10 mph over the speed limit (with a few exceptions like school zones), and police running radar can't do it at the bottom of hills, or on steep roads, and have to be visible. If any city violates any of these, the state will take that police departments license to run radar away.

That's how laws work. You can't legislate for every possible scenario. Officers work in a framework. Courts decide if that framework is reasonable and then codify the rules as social conditions evolve. You don't have to imagine it, you already live in it.

One of the MAIN reasons you ALWAYS roll up and lock your vehicle when having to exit, this ensures K9 and then follow the states rules on search. ALWAYS secure your vehicle, you have every right to do so. They CANNOT request it left open for search.

You should do whatever they want you to, within reason of course. Now if you are approached on foot , let’s say, and they say we got a call saying you were behaving suspiciously, then at this point you have not done anything that the officer can cite you for or arrest you and you are not under his orders. If he tells you to put out your cigarette or to stop recording, you should ask him if you are being detained and why? If he says no, then he doesn’t have the right to give you orders. Got it?

Watching a lot of these videos and coming in with a bias mindset makes you guys go too far in the other direction. If audit is trying to be objective then he can’t make a call either way. He wasn’t there so he can’t judge one way or another for the smell of marijuana. So he did the logical thing and ignore the smell part. Look, if he did grade the cops lower and used “smell of marijuana that may not have existed” as justification of a lower grade, he’d be bashed for not maintaining objectivity and lose reputation for being a fair channel... which defeats the entire purpose of this channel. If you guys want to hivemind go for it, but don’t fault the channel for disregarding something they can’t attest to objectively.

You weren't there, it's not like the driver later said anything about there's no smell, or complained about the search being illegitimate and that there was no smell as far as we can tell. If you think the accusation was BS that's entirely your opinion and I don't plan on swaying you. However, I WILL contest you on the point that it's an objective conclusion based on the video. As I said, ATA is being objective, and even with your logic it's still a subjective matter and involves speculation. There's nothing that says there ISN'T a smell coming from the vehicle, most notably it lacks a statement from the driver himself. Maybe the driver thought the police won't listen given what has happened so far, sure, but you would think the driver would mention it later that there was no smell or anything suspicious. From what I can tell, the subsequent contest was only about the citation itself (which wasn't directly related to the search). Either way, at least without some help from the driver himself, ATA would not be able to OBJECTIVELY state that the marijuana smell accusation was fake. That induces bias one way or another. If the driver said somehwere that "there was no way a cop could have smelled marijuana in my car", either during the interaction of subsequently, ATA could say "questionable search of the car" and lower the grade there. However, given what we see, I think ATA made the correct judgement here.

1. cop will look into a window with a flashlight, or otherwise even with tint with their takedown lights 2. as soon as you open a window they will smell drugs 3. this guys windows dont look all that dark, cops can easily see in the car. this citizen is a bit extreme and he is asking for descalation and he cant even do that himself. you got pulled over. protect your 4th amendment rights, keep your mouth shut, and let it happen. if they are gonna violate your rights they will do it, but escalating yourself isnt going to help anything either. you fight in the courtroom not the street. while hes ok to be pissed legally, that doesnt mean you will get respect. he wanted the cop to read the ticket, the cop wanted this guy gone...take the ticket and complain later if he was wrong instead he was trying to instigate the cop which isnt a favorable look. im torn on this one, the driver was instantly combative with his intentions. the cops were over demanding about window being partially rolled down and could have just said ok fine whatever. its a mercedes, half the time the windows dont work anyways and he prob could have just said hey, windows dont work that well. they crossed the line when they wanted to search his car, which im guessing its about payback for the window request. but its also incredibly STUUUPIIDDDD to have your car smell like the devils lettuce because you just gave PC to LE. They don't have a "clear" view into the vehicle until they're on top of the driver's seat, and by then so much couldn't already happened. Which, let's be fair here, unless you got limo tint, this excuse is complete bull. You can clearly see in and out of a vehicle even with a fairly dark tint. @@furamusic301 - Another point is that many officers aren't tall enough to see into the lap, seat, or center console with a lot of higher riding vehicles, even with all of the windows down all of the way. That doesn't mean that they shouldn't try to put themselves in a position to see more in situations where that's possible. But it also isn't that serious, when they're just detaining someone for a minor traffic infraction. They don't make drivers and passengers exit big trucks and SUV's at gunpoint, just because they can't see as much inside the vehicle.

