Logan Police Run A Sting operation to catch people failing to yield to pedestrians in cross walks. Their officers try to make themselves as un-visable as possible, jump out in front of cars, and then ticket them if they don't stop fast enough. Cache Valley Transparency, who is highly concerned about officer safety goes out and holds orange flags to bring attention to the officers trying to cross the street to keep them safe, but Chief Gary Jensen is mad that they aren't able hand out enough tickets when drivers see his undercover pedestrians, so he tells Cache Valley Transparency that if he continues to keep officers safe, he will be arrested.

The courts have ruled that a person flashing his lights or posting/holding a sign to warn drivers of an upcoming speed trap is a clear exercise of the First Amendment. As such, officers can not arrest or charge a person for this without directly violating the First Amendment. There is no arguable distinction between what is happening in this video and warning drivers of a speed trap.

I will say that what he is doing is not illegal, but I do have to defend what the police are doing as well. Where I work has buildings on both sides of the street, and therefore we have employees crossing all the time, and we have installed our own lights for the crosswalk, that we also keep painted. It's state law to stop for all pedestrians in the crosswalk, and yet cars fly by all the time and do not stop. People have been hit in this crosswalk and had serious injuries'. So we allow officers to run this kind of sting there all the time. Drivers these days are oblivious, and this is actually a good use of police money. Now, that being said, this chief does not care about safety, only the money. The point is that simply running that sting makes people stop, you don't have to actually give tickets.

Sting operations like this are probably illegal to begin with. Just like DUI checkpoints are in the technical sense illegal as well. The Chief in this case has made his intentions known and it is below the belt for what he is trying to do. Generate a revenue for his department. He should resign or his employment as Chief to be terminated for such practises. He is essentially giving out incorrect advice about the flags. The city put those flags there for a purpose and it is to keep predestrians safe and noticed at the crossing. The Chief saying you will be arrested for using them is sending the wrong message and it could deter others from using them, thus making it less safe. What is his role again? Protect and Serve? Take the protect out and add ourselves, and you have "Serve ourselves" - Yes, with the money of tax paying people.

It is very obvious from the video that they only cross when traffic is coming. Not when the street is clear of traffic. The fact that they decided to go this route, using vast amounts of resources, 10-22 officers. 9-10 vehicles, drug dogs, plain clothes cops, rather than installing warning lights as most cities do. I think this is more a case of entrapment by the police. I realize every State has their own version of what constitutes _entrapment,_ but some citations would likely fit the generic definition under the right circumstances. The PD pretend it's a safety operation, but it could be very easily argued that with the officers purposely stepping in front of vehicles without due regard to their safety, and the distance and speed of the vehicles, they are creating an unsafe situation for everyone involved. Imagine they do this while there is rain or snow out there? Their actions could easily cause a serious accident, not just for themselves, but also the driver or innocent pedestrians or kids playing in the neighboring yards. Entrapment: An affirmative defense in which a defendant alleges that police officers acquired the evidence necessary to commence a criminal prosecution of the defendant by inducing the defendant to engage in a criminal act which the defendant would not otherwise have committed. see, e.g. Jacobson v. United States, 503 U.S. 540(1992). That's the legal definition as per Cornell Law University.

Several cops in plain clothes, stand at a cross walk, wait for cars to come, then decide to cross the sidewalk, forcing everyone else to stop, so they can ticket an offender? It would be interesting to know, how many of these stops resulted in a vehicle search. Wow. That's some awesome crime detection and investigation. Phffft. Normally we do that that's a ticket for jaywalking,- what they're doing is entrapment plain. I have always and continue to have the utmost respect for good police officers. I know they have an extremely difficult job to do not to mention dangerous. On the other hand, I cannot abide by Constitution breakers authoritarians that want to push their will on the community! In my opinion Constitution breakers are un-American have no right to push around the public when no one is breaking the law. It is my duty as a proud American citizen born and raised to say something when there are those that are sworn to protect and serve and abuse that authority. For me to say nothing would be un-American! Please keep in mind, we the people have the power of the vote. We can vote out the mayor, D.A. , and sheriff if changes are not made immediately to remove this constitution breaker from the office of Chief of Police.
