Usually my bothers hunted on the family farm in ND although we lived in MN. A large area of the farm was a naturally preserved wetland. One of sister-in-laws said no more trophies so they’d donate the meat and antlers to locals. It’s different when you’re a local land owner in a small, small town who gives away venison and trophies.

This happens in Florida too. I know of a man from North Florida who had his guns and truck seized over a deer killed that he was not in possession of and was not found in the proximity of. he had to pay a lawyer and get forensic evidence that he didn't shoot the deer. The game commission had to return his truck and guns after over a year. When he went to get his truck the battery was dead so he removed a battery from a game commission truck to put in it.

It's not a happy ending. His antlers are ruined and he had to pay lawyer fees ect. It'll be a happy ending when he wins the lawsuit, everyone gets held accountable and gets a nice paycheck.

I met that officer at a stand they had at the WV State Fair. I'm not from WV. We had a good talk, when I said I wasn't from WV he made a off hand comment to another officer about me being one of the guys taking their deer. They laughed, kinda, I found it weird enough to wrap up the conversation and me and my son went along our way. Small 🌎

Currently dealing with a similar problem in Indiana. 2 officers came to my house and harassed my wife 2 months after gun season . Their first question was if I was home. I was not because I’m a firefighter. They cornered her on our back deck and told her that she didn’t look like a hunter and even made her make deer noises. This was the first deer she had ever harvested. This questioning and harassment went on for over an hour. They wrote her a ticket for illegally checking the deer because it was taken 300 yards out our back door on private property. They didn’t know I had a farm lease on the property. . This will be a year in January and we have not had a court date and they still have her deer they illegally took. We have since filed a sexual harassment claim against the officers from the event. Nothing came from it.

If Justice were truly Blind then that would be the expected outcome... but far too many people are in fact "above the law" because they know their victims cannot begin to afford the attorney fees it will take to do anything to bring THEM to justice! And there'in lies the problem in our legal system: Justice is NOT blind, some people are "Above the law" in effect, and the cost to get Justice is too high for the average citizen in this experiment that's going oh so wrong of a country!

1st thing when dealing with pice at you home, tell them they are trespassing and to leave. If they don't it's trespassing after warning, this is a crime and call the state patrol. Then call your attorney and have them on speaker phone. Without a SEARCH warrant in hand they have to leave. If they have an ARREST warrant they still can not just enter. They have to get you outside your house. Got to love family that's just went to law school. Knows all current laws and all the BS the cops can say to you and what I can and can't do when falsely arrested and or detained.

I went through a similar issue in MN. I had a beach house I was remodeling. It was unique and grandfathered due to its close distance to the shoreline. I had all the necessary permits, but at 7 months into the project I receive a cease and desist order accompanied by arraignment notice whereas I was charged criminally for performing work without the required permits. After waiting 16 months for trial, as there was only one misdemeanor trial call a month and I never made it in the top 10 for priority, I filed a demand for a speedy trial. The demand required the trial proceed in less than 60 days. The morning of the last call trial call available, the county attorney dismissed the charges. The delay expenses and legal fees totaled in excess of $10K. I was going to bring a motion for sanctions against the county attorney for frivolous and harassing litigation. This is when I determined why the county attorney had brought the matter as a criminal case, rather than civil. You cannot bring sanctions against a prosecuting attorney, in a criminal case, in MN.

These are some of his classic mistakes. 1. Assuming that being innocent guarantees that cops will go away. 2. Assuming that cops will take your words as intended by you. They will twist. 3. Repeated asking of the same question is for clarity. It's to trick you. 4. Not recording EVERY cop interaction. At least audio. 5. Speaking to ANY cop at ANY time for ANY reason without an attorney.

I had a very similar experience. However, I guessed (correctly) what they wanted to talk to me about. I press prepared for the meeting by pulling together all the documents needed to defend myself. I had the wildlife agents meet me at my office instead of at my house. My office is in the same building as my attorney. I invited them in to a conference room and told them I was recording everything. They looked at each other and one of them pulled out his phone and turned on the recorder. I had a witness in the conference room - they wanted to know why he was there. I told them he was thete as a witness. I let them do the good cop - bad cop routine for about 1.5 hours. When they got to the part where I was pretty sure they were going to arrest me they asked if I needed an attorney. I said "Not right now but he's in the next room if I change my mind." I told them I had what I think they were "confused about", flipped over the documents I had ready on the table, and told them I was saving them some time as all the documents I was providing were filed into the public records at tbe court house and that these were certified true copies. It was priceless to see the excitement and enthusiasm drain from their faces. They thought they were going to perp walk me out of there and get there pictures in the papers. They slunk out of my office and I haven't heard from them in 2 years. Before anyone asks I had done absolutely nothing wrong and followed all the rules. The whole story is too long for this venue. Be smart.

