Why? He did his job. In most countries in the world international passport is the only identification for foreigners. Some countries also mutually respect national passports. But she didn't have any passport with her.

@@elksalmon84 No. Canadians can drive in the USA indefinitely in the USA with any provincial drivers license. As a matter of fact, they can even enter the USA with an expired Canadian passport. This is a fact. Treaties are in place. Every border police officer knows this as do Florida officers.

As a 3 decade cop, this was atrocious. In fact I have stopped Canadian tourists in South Florida. Never arrested any of them. YOU NEED TO SUE THEM for FALSE ARREST!

It's always good to hear /see a cop or former cop speaking out for the right side when cops use their might to abuse people. I do believe there are more good ones than bad and that bad behavior from officers endangers all officers, so it's good to be reminded of it with the good ones speaking out. Especially in these days when the system does allow for way more bad cops than it should. Thanks for your voice!

Georgia is one of several states where you MUST have your Canadian Passport with you in addition to your Canadian Driver's License. The policeman was correct. Refusing to let her contact the Canadian embassy was a no no.

She's facing a charge of driving whilst Canadian, the judge is asking the prosecutor where this is actually prescribed as a crime in Georgia, the prosecutor is stuttering.

Several decades ago, I used to hate driving through Mississippi and Louisiana because of local rackets like this. Glad you got it resolved.

Same thing in Indiana. If they see an out-of-state plate, you're toast. They will sit right by a speed limit sign that's lower and use the radar gun to clock you outside of it while you still could go the faster speed, then follow you into the slower zone a few blocks, and THEN light you up. It'll be your word against the officers that their radar gun wasn't pointing into a zone that was actually faster when they clocked you. It's one of the oldest tricks in their playbook and they love playing it. And it gets worse. After that, if you go into the courthouse the next day they will tell you that there's a 10-day waiting period before the ticket will show up in the system, even though you can pull it up online. They won't let you pay it and they won't let you talk to anybody. The goal is to get you to leave town so that you can't fight it and that hopefully it will even go to default so they can get you for even more later. It's really screwed up. But that's the way it is in Podunk America

Most Canadians are. I was born in the US and lived there for 48 years. The last 18 I have spent as a permanent resident of Canada. The people here are wonderful, and I plan on staying.

mr white umm I tried searching up the “open-boarders immigration policy” or as it may be called the “open immigration policy”, I didn’t find anything having to do with what Fez337 said, and I don’t even know where you got that from, but unless you have proof of that then show it. I am very certain that Fez337 is correct about the fact that Canadians with a LEGAL drivers licence from Canada are ELIGIBLE to drive in the US, unless there are some exceptions, but I think there may not be. If you mean by “open borders”, then that’s something else, but borders aren’t that OPEN, in other words, “free” of letting through people, so that’s definitely irrelevant. As a Canadian, and one that travels to US a couple times per year, I know how borders are and I have never heard of that kind of policy.

Why? The news show didn't say it, but it showed on the screen that the officer can request to see the passport to check the validity of the license.

@@AshiStarshade She showed a photocopy of the passport, and the officer could have called dispatch to verify the validity of the passport. Instead of performing an investigation, like she is supposed to, she arrested an innocent person.

Driving through Georgia with Wisconsin plates, I was pulled over for following too close to the car in front of me on the freeway. The cop actually told me I must maintain 300 feet from the car in front of me. 300 feet! He just wanted to run my license, no ticket, but clearly I was targeted.

Absolutely true. And not just Georgia. There are departments of towns and cities off major highways which basically use seizure laws to rob people blind. If an American or Canadian stays in a motel or hotel off a major highway, expect that the staff is working with police to profile people and stop them as they leave.

I called this department about a year later. They still think they did fine. Only had to give in to public pressure. Oh and the Supervisor whom I talked to said 7 times that she was the Sheriff's wife. Very strange.

I am a Canadian trucker for 18 years and have been stopped by cops and hwy patrol but never heard or experienced anything like that. The hwy patrol can even check my medicals through my Canadian driver's license so how come this particular cop is so ignorant of the law? Americans are all over in Canada driving the number plates from Georgia do they have a different driver's license to come to Canada??? She should be fired for being an embarrassment to the state of Georgia.

