Creek Smallmouth on the NED RIG

In KY property lines will go under the water. If you're floating your fine, but wading technically puts you on their property if they own both sides.

fishinwithdave I'm a realtor and fisherman, with 192 hours. Riparian Rights Anywhere will tell you No one owns the water. In very certain situations they can own 'half' but that's rare and ya can still fish it. So, No One. For instance I have an army ammo installation right behind my place. I've floated and fished it enough at this point they wave. Everyone else whispers they'll come out with m-16s, maybe even drag you from the water or 'guide' ya out, No. Those people are subscribed to that guys YT of being an Asshole thinking they're doing the right thing. Bet they have a patch of ocean they bought and named for their gf's. cheeeeese IT'S!

Yeah Dave they can in certain situations, For 'drainage' and such. Just like they can force you into selling your land for needed 'utility' purposes. However- like I said below, Even in those situations they can only own out to about halfway. So you can still fish or kayak those areas, it very grey and they can't really enforce it. All you have to do is walk to he halfway spot, that's why No Matter the situation, nicely ask them who the fuck they think they are. No One owns entire Rivers, not even Bill Gates. That's Only Government or federal installations. NOT rural/ private anything in any way, To clarify. I live on a peninsula beside a chemical plant, and have an army ammo plant to the back on north fork of the Holston, I've had to look up and learn this exact info, it wasn't even spoken about in detail in real estate school. That's why they keep dams chained up and you can only get so close to fish, they reserve the right that they own out so far and people can't fish or trespass for obvious reasons, but still. I've been harassed fishing dams even here in TN. Hey don't own the water, but in certain situations..theyll act like they DO.

You can own the land but not the water if you are wading its on top of his property however if u floated over it on the water he does not own the water. That was the best response I got from fish and wildlife ob the subject

Caught some great creek smallmouth! Too bad about that guy but I think you handled it well. He was totally in the wrong but like you said, maybe he's had other fisherman trash the place and that's created a bad view of fisherman by him and he thinks he's doing the right thing. He could definitely have handled things in a different manner but oh well.

I think you handled it spot on. If you plan on going back I would definitely talk the to fish and game agents and the cops before next time. That way you know exactly where you stand and then piss in the codgers corn flakes when he is proven wrong. And the neg rig rules.

That is a navigable waterway. In Arkansas the public has 50 feet from the shoreline. Should of just let him call the cops, could of been a good add on to the video and taught him a lesson.

Should have called DNR. People like this get away with so often that I have seen people post property that legally was not theirs because they have gotten away with it for so long.

My Fishing Friends, ALL waters are public. People can b.s. I have 192 hours in real estate school. Your city ponds are one thing, yes they're private. (Mostly still open to public) Lakes, creeks, rivers, are All public. Do people act like this at the beach about the ocean? No. Can't stand these people Even if they have good intentions, I don't care. Guy just ruined my mans spot when it was heating up. If Anyone in Any state Ever talks to y'all like this. Motion them towards you, ask them to turn around on their phone and look up the riparian Rights in that state, Which are All the same- No One owns the water. In particular cases the government Can own HALF, but that's near nuclear sites and such, which you can still use if ya know Which Half. I just wanted to clarify, never back down to these water weasels. They're mad because they've never caught a fish and watched you catch a few, even his dog was jealous.

You should really try Nikko baits hellgrammites on those zman shroomz Ned rig weights. That is probably the best bait for smallmouth I’ve ever used. It’ll catch tons
