There is no good rule to this. He gave the appropriate answers, but not answering questions can often get you in more trouble than answering basic questions and refusing a comment on others. Police tend to be more suspicious and aggressive on individuals who remains completely silent. @@krane15

@@theatomic430 Yeah, I can tell he's not a criminal defense lawyer. More likely just a regular corporate office type. In fairness to him, though, it's scary and intimidating when two cops with guns and badges and bright flashing lights and an aggressive "take charge" attitude come up to you and start asking you questions, and you're on your own and there's no one on your side to give you any moral support.

The first day in my first class in law school my criminal law professor (an ex federal prosecutor) told us never to consent to a search of your vehicle. There really is no upside.

You're helping the cops search for a reason to arrest you. Sometime they can find things your family or friends may have left behind. Even a service attendant or the guy at the car wash. One grandma was arrested and jailed because her grand child had put cotton candy under the seat that had dried and tested positive for cocaine using the field test kit. She spent 4 months in jail before the lab finally got around to testing it and confirmed it was just cotton candy.

​@@fuzyfuzfuz2 Well, because they are authority and usually if they ask you to do something you kind of have to do it. In this case he didn't have to consent to a search because the officer had no probable cause, but if the officer asked him to step out of the vehicle at any time, by law he has to do it. Refusing an officer's command will just hit you with resisting, and that gives you a criminal record, which makes it tough to get jobs and other stuff rightfully so.

This is known as a pretext stop. They are phishing for something and trying to find something else. They are running his tags and license. He does have to ID, but does not and should not consent to a search!!! Please know your rights, brothers and sisters!!!

@@kajuskup375 the dogs give false hits more often than not. Average of about 50%-80% of the time it's false alerts. I'm sure there are ways the dogs can "ALERT" on command. Or the handler just says the dog did.

I like how the cop just repeats the same question, “And so of course you wouldn’t mind, JUST to confirm what you are saying is true.. if we search the vehicle?” I’ve been in sales all my life. That’s a highly crafted phrase meant to gain compliance and affirmation. The “of course”, and the “just” are minimizing phrases (it’s not a big deal), the “you wouldn’t mind” is a confusingly negatively oriented phrase (the citizen must either say “Yes, I mind”, and in order to say “No, I disagree”), and the entire structure, pacing, and overall delivery of the phrase is intended to receive a “Yes”. Ok but if they get mad that they can't search, they might decide to give you a ticket for what they pulled you over for instead of a warning. They shouldn't even be allowed to ask unless they back it up with an honest suspicion, because asking can feel like an order to a lot of ppl.

@@kenthurt6114 The officer wasn't allowed to search the car. So, he asked if it is ok to do so. It's up to the citizen if they want to waive their constitutional right or not. No rights were violated here. Had the officer said I will search your car now....then a right would have been violated.

There’s a big court case on this. Police officer asked in a way where they said yes to his question, but not to the search. To get over that, you should just say, I do not consent to any searches.

As much as I hate getting pulled over for petty things like tag light, crack in the windshield, air freshener on the rearview mirror, etc.. the reason they do it is to check and see if there's anything more serious. Stops like that often lead to the apprehension of criminals with warrants. This officer ran the drivers information and it all came back clean which is obviously why they didn't bother with a narcotics dog and they let him off with a warning. That interaction went perfectly in my opinion. They were respectful to each other and nothing escalated

@@raymondkisner9240 I agree. They often use confusing compound questions like, you don't have drugs in your car? so you don't mind if I search it then? It's like do you say yes or no to that? Neither. Say, I do not consent to searches. And always remember, anything you say CAN and WILL be used against you, but meanwhile you can't even call on what THEY said to YOU because it would be dismissed in court as hearsay. You are very aware, this was just to add on to why your words were so important for others. Speaking to police can only hurt you it can NEVER help you.

For an attorney he sure answered a lot more questions than I would have. I get being polite to avoid unnecessarily pissing off the cop, but seriously, what does sharing my destination do to help my situation. And why would he ask you to roll the passenger window down other than to argu a crosswind carried the smell of alcohol or weed, just to try to gain access to search the vehicle. “No thank you officer, I’ll leave my window up.”