@@furamusic301 It was legitimate. The window tint is quite dark even from the inside out (see 9:31), and the other direction is of course much darker. They need to be able to see the driver's hands' movements as soon as possible. Ordering him to put his hands on the steering wheel would not have helped much with the windows still up, since he would have to produce documents and such. And staying behind the car gave the cops a certain amount of additional protection, especially since shooting at them would require significant movements from the driver that they might be able to spot.

@@Dowlphin You can see silhouettes move. The windows are dark, but not that dark. They're not limo tinted and completely blacked out. They can clearly see him and his deliberate movements, even if they can't see every detail like the numbers of hair on his head. Like I already stated, the rear windshield is already the same tint as the rest of their car. If officers were really worried about their safety and being able to see what's going on, they'd approach the vehicle from the front. The front windows and windshield are not allowed to be tinted, from what I know, and if they can be it's significantly lighter than the rest of the car. Plus they can see his face and any other passengers inside the vehicle with ease. Furthermore, it would prevent the amount of take offs after being pulled over. If they came up, asked for your papers, and you decided to drive off while they input your info, they can immediately put the vehicle in drive or neutral and move to block you from moving forward. If they're worried about weapons, park cock-eyed so you can use the vehicle and doors as cover. Slowly approaching from the back does less for them since they cannot see over the seats until they're right up on him. Again, this has nothing to do with them and their safety. This wasn't a felony stop. It was a simple citation and misdemeanor because, as the story goes, he fishtailed a bit coming out of a turn at a stop. There was no reason to make this more than it had to be and search his vehicle. There was no reason for them to feel threatened. He made no attempt or movements to dictate he was hostile or a threat. If they were smart and logical, they could've went about this a hundred different other ways if they truly feared for their life. But they didn't. Instead they chose to become hostile right off the bat and continued to keep that hostility throughout the entire detention.

When the officer said he smelled marijuana but found none, I would claim that the smell came from the officer and inform his supervisor that he may need to be drug tested. That smell came from somewhere.

I live in Lexington Park, MD. As a 38 yr old Female that has lived in this area for the past 18 yrs and have have 5% limo tint on EVERY car I have ever owned, and have never not once ever been pulled over for it, I have been pulled over 10+ times for other traffic violations, but my tint has NEVER been brought up. But over the past few months in this area, there is AT LEAST 5+ traffic stops of young black men for their tint. Its BS and racist! Checkout the channel @Aye yung city, he does a great job showing St. Mary's County's "Task force" at work, wasting tax payer dollars!!!

years and year ago mom was headed to atlanta..on i 75...in the middle of 8 million cars this cop pulls her over..she in the middle lane..she had NO clue why he pick her out of the other zilliosn cars on the road...she dropped her window one inch only..it was dead winter..cold as heck out there...one inch down and he said roll down your window..she said NO...I will not take down this window down ,its cold..he was angry as hell.....went on and on about her dropping the window....she never did...I do not recall if she got a ticket that day..this was a long time ago..but she never dropped the window.

@@machedari it's not a probable lie. If you went to court he could argue that the smell could have been in the area. Remember that a court room standard is usually beyond a reasonable doubt, and that burden of proof has not yet been established

How tf are you gonna grade the cop a “B+” for performing such a hostile traffic stop, which included barking out orders for the driver to roll his window all the way down while he had his hand on his service weapon, ordering the driver to step out of his car so he could conduct an unlawful Terry frisk on him and an illegal search of the vehicle, and then finally give the dude citations for the initial reason for the stop after not finding anything else to pin on him? He was super hostile from the get-go and shouldn’t have gotten a grade higher than a “D”!

They're used to the decades of violating our rights and can't move past it. Once it's legal federally they'll lose their jobs as their role will be defunct at their department. Maybe the officers left can start solving violent crimes instead of harrassing random drivers.
