Isn't the military secrets. It's finding out weak points. Like a team casing a bank or a boxer watching videos of his opponent. Looking for weaknesses. Boxers doing it is fine, they're trying to find weakness in their opponent to win money. A guy filming gate guards finding weakness has the potential to cause way more harm. Maybe family guy is just filming, let's say how many marines drive mustangs. It's almost all BTW. Maybe he's tracking guard schedules. Growing up and still living/working on and around a base, I'm okay with this.

Agreed that dude just got there he had little to no clue why he was detained to begin with and simply saying I was detained doesn’t infer that he knows why the fuck u were detained kinda gotta be more specific on what the fuck you did to get detained in the first place (like pointlessly videoing the front of a base for seemingly no reason other than to get attention like a 4th grader throwing a temper tantrum) some of the audits are cool but some are plain stupid and are simply in an attempt to get a settlement sure you have rights but wave something around enough and chances are they will take it away eventually it’s one thing to feel the need to state your rights it’s another thing to force the topic to come up (fuck with the system enough and the system will eventually adapt to either a side you like or to counter exactly what your doing) just food for thought

@@Whimpykids2 Hot take, but I don't really think it matters. Officers aren't teachers, they can't arbitrarily hold you "after class" because you annoyed them a little bit. I get what you're saying, but at the same time, that doesn't warrant a crime. Just because an audit may or may not be legitimate in nature doesn't mean they're breaking the law, which I feel might be a subject already being discussed within the auditing community as well as law enforcement.

I spent 9 years in the Navy and did 3 on security. If it were actually illegal to record a base or even the gate, he would not have been hassled all afternoon. He would have been snatched up immediately.

Marine here, I see why the baggage on the Navy happens so much, different breed I guess. I had to spend 8 months as acting military police through the forward assistance program at Camp Lejeune and I can tell you that no, no one is getting snatched up. You could be detained and questioned as to why you are taking pictures but there is no CIA snatch and grab policy for photographers outside of a basic restricted base. I will say most military installations do own a decent portion of property outside the gate though which allows for investigations to occur there from military and makes it federal property not public. Also, yes it very much can be illegal, most bases are at least restricted, I direct you to 18, U.S.C. § 795 again like the video shows. This designation usually happens for normal bases during time of war, like when I served but can change, which happened towards the end of my service.

I used to go to airshows at all kinds of Navy, Air force, Air National Guard and Army bases all over the place and filmed and took pictures of all kinds of things Many other people did also . No one cared or bothered me and anyone else there filming and taking pictures. I dont understand what in the world is so horrible about filming an entrance to a military base ? Why is a video camera so terrifying ? I dont get it ?

If our law enforcement officers stay knowledgeable of the particular laws and regulations they're charged to enforce and operate within the scope of their authority these auditors would have nothing to publish and no grounds to sue. Just as some police officers say "innocent people don't run", innocent officers have nothing to fear from a recording device. Always do what's legal, always do what's right.

Yeah tbh you would've been fucked back then knowing your rights or not. All a cop had to do was lie a say it didn't happen like you said then it's your word vs his. Hell even today, where we have videos of what happened, cops STILL lie about how things happen in their reports and sometimes get away with it. So you didn't stand a chance, knowing your rights even back then still helps tho I think most cops would be less likely to violate someone that knows they're rights and might file complaints or lawsuits against them.

There is truly a bizarre contradiction in the US law here. Police have to have a articulable reason to detain someone, but they don't have to say what it is, so how is someone supposed to know if their detention is legal or not? The logical answer would be to say "Why am I being detained" and if it can't be answered then "this is obviously an illegal detention, please let me go" , but as they don't have to answer... then it can only be debated after the fact, by which point I am sure the police can make something up retrospectively.