You wouldn’t believe how many times cops have busted dealers with a huge stash of meth and coke in their car all because of a minor traffic infraction like a tail light out or tag lights shining into following traffic. This cop did nothing wrong. He was just doing his job. They are supposed to be suspicious of everybody. That’s how they catch the dealers who sell their poison in your community. You should appreciate that.

borndead4420 Better to get the drug dog. Because it’s easier to argue in court that it was an illegal search vs you giving consent. And you never really know what’s in your car to risk it. Maybe your mechanic, friend, the valet driver or anyone could have accidentally dropped something in your car.

I had a cop pull me up here in New Zealand a few years ago about 10pm. walked up to my open window and said there are only three reasons you would be out this late at night , your either going to a party, coming from a party or going home from work. made me speak into the breathalyzer and when It came back negative said have a good evening and walked back tihis car. I thought wtf. He basically wanted to know where id been and was going.

This was a big deal two years ago when I lived in Florida, the license plate frame thing. Everyone who fought it in court won. Police depts. were warned it would invalidate the rest of the stop.

Several years ago I had just gone through a Florida Turnpike toll gate when I was almost immediately pulled over by a Trooper. He played the license plate frame game. Didn't ask to search my car so I'm not sure why he stopped me.

You can not get pulled over for just that reason. Having a license plate cover is not probable cause to pull someone over. However, if the officer can articulate that the reason for the stop was something other like not using a turn signal, speeding, or illegal turn, then yes you may get a ticket and yes he can write you a ticket for an obscured license plate. Most courts will dismiss this ticket and tell you to get rid of the frame. If you are concerned about getting pulled over, download the vehicle code regulations in your state.

How much more evidence would the cop find of an illegal license plate surround by searching the vehicle? (None!) He had ZERO reasonable suspicion for there to be a weapon in the car. I was pulled over on my way north from Florida. They asked me the usual jokey questions like "do you have a bazooka or any other weapon", I said no and they asked to look. I said no and they revealed the real reason for the stop. Said they wanted to do a drug search. I said no and they made me wait while they brought a dog. I wasn't "under arrest" but I wasn't free to leave, which makes no sense to me. They then proceeded to let the dog into my car where it promptly scratched the shit out of my leather seats. The dog didn't alert so I was then free to go with damaged upholstery. My crime was being in my late 20s with a nice Porsche.

"so after i'm done, if i ask to search the vehicle to verify what you said is true, you don't mind?" the framing of that question is so deceptive. a reasonably nervous person might accidentally answer "no" to that question, just based on how it was framed. the citizen hears "search the vehicle" and their immediate response is "no", but in this case, answering "no" to his question would actually equate to "yes, you may search my vehicle". it's a very dirty game

@@wes788411 If he would've answered 'no' to that question, he is effectively saying 'no, I don't mind [you searching my car]', which can be interpreted as consent. Again, if you are nervous you might accidentally answer "no" to the question without understanding the exact wording. Think of how you'd answer these yes/no questions versus what you meant by the answer: "Do you mind?" vs. "Can I?"

C. A. You are 100% correct. Consent to search can be revoked at anytime. If the officers have not found anything for a probable cause search at that point, they must immediately stop the search or they are violating your 4th amendment rights.

Then they see if anything is suspicious or if there is any evidence of further activity. Your ignorant notion that police plant things on a regular basis, is quite delusional. These types of stops also provide a deterant for various other crimes. At least he is being proactive and not reactive in trying to make the area more safe.

I remember as a kid in my tiny Kentucky town riding my go karts, moped, four wheelers all over town and the sheriff waving as I went by and would yell “do A wheelie”! Changed so much as even a teen the local PD would pull me over on a damn moped on back streets and demand they search my backpack bc it was suspicious I was traveling in a completely legal moped 🏍 at 6pm lol it’s gotten out of control. The tiniest traffic infraction can turn into a fishing expedition real fast.

I have even tried to buy property where the owners only wanted (large amounts) of cash and I simply said, "No thanks, If I get pulled over with $15k in cash the cops will assume I'm a drug dealer and confiscate my money with zero legal options for me to get it back. I'll gladly get you a cashiers check or money order though."

