Scotland’s First Minister has insisted he is “very proud” of new hate crimes laws which have just come into force, as author JK Rowling warned the legislation is “wide open to abuse”.
The Harry Potter author, who has become a fierce critic of the Scottish Government’s stance on transgender rights, has been one of the highest profile critics of the legislation.
The Hate Crime and Public Order (Scotland) Act came into effect on Monday, consolidating existing hate crime legislation and creating a new offence of stirring up hatred against protected characteristics.
However, women have not been given protection under the law, with the Scottish Government instead promising to bring forward legislation to tackle misogyny.

My view is that "free speech" should not be invoked to justify "hate speech", where this is defined as actively promoting or endorsing harm to any group in society. So, for example, it is perfectly fine under free speech to claim that a trans woman is really just "a bloke in a dress". However, if you start saying that trans people should be beaten up or even killed, then that is hate speech and should be illegal.

Had an eye appointment checkup at Vision Express today. I had to fill out a questionnaire before I was examined. The first question was gender. Three options, male, female, other. What's that about? I assume I just committed a hate crime?

I agree with you that truth and opinion are not hate. However, actively endorsing or promoting harm to any group in society is hate. Hypothetical question: would you defend a pedo who tried to justify grooming on the basis of "freedom of speech"?

@@Julie.2024 Fair enough, but given that "freedom of speech" cannot be absolute, why is it "draconian" to apply it to hate speech? I don't see anything to suggest that the law will be applied to trivial cases. What's the big deal if it is applied to cases of active promotion or endorsement of harm to groups like Muslims or trans people? Surely that is appropriate? The "in your own home" thing is getting a lot of criticism, but you can't groom a child in your own home either, or commit assault, rape or murder, or plan a riot, etc., etc. There are lots of things that are illegal to do in your own home.

@stephenthorpe3591 I do not disagree at all with your views. There are many areas where hate crime needs addressed. One is disability hate crime. This is already implemented through iammescotland with Police Scotland. I was initially involved with this. You're going off on another tangent. This new law is about inciting hate crimes 😒. Everyone should be able to have the freedom of their own domain. Right or wrong things will be said in private that wouldn't be socially, I expect. Don't think any of us exempt from that. Does it mean we need to be put on a non crime register? That's what I mean about draconian. The services have no time for serious crime issues, yet to date, there's allegedly been thousands of reports since this new law come into fruition! It's damming and going to stretch an already overstretched police force.

I see these laws as just a broad way to censor speech because the terms used are meaningless. "Hate" can be literally anything you set it as. Someone swearing at you? Someone saying they don't like you? Someone criticising the government? An extremely dangerous and foolish precedent is being set with these laws.

Nah! Language is always vague to some extent. If the law is enforced sensibly (and there is no real reason to think it won't be), then hate speech will be prosecuted only when it involves a significant level of endorsement and promotion of harm to a group in society, such as Muslims or trans people. Calling a trans woman "a bloke in a dress" should be fine, but threatening to beat them up because thay are trans is not fine!

@@AdamantLightLP I trust any government not to try to enforce a law beyond the resources of their law enforcement and judicial systems. Besides, it is not all that arbitrary. Hate seems to be being defined as whatever any reasonable person would consider to be of malicious intent (=intent to cause or promote harm to any group in society). That should be workable. Easy to avoid trouble by just refraining from mouthing off about Muslims, trans people, etc. Think of it metaphorically as a speed limit.