@@a.jperez202 But that means the cops can make up a reason retroactively, which violate the spirit of the whole thing. I acknowledge there are times when it may not be possible to articulate the reason for a detention at the time (the person being detained is hostile) - however if a police has to be able to give an articulable reason to detain someone and they are asked specifically what that is, then the question is what reason is there for them not to answer? If they are not willing to answer then the question has to be "why won't you answer" and the obvious answer is that they don't have an articulable reason at this time, therefore under most circumstances logically the detainment is invalid if a police refuses to respond... except for some bizarre reason police are not required to answer a reasonable question.

Military member here: regs only apply to US military personnel. The rest of it is irrelevant. Public viewing is public viewing. SSgt whatever his name is isn't military personnel. That's a contractor. Probably prior service, but outside the gate MPs have limited authority especially in respect to civilians.

Also have perfected explaining exactly if either side was right or wrong in a way everyone could understand, even if they no nothing about your rights or laws. Every Citizen and police officer need to watch these videos so they both can either protect themselves, or if they're a cop, respect and honor people rights and the law.

Audit the audit is most definitely biased in favor of the law and of law enforcement. It is ignorant for people to assume that if a law exists, then it must not violate our Constitution. This couldn't be further from the truth! Although it may appear as though audit, the audit is intelligent enough to interpret the law, it couldn't be more obvious that they are ignorant of the Constitution. A constitution which is relatively easy to interpret. Unfortunately, a vast majority of Americans don't value their constitutional rights enough to read the Constitution.

libra8a: Not only has the SCOTUS ruled that at inland check points that they can detain you pending satisfaction that you're a citizen, but they can jail you and they have installed two room mini jails at inland check points. As a note, it is not a crime for a U.S. citizen to cross into the country at any point along the border however by doing so you might be stopped and asked to prove a right to be in the country. 15:38 I would say, especially considering the material usually shown on this channel, listening to Detective Mitchell's style of communication was a delight. Very polite, civilized and inquisitive and even hardly challenging in an offensive way, and yet maintaining a core of authority he would not compromise. Understandably the auditor's recommendation for internal revision of the department were a bit provocative to that core, but we can easily tolerate that, since he also has a representative role and has to weigh factors. He might have taken his time alone later to study the incident properly. Without having done that we cannot expect him to figuratively bow down before the auditor, who, from a psychological perspective, also did not have an aura of particularly high respectability, although that is no distinct fault of his but just the way he verbally expresses himself.

Long story short cops need to get over how people talk and just learn the law. Doesnt matter if he expressss himself the way he does, the law is the law and even the "nice" cop failed to know some of it and was actually quite condensending in his attempt to convince the auditor that no crime of ilegall detainment had been committed when it had. He would not have instantly released him if they had articulateable suspicion and they never got his name so they didn't push the issue because they realized they were wrong. The officer knew they committed ilegall detainment, but still tried to convince the auditor they had not to dissuade him from filling a lawsuit. It's a fake kind of niceness, some of them have to have it.

I didn't watch the whole video so I know I missed alot but civilians have to careful because as highlighted with article 795 there are plenty of things that seem silly that is classified. There many fuzzy statutes especially dealing with homeland security that makes filming military installations illegal in some sense.

Note that the edge of the base is not the fence and/or gate. Base property often extends past that line substantially. It's quite likely that sidewalk was part of the base property.

My husband and I were parked in a parking lot about a 1/4 mile from a base entrance. We were lost and were trying to figure out where we were. At no time did we enter a base. Out of nowhere, when we began to drive, we were surrounded by police and military police and were told we were on base. They all freaked out, threatened to arrest us, charge us with crimes on base. It was nuts. Once I realized what was going on and calmed down, I realized I had done nothing wrong or illegal and broken no laws. I told them this and they let us go. It was nuts.

One thing overlooked is alot of time the bases own that land around the base fence too. There are usually signs that say no photographs or videos and all personal are subject to search. So if that sign is there and he walked past it he just agreed to it and has no leg to stand on. While I was at Fort Bragg this was the case and we had a couple people try and looses. Once you walk past that sign all your audit falls apart.

