I know this isn't the point, but exactly how does one contribute to an inheritance? If you contribute, it's not an inheritance, it's just your business.

​@adamb89 pretty easy to see how an employee of a family business could contribute to it without equity, or how kids could contribute to their parents financial security without equity by paying bills or so on. They could help with a remodel, financially or with labor, they could do a million things to improve the financial standing of the family. Op mostly means unproductive people arguing over productive people's assets, there is virtually unlimited ways one could help improve the financial situation of their elderly parents without retaining equity. These done seem to he those types though.

Sounds like this was a plot set up by the mother (the victims brother). She spoiled her raggedy kid, stole her brother’s inheritance for her raggedy child and then allowed her raggedy child to kill her brother so they could keep the money. The daughter didn’t even need to be there. She was not needed to sign anything

But it wasn't that clear cut. At least, it wasn't clear that it was murder. The prosecution agreed to go for manslaughter because they realized that there was some weakness to the case against Tucker for murder.

@@SY-ok2dq It was pretty clearly murder. concealed weapon that she was practice firing earlier, shot at a man who wasnt being threatening at all, with financial incentive for murder, but it's not clear? I don't know how people can arrive at this conclusion, including Dr Grande here. What else would need to be involved to lock this down? It's so cut and dry it's ridiculous. Let's forget for a moment that it was a defenseless little damsel who did this, and not forget (whether admissible or not) that she has a history of trying to stitch people up for criminal acts that they didnt commit. I think any reasonable person sees that she planned this, and then shot a defenseless person in order to inherit money.

@makavelismith As I said, the prosecution went for manslaughter. They wouldn't have done that if they were fairly confident of getting a conviction for murder. And the trial results bear that out. Prosecutors are not in the game to lose. It wasn't cut and dried as you seem to think. I've forgotten the exact details now but there were things which the defense could have used to convince a jury of reasonable doubt or to split them on a murder charge. The prosecution was aware of this and in order to secure a win rather than rolling the dice, they went down to manslaughter. Practicing firing a gun doesn't show specific intent to murder someone. Obviously people who have guns will have practiced firing them at some point. Her past history might have been difficult to get admitted as evidence. I'm not sure about the particulars of that but I've seen American cases where judges wouldn't allow that kind of evidence as prejudicial and not directly relevant to the case.

​@@dylandice4638 Kelly, Shane's sister amd the one in the will, was not responsible for the shooting and I guess there was no evidence that Kelly planned or aided in the shooting as a premeditated act. Even if Tucker had been found guilty, unless they could pin anything on Kelly, she would receive the inheritance.

Typical cut of from contact his own mom, by women that play emotions. They would have won anyway, because he was the bad boy. I was cut out when my mom died of cancer by my sister on welfare.Because she told her she takes hormone therapy to get an Grandchild, but she didn't know shit about the Therapy. Usually I agree with your findings, but in the case, I do think she was guilty of murder. Why would a pistol be needed at a will signing? She obviously went prepared to shoot him when you consider, she had practice shots in the morning, reloaded her weapon prior to the meeting, forgot her ID but remembered the pistol, immediately started filming with the intention of capturing behaviour suitable for self defence….but in the absence of that behaviour, opened fire anyway.

When I lived in Oregon I was in an Open Carry County. Most people did not carry it seemed more for the benefit (?) of business operators dealing with the public at night. There were several though that liked to strut around like roosters, proudly displaying their insecurity & false bravado. I used to openly laugh at their displays (& quite nearly got shot for it several times) Greed, Insecurity and/or Alcohol combined with firearms will always make the morning news

I know it's not funny, but I am amused at the fact that Tucker got charged with having heroin while her mom claimed that her brother (mom's brother) was manufacturing meth and that is part of her reason for being fine with him being shot. I live in Oregon and sadly, this is typical behavior for many families, especially the rural ones. Edit to add: I do believe she was guilty of murder. She knew how to use the gun, she knew how to aim the gun, she chose to shoot her uncle so her and her mother could get the house when grandma dies. Her mom had already proven she was sneaky and underhanded, I believe her daughter would act in the same manner. Just my opinion, but its an opinion based on experience with families who act this way.