I love the " suspicious behavior" excuse. Cop pulled me over so I asked what wrong. He says he pulled me over for suspicious behavior. I asked if I can get a ticket for that. Stunned the cop, dumb enough to ask what for. Told him I wanted him to explain to a judge how dropping off items to a non profit is suspicious behavior. Then comes the I need to search your vehicle. I said yes you can once you call your supervisor, they call the DA, they call a judge and you get a warrant. Then he says this would take time. I'm not busy and after you've done all that to search my car and find nothing it's a waste of your time and my taxes. Very distinctly told me to get the hell out of there.

My ma is afraid of cops, one was standing at her door when I was there, yelling about a tenant that didn't live there anymore. I walked over and slammed the door in his face and explained her constitutional rights to her. That asshole dented the fick out of my door with his flash light, but that was it. 30 years ago I was stopped by a cop near Chicago while driving cross-country. He claimed I was speeding, but the real charge was, “White boy driving with a hot black chick”. He approached on my girlfriend’s side and tried to open the garage door opener that was clipped to the visor. I think he was looking for drugs. I said, “Careful. You’ll open my garage door in L.A.” This embarrassed him enough that he let us go. These videos have taught me that it was a merit less search. Thank you!

Just say no to every "request" for search. Start suing car dealerships for putting illegal tag frames on cars. That leads people to assume they are not illegal, then get tickets. I take them off because I'm not getting paid by the dealer to provide advertising.

Tag covers are only illegal IF they obstruct the view of required visible info. Usually the tag expiration ‘month sticker’ is what they are referring to. Always make sure your tag light bulbs are both working.. I’ve never heard ‘they are shining back’ (that sounds like bs)

Good job by both the officer and the driver. It's the officers job to enforce the law (no matter how small the infraction is). It's also the driver's job to be aware of the driving laws (and be aware of his Constitutional rights). Overall, it was a pleasant interaction, and the officer just gave him a warning to fix the issues that warranted the stop.

With that one opening sentence, you have proven, beyond any shadow of a doubt, that your opinion on this matter is utterly worthless, because that video is a perfect example of what NOT to do during a traffic stop, for BOTH SIDES. It's not the officer's job to trample on the rights of citizens so that he can fill a ticket quota for the day. You didn't notice how even after the driver refused the search, the scumbag cop still wouldn't take "no" for an answer and tried social engineering the driver to get him to comply? It's not the driver's job to help police with any investigation. The police are not your friends. They can, and will, use anything you say against you. The prisons of this country are FULL of idiots who answered every question the cops asked them and are now paying the price for it, when all they had to do was simply STFU and they'd be watching TV on their own couch, at home, at this very moment. I was reading a story yesterday about an idiot who opened his stupid mouth and went to prison for it. The cops had a search warrant for drugs for his house, but because several people were living there, the cops had no proof the drugs they found were his. But because he was the only person there at the time, and he didn't want to get busted for the drugs, he thought he'd be better off if he admitted that a weapon they found was his. Note that the cops didn't know the gun was his, and they had no evidence that it was. Well, the cops couldn't bust him for the drugs as they weren't in his possession, but they sure as fuck could bust him on the weapons charge TO WHICH HE ADMITTED, for which he then went to prison. All because he ignored the best piece of advice in the world for anyone who is having an interaction with police... DO NOT ANSWER QUESTIONS! Instead, he opened his stupid, dumbass mouth, and went to prison for it. The lawyer in the video should have followed the exact same advice he gives to all of his clients... DO NOT ANSWER QUESTIONS!

Being from Central Florida (Orlando, Daytona, Cocoa Beach, etc)I’d venture to say the only reason they didn’t bring in a K-9 when he refused was because he played the lawyer card. I’ve been asked to consent to a search 3 times and refused 3 times. I’ll let you guess how many times they called in a K-9 to do a “non-invasive preliminary search” (I think that’s how one officer referred to it). If you guessed a dog was called in 3 times, you win! Out of those 3 times, they said the dog got a hit 2 times and proceeded to search my car since they now had “probable cause” - nothing was ever found but I guess there’s no crime occurring here in Central Florida since every time this has happened it takes around 2 hours between the initial stop, waiting for a K-9 unit to arrive on scene, and then the walk around/search. Gotta love the overzealous power tripping cops - and for the record, I’ve had interactions with great officers as well, unfortunately it’s just a roll of the dice.