It is my position that these people are enjoying their fantasy...One in which it should be a simple task to simply hire an imaginary better person...One that is eager to apply for a job made up of tasks...Tasks that they are unwilling or unable to perform...At a compensation they are unwilling to accept.. And if You feel that You need better Police Officers You need to apply...Pass the screening and Pass The Academy....Pass the State Exam...Pass The interview and get hired by an agency....And show us how the job is done properly... @ALL The Supreme Court of the USA determined that Police officers DO NOT NEED TO KNOW THE LAW. It is utter bullshit. But think of how few people would be qualified to be police officers if they needed to know the law. What they need is a DA post at the county station for cops to radio when they hit something like this that they don't know what to do.

Sounds like a "tourist tax" stop. I've run into this in other states where the officer sees your license plate, and you aren't local, so they pull you over and write you a ticket. Even if you weren't breaking the law. They of course knew that you wouldn't come back to fight the charges and most likely would pay them if you knew you'd be back in that state again.

Somebody should make a list of places to avoid as tourist in USA...I guess there is probably a youtube or website for this already. Georgia is a red flag for sure. Prob Alabama, Mississippi, Parts of Florida, west Texas (experience)...

Georgia Cops have been notorious for stopping out of state vehicles for as long as I can remember going all the way back into the 70's just so they can write a BS ticket. Here's some other states to be careful in New Mexico, in the Clovis area Alaska , Arkansas, Washington State, New Jersey, Virginia, Montana, Utah. to name a few.

My American brother and I were driving over a bridge in southern Ontario some years ago, and ran out of gas on the bridge. A cop showed up, and instead of harrassing us he drove off and brought us some gas, for free!!!!!!!! Quelle différence!

As a frequent traveler to the USA, my license from my country is valid for up to 6 months. I do not require an international drivers license to legally drive in the USA. I never have a problem hiring a car from any company at any international airport in the USA. My biggest fear is a traffic stop with a cop that doesn't know the law.

What the world fails to realize is that the southern and Midwest in the United States often has single patrol in law enforcement. If you run into an officer who is uninformed or with bad motive, you are forced to go through the system and suffer the financial cost. It is best and safer to avoid those parts of the country when traveling. It is unfortunate but travelers have to incur the extra cost and the officers and agency are insulated from liability for the error. Thankfully this young lady was able to get help.

It's not just Canadians, I went through a similar situation, no arrest, but a bs charge in 1979 or 80. Totally fabricated, because I had NJ plates on motorcycle. Had to pay cash to continue on.

What gets me is it just wasn't the ignorant police officer who pulled her over. When taken back to the station, the officer obviously had to tell other people why she was arrested etc. Not a single one of them seemed to know the law or care to correct the arresting officer on her mistake.

Canadians per se are not being targeted. Any out-of-state long distance traveller is more likely to have the book thrown at them as they are unlikely to return and mount a defense. This is also a particularly touchy time with anti-alien sentiment quite high - esp. in the deep south.

Interesting but that is the law in Georgia and is published on their website. It is interesting the that Heather conveniently leaves out the last part. "Non-US citizens with a valid foreign driver’s license are allowed to drive in the state of Georgia for tourism or business purposes. If you choose to drive with a license issued by a foreign country, a law officer may ask for your passport or visa to verify the license is valid."

to be fair.. it does appear there was a legitimate ticket issued for speeding.. whether it was a speed trap or not does not make less legitimate.. unless something fraudulent or in attempt to fool drivers into thinking the speed limit was different than what it was. And depending on how much over the speed limit the person was going could be justification for an arrest and felony charge. Its unclear from this video interview what exactly the charge was.. we have a hint that it might have to do with speeding when the person referenced a "speed trap"

There is very little accountability for police in the United States. They will act above the law and unknowingly do many illegal things with zero consequence. @@gsp49 Where do you get that information from? That is a crock of sh--. They may claim immunity, but that is something that would have to be argued in court. State rules make it difficult, but it can be done. Before you can sue the state of Georgia, you must provide ante litem notice, just as you would when suing any government entity in Georgia. This is basically an overview of how you sustained your injuries and evidence to show how a Georgia state agency was liable.

She should’ve got a full refund, including the impound charges and apology at the minimum. That cop violated her rights by not following the law and could be sued as well as the police department in that state. If cops are unfamiliar with the law, they should call a supervisor before arresting somebody unnecessarily.