Beyond that, if your dog barks at them, they can kill it and say "I felt threatened". Same if they shoot a person they say"I thought he might be going for a gun." Cop gets no charges for MURDER

These are legitimately the type of cases that scare me. I tend to keep to myself and stay home a lot but nothing prevents some LEO showing up at my door saying I did something wrong when there is 0 evidence proving it especially when they can show up without a warrant and lie to me to get some sort of self-incrimination from a conversation. I'm glad there are channels out here like yours that help educate the public on what law enforcement can and cannot do. Thanks for all that you do.

This is why you don’t talk to them and don’t answer the door. They had zero evidence to prosecute this man for anything. They also didn’t have a warrant so what this man should have done is refuse to talk to the police and told them to come back with a warrant. Had he done that, they never would have been able to get to his bucks and had to give up trying to pin a charge on this man. The 4th and 5th amendments were created to protect us from this exact situation. So protect your rights and protect yourself.

You also have no legal obligation to speak with officers. Verbally invoke your right to remain silent, then request a lawyer , and then shut up. You can never incriminate yourself if you don't talk to them but you also have to clearly articulate that you're invoking your right to remain silent.

From what I've noticed far far too many of those in LE exhibit that horrible behavior because of the illegal and morally reprehenisble things their peers, their higher-ups, their department and former officers have gotten away with under the color of law or that they were able to coverup after the fact. Many go into LE knowing they'll have carte blanche freedom to push their racist agendas aggressively with many like minded individuals to cover their back.

Police culture is extremely successful at getting officers to view themselves as separate, distinct, and at odds with the rest of us. This Us v. Them mentality combined with loyalty demands explains why police whistleblowers are so very rare.

It's due to the illegal and oppressive war on drugs. The state has no business telling adults what they are "allowed" to consume, especially when the overwhelming majority of drugs are less harmful than alcohol (Source: Drug Harms in the UK: A multicriteria decision analysis)

My understanding of why the Court ruled police could lie was for undercover investigations when an officer became embedded within a drug or prostitution ring. As usual, whenever the government gets granted exceptions, it always takes advantage beyond the original intent.

This was a great piece! Thanks for your hard work and diligence. Nowadays I am suspicious of all law enforcement. Sleezy tactics and secondary gains motives (“our trophy deer” - in the case) plus apparently zero accountability or consequences for illegally going after an innocent man, smearing his name and dragging him through an unwarranted legal process. There is no vindication for this man, no apology and no way for him to replace a slipped trophy hide. His rights were blatantly trampled upon by apparently corrupt law enforcement officers who obviously knew they had zero evidence and zero case. These West Virginia wildlife officers are operating with a shady playbook similar to the ATF. “Act first” then do your investigative due diligence while the subject remains under duress worrying about his valuable time and even his livelihood. It is appalling that this has become SOP in many fake criminal cases. Thank God there are still lawyers out there, like you, who have concerns about civil liberties and constitutional rights defense. Virginia went bad by reclassifying game wardens to law enforcement officers. It's come to my opinion to never trust any law enforcement in any situation ever. I used closely with law enforcement and game wardens decades ago. I was in public safety in another state at the time. Law enforcement earned this.

@@mandelstamm yes, as are in many places. A few years ago they reclassified game wardens and now they can arrest you for several infractions. It used to be they were "friends" of the hunters, fishermen and outdoorsmen. A mentor to all Boy Scouts and Girl Scouts. Now, they are just cops looking to ticket and arrest everyone they stop. It is very dangerous as law enforcement goes. Alone, often. No back up.

and the moral of the story is: "DONT TALK TO THE POLICE" if he had not told him were the antlers were and that he had a photo and admitting to have hunted them etc. they would not have known the taxidermist to get the antlers. and if the police comes to your place uninvited, TRESPASS THEM, and even better tell them their whole department is trespassed. Then put up a sign "NO TRESPASSING" in your yard or at the entrance to your place.

As an avid salt and freshwater fisherman, I’m am distinctly aware of the power these natural resource/ game commissions wield. Make one wrong step and you can lose a car, boat and even a house. While I do feel conservation and awareness are necessary, I do feel these agencies have entirely too much power. More often than not this power is abused and leads to situations like the one here. Very sad that this happened. Hopefully doesn’t deter him from continuing to hunt and enjoy what our creator has given us.

If a DA ever moves for a continuance, counter move for dismissal with prejudice as they are denying you due process and a speedy trial. If the prosecutor brings charges and doesn't have their ducks in a row, they are violating your constitutional rights. Period.

I'm not a hunter, but had vehicles seized in much the same way. Then sold by police. Only two years later at court a judge demanded police to give me back the vehicles as they were taken illegally. I had to take another court case for compensation of sold vehicles.

Years ago there was a local cop who stopped a guy That turned out to be a drug dealer. When he went to court they told him he was being charged with X amount of drugs in his procession and $20,000 in cash. The suspect stated it was $30,000, where is the other $10,000? They assured him it was 20. Upon investigation it tuned out that a detective had stolen the $10,000.