I work in the Crow/Applegate/Lorane area and can tell you the sheriffs don't even show up when you call about a trespassed drug addict threatening people. They claim to note down the incident but no one comes to deal with anything. Edited for spelling

I believe that she murdered him, thinking that the legal precedent between them would protect her. She belongs in prison for a much longer time. She appears to be highly immature and irrational. This was all driven by greed over money that neither heir had any part in earning. Neither of them really worked, or seemed to be admirable in any way, but it appears that Shane alone was fair-minded about the inheritance, which is why he was killed, IMO. Always be leery of people like Kelly, who mismanage their own finances. Generally, they would love to get their hands on your wealth, to squander it also.

I could go on, but it would take too long to list all the activists that believed and followed through with their cause. It’s just unfair to lump them into a corner because of what one might believe an activist is. Most are good people with a good soul and their beliefs extended beyond politics, which is what I detected as an undertow to your comment.

I’m glad I don’t live in Oregon, it’s a gorgeous state but I’ve heard to many examples of the police waiting until after a death or serious crime. I guess I understand in remote area’s but in other state’s they still try their best to get on scene to hopefully stop and get the family members ( in this case) or other’s separated to cool thing’s down. Having shot a firearm earlier and then having it hidden under a towel or napkin on the table is highly suspicious.

..and as an addendum, Tucker filed a malpractice lawsuit against her attorney alleging he messed up her defense and tricked her into accepting a bad plea deal. The lawsuit was thrown out.

@@GSPfan2112 exactly! Who attends a meeting arranged by your son/brother/uncle and don’t even allow him to partake in the meeting her arranged. His plan to divide the family assets 50/50 (of what was left after his sister already took a lump) was fair, providing his mother agreed it - which we can assume she did seeings as she permitted the meetings to take place on her home. Killed because your greedy sister wanted even more!

Regardless of what they might have thought about Shane, he had a right to an inheritance. Only his parents had the authority to deny him of that. The theme Dr. Grande presented about people doing things half-way seems really appropriate for a crime in southern Oregon. It's easy to find a mechanic to work on your car in Grants Pass, but almost impossible to find one who will actually fix it. So it doesn't surprise me that the local police didn't want to get involved in a domestic confrontation, even though that's their job.

I remember first hearing about this case and feeling a massive miscarriage of justice. Listening again now I feel the same. These women were manipulative, the police failed her uncle, and she should be behind bars for murder.

There was no question about guilt, and no need for a plea bargain. Firing a weapon to "scare" someone is a fairly certain conviction. Firing a weapon at someone or to scare someone is a crime unless there is a reasonable fear of death or grave bodily harm. But the prosecution can argue that if the shooter is in fear of death or severe harm they aren't going to fire a warning shot.

If I were a jurist on this trial I would have voted to convict Tucker of murder in the first degree. She had a hidden revolver, she brought it to the door, the door was opened, she raised her weapon with her finger on the trigger and should pulled it using considerable force with intention of shooting at her Uncle who was in close range. Her history is of an unstable young woman who exaggerated aspects in her life for her benefit. She had previously shot the revolver that morning, she knew it could be lethal and she had known her Uncle would be there for the signing of the paperwork. Her release from prison is a travesty of Justice.

I feel Ike if the family is awaiting a tense situation and a handgun is brought out, it’s bound to be used. If the gun was in a case and locked away, Tucker COULD have time to lock the door and yell, “I’m getting my gun’l and he would have known to leave. Tucker had financial loss if the notary had signed the deed. I think she should have been charged with 1st degree.

Wow. I know this exact type. Once you encounter one of these people, you'll never forget. I suffered the same false accusation that she made, and after losing against me in court, my accuser followed my family and I down the street screaming "pure evil" at the top of her lungs. I know that folks on YT don't like to diagnose from a distance, but if she really does match up with the person I experienced, I wonder if her diagnosis might share a word with a very early Madonna song. And I don't mean Lucky Star.

Sounds to me like it could have been a set up in order to assure a quick deed was never signed. If the lawyer could enter the video in defense, it looks to me like the prosecutor could have gotten a warrant to look at what else was on the phone. The tell is that she did fire the weapon that morning and reloaded. She was getting ready for something.

If Shane has children they could file a civil case for wrongful death and most probably win the whole house plus damages. The standard for a civil case is lower than a criminal one: instead of beyond reasonable doubt, the plaintiffs only need to show on the balance of probabilities. On such a standard, I believe it would be relatively easy to demonstrate Tucker is liable af.

I think the mother is a POS. Mooching off the grandmother, Lori, refusing to work, allowing her daughter to get sucked into drama that had nothing to do with her. Grown-folks business, as my family says. Tucker should have been told to stay in her lane, but the mother was so greedy that she probably used Tucker to guilt the grandma into mortgaging the house.