Got two more stories relevant to that. -- I was pulled over on another interstate, not for anything driving-related but just for having a license plate that said Mississippi and not South Carolina, and the clown sat me in his patrol car asking my why my parents weren't travelling with me. I said "well I'm 42 years old and they have their own lives now". He just looked puzzled and didn't know what to make of the whole thing. Not even making that up. -- A friend of mine moved to New Orléans from New Jersey, went to apply for a Louisiana driver's license, they asked her for ID and she gave them her birth certificate. "Dat ain't no gut" the clerk said. "Why not" asked my friend. The clerk said..... wait for it.... "it's not from here". You just want to find a wall to bash your own head into....

I live in New Mexico, which is a state in the US, and a family member driving through Georgia was stopped and the cop wanted to see their Mexican passport because they have a New Mexico license plate. There is a reason we are the only state in the country that has USA on our license plates

Here in Canada, in order to become a police officer you need a University Degree. Down in the USA, I think the only prerequisite for joining up is highly questionable.

Sue.? The taxpayers foot the Bill. She will being suiting the poor citizens of Georgia. The cops have immunity from any prosecution or lawsuits stemming from actions. Something is needing to be done about this Caustic Culture that is actually nurtured by Police Chiefs and their subordinates.

@@creekdweller9662 - Umm... no. Qualified immunity grants government officials SOME immunity from civil suits. In other words, you can't sue them for doing their job. However, you CAN sue if you can show that the official violated "clearly established statutory or constitutional rights of which a reasonable person would have known". A reasonable person (especially a cop) should know that a Canadian driver's license is just as valid in the US as a US license is in Canada. So in this case, a lawsuit would be easy to pursue.

​@@Mr.Ekshin It's way worse than that simple interpretation. The "clearly established" standard doesn't refer to laws, reasonable people, or behavior expected of cops. "Clearly established" means established by the supreme court. In this case, there is almost certainly no existing judicial precedent for a Canadian driver's license with scanned passport on a cell phone in GA so the officer would get qualified immunity, and there will never be a precedent for similar cases so cops can literally do this everyday forever in complete immunity. A great/terrible example from 2019 came when an officer in TN ordered his dog to attack a suspect who had already surrendered. The closest "clearly established" standard involved a SCOTUS case where the suspect had surrendered by laying down. But the TN suspect surrendered by sitting down and holding their hands in the air. That little difference granted the TN officer qualified immunity which was affirmed on appeal. In another recent case some federal agents beat up a patient at a VA hospital, but they beat him up WORSE than the closest "clearly established" case, so the court granted the agents immunity. It really is that bad. Cops have complete immunity for ANYTHING that SCOTUS hadn't PRECISELY address before 1982. Think about it, cell phones and digitally scanned passports didn't even exist before 1982 so nothing related to them can ever become "clearly established".

They don't even care about that. They don't have to pay the lawsuit judgements, the city/county does. so there are literally no consequences for the individual officers and/or the the police departments that order them to do this.

In 1985 I had recently moved to Georgia from Ontario, and was driving to Miami to see my sister (in a US registered car I had just purchased) . I was stopped for speeding near Valdosta college (?) , and when I showed them my Ontario driving license, It was taken from me and I was told to follow the police car to the station where I was hit with a $80 cash fine (maybe more, but that is what I remember). And they gave my license back. Not as traumatic as this incident, but similar attitude "How do I know this is valid; How do I know you will pay the fine if I ticket you". I suspect my cash fine paid for a few dinners / brews for those involved.

I agree with her. Caught "speeding" and arrested instead of a citation and mail a check. Obviously they know it's a lose now or lose later forfeit the bond. Then owe the bond or bail. It's not speculation it escalated to that point, and the officer not consulting dispatch. She has a clear case of unlawful detainment and wrongful arrest. Try $20,000 and walk.

That's exactly why some cops prey on out of state drivers (and in this case, out of country). They KNOW you're not willing to come all the way back there just to file a lawsuit, and then stay there for the duration of the suit.

Such a well spoken young woman, not a “you know” or “uuumm” or “like” or any other unnecessary nonsense word. Just full sentences, delivered one after the other, developing a coherent conversation in a pleasant, alert and engaged demeanor. I’ve observed before from other of my neighbors to the north that Canadians obviously must have a much higher quality educational system. You put Americans to shame!

@@AkbarSnackbar There is no law universally reimbursing legal fees, especially for civil suits. That's why people usually lose money even if they win a civil asset forfeiture case. The legal fees cost more than the money seized so they lose money even if they win. That's by design so police can abuse civil asset forfeiture and make it not worth it for people to try and get their money back.