I think there needs to be a law prohibiting any type of lies or false declarations used by any law enforcement agencies from being used. We need some real justice to halt this type of actions and hold the deceptive cops and law enforcement agents to a higher standard. By allowing them to use the deceptive tactics we are basically granting them the ability to keep rehearsing all of the absolute lies and when they appear in court 'sworn' to tell the truth they are no longer capable of being truthful.

My son in law from out of state was issued a Ticket for hunting without a license while hunting hogs here in TEXAS. The law specifically exempted any hunter from being required to have a license to kill depredating hogs on private property. I stated this to the Warden and he got puffy and wrote the ticket anyway. It was dismissed by the JP after showing him the law and calling TPWD to confirm that he was hunting legally. The Wardens write many tickets knowing that most people will just pay it rather than fight it. Absolute violation of hunter’s rights, but nothing is ever done to deter them from doing this.

What good is an unfelt fake ass apology? Sue the snot out of everyone involved and put it in some major newspapers and hunting magazines. Make sure to put the names of all the people involved in this sham so people know who they are, up to and including their families and friends. Post pictures of them with as much information you can get so everyone has an opportunity to let them know how they feel. Dude about 15 years ago cops came into our home with no Warrent and stole a PSP around 5 rifles and a collection of very expensive knives valued over 5000 dollars. They also tore apart all of my subwoofers and put a hole in the drywall. I really wish we had cameras back then available. And when we contacted the department to see if we could get them back they claimed that it never happened and that officers never took anything or were even there in the first place.

Similar situation happened to me; a criminal suit dropped the day before we were set to start a jury trial. I had custody issues pending with my daughter, or I might have pursued the same recourse. I hope every single dollar is drained from their pocket books, and the gov is forced to do a full media “blitz” clearing this young gent’s name. I been in court a bunch with my crazy ex, and an out of control family law system, and my divorce attorney was among the best, you share many of her fine attributes in your dealing with evidence and presentation of facts. True story: my friend was in northern Michigan snowmobiling . When he stoped to load his sled back on the trailer he removed his coat and placed it in his vehicle. All while a snively whiplash DNR orificer was sitting in his truck watching it all occur. The pirate walked up to my friend and demanded his ID. My friend told him, “ Ok let me get it it’s in my coat pocket” the pirate went into stormtrooper mode and demanded he produce his papers immediately. Well, my friend was not able to get his coat and was ticked for operating his machine without proper papers. Despite the fact we live around 3 and 1/2 hours south he fought the ticket and lost in the kangaroo court of Paradise, Michigan. It’s ALL about revenue !

How much money is this guy out from having to hire a defense lawyer for a case that just gets dismissed a week before trial? Or all of the back and forth between his home and where the court was? And now, to recover any of that, he has to fork out more money and risk losing a lawsuit. And, because of qualified immunity, the game wardens face no direct personal consequences. So the taxpayers are going to be the ones footing the bill. This is 100% ridiculous.

I can't believe that we can't find a way to punish malicious prosecutions like this without allowing frivolous claims to get out of hand. This man should be compensated otherwise justice is not being served.

I don't believe I would be looking for a way to punish these officers (that's for a jury to decide) more so that I'd be looking for a way to keep them from doing this again....EVER. Someone might look into the State licensing agency where police get their certification. There should be a complaint process for this type of behavior that these knot heads would be looking at being decertified. A totally different process than being sued in federal court. I would have troubles with someone crossing County lines without a proper court order let alone going into another State without a warrant or with probable cause that a crime had been committed. The officers in the South Carolina jurisdiction need their hand slapped as well for allowing this to take place. I think I'd be a little pissed at the taxidermist for allowing those antlers to be seized without some type of legal paper work being served on the store/business let alone the owner of the antlers.

DNR in Mineral County WV just got done prosecuting one of the largest poaching cases in WV that was taking place around the same time. 2 mineral county deputies and the ems chief were arrested and convicted, as well as the ems chief from the neighboring county in MD, and 7 others. They killed at least 27 bucks in mineral, grant and Hampshire counties. They seriously got probation.

I've seen similar stuff happen in Arkansas. People think because a deer walked past their game camera that they now own that deer.

I have a hunter that leases my land. There was a monster on camera for years. He never took it to let it get bigger. The first time that beast crossed the fence the neighbor took it. He was angry, but never blamed the neighbors. He said “hell, I’d shoot it if i saw it too!l

Since the state has now put an actual dollar value on trophy deer, the state now owes the victim that same amount for ruining the capes. This is in addition to any damages he would seek for defamation, false charges and attorney fees.

The newly appointed chair of the DNR committee in the WV House of Delegates is also the President of a hunting club which two members are believed to have participated in the murder of a married couple who trespassed. One member, Terri Storer has been charged with two counts of murder. Trial scheduled for April17th 2023.
