It's hard to assess how powerful Zelena is nowadays. I mean, as a mere baby, she saved her adoptive parents from a tree falling. Later on, she was given an amulet that amplified her power. Presumably, when the amujlet was removed, her power was reduced again but by how much? Based on the letter Rumple wrote to Cora, Zelena is more powerful than Cora, and Cora was able to shield herself from the Dark Curse. So either Zelena got weaker or Regina got stronger.

Except that (1) Zelena as she was (and to an extent still is) would not have been a positive influence on the baby; either the baby would have grown up as a villain or the kid would have had serious psychological issues due to Zelena being an overprotective, demanding, smothering mother; and (2) the baby was just as much Robin's as it was Zelena's, and seeing that she was unfit to be a mother (and had a distinct criminal record even just in the time between the second curse and this time), Robin had full rights to withdraw his support of her and basically divorce her. Any custody judge who knew his stuff would have denied Zelena custody.