I'll hand it to the auditor. There were a lot of officers there, both police and military, bearing down on him and he stood his ground and slapped some sense into them. He got illegally detained for a half hour and was clearly livid but had the restraint to compose himself.

@@OldManWhit Nope, chances are pretty good they'll insert that " National Security " clause and then it's just about all over. People go missing around Area 51 for that same shit. Try recording outside of and well off the base of things like, an active navy base or an Air Force base known to have nukes ( Fairchild AFB Washington comes to mind). Try to record as your standing on a public passage outside of any of those and you will, be greeted by people you do not, want to meet.

Sometimes the lines demarcating military and civilian boundaries are not as clear as most “auditors” think that they are. Sometimes the bus stop or the “easement” or even what looks like a civilian municipal street (or even a State highway) is under military control... When people learn from other KZbin videos by other misinformed “auditors” then they often get the results of acting stubbornly on bad information. Furthermore, The GIS surveys they sometimes rely on are often off by several feet or more. The surveys conducted by on the ground professionals are much more accurate. There is a Supreme Court case about misunderstanding military boundaries. In UNITED STATES v. APEL(2014) No. 12-1038 Argued: December 4, 2013Decided: February 26, 2014 {Held: A "military. . . installation" for purposes of §1382 encompasses the commanding officer's area of responsibility, and it includes Vandenberg's highways and protest area. Pp. 6-14.} { (a) Contrary to Apel's argument, §1382 does not require exclusive possession and control. The statute is written broadly to apply to many different kinds of military places, and nothing in its text defines those places in terms of the access granted to the public or the nature of the Government's possessory interest.} I’ve become more anti-auditor since I last posted on this page. Love the auditors who protect our rights. I'd have printouts of the DHS memo explaining that video from public areas is legal, 42 USC 1985 that explains deprivation of rights under color of law, the GIS survey that shows that the sidewalk is public property, etc. Then again, if the goal is to make permanent changes in the enforcement rather than survive an encounter, it may be better to know these things cold but not reveal the information until the lawsuit is filed.

Pretty sure they only have to tell you what you're being arrested for, and even that may be dictated by local policy. Not 100% sure but it's certain you don't know what you'll be charged with if arrested until arraignment, as prosecutors decide the charges that go to court.

You'll get notified in charging documents, other than that they don't have to tell you shit, though they usually do notify a person being detained, they have to prove reasonable suspicion and probable cause to the court, not to a defendant.

Excellent point on the lack of a requirement for police to inform persons why they are being detained or arrested. Suspects generally will only find out the reason at arraignment, typically within 48 hours. Further, since police are allowed to not be truthful in this setting, they could very well have RAS, but say they don't. That puts the suspect in jeopardy if they fail to identify upon request. However, I suspect that a charge for failure to identify in such a case would be difficult for a prosecutor to win because it would appear to be a type of entrapment. From this video, it appears that the photographer did not identify upon request and it appears that the officers did not arrest him for that failure. Finally, in the remote eventuality that the photographer pursues a civil right lawsuit for the illegal detainment, a key, compelling piece of evidence would be testimony from the detaining officers about what their RAS was. Unfortunately, they won't be required to testify under oath until months later. In the meantime, most certainly the officers will have been exhaustively coached on how to testify. This coaching will come from fellow officers, union leaders, attorneys hired for him by the union. Plus, he will have received advice, but not coaching, from the attorneys defending the lawsuit. But, most alarming, the officers are allowed to be incorrect about the legality of the activity they observed. e.g., they could say that they sincerely thought that photography of the gate was illegal when it actually is legal. All this shows that almost aspect of the relationship between police and the public is asymmetric.

@@craigjensen1091 Generally, only prosecutors have the authority to file criminal charges. With few exceptions, there is almost no way for the public to force a prosecutor to pursue a case that they don't want to. Although, I understand that one of the few exceptions are violations of civil rights.
