Hello ,Thank u a lot for your sharing ,I overstayed my f1 visa for 6 months in 2017 ,and I went back to China after that ,I wonder if am eligible to pass anotherB2 travel Visa or F1 student Visa interview due to my previous story of overstaying?

+Marco Antonio Lopez Garcia They do have the discretion of cancelling a visa if they believe you are inadmissible to the U.S. The officer can claim that because you overstayed in Canada, you may be deemed to no longer be eligible for the B-2 because you are going to overstay here. While the argument is stretched, there is little travelers can do while they are at the airport. However, if they did cancel it, they must notate that the visa is cancelled in the passport. If there is no notation, then it might not have been revoked.

Please i need answer to this.I entered usa in may 2017 ,i was allowed to stay untill 21 november 2017.I applied for extension if visa priir to i 94 expired.My case was pending for 11 months ,i waited for answer in usa and got deniel and was given 33 days to leave usa.Should i have any issues in renewal my visa

In 2001 I got B1/ B2 visa. I entered US and applied for extension. Thus I stayed there for 12 months which was the limit after the extension and returned. Will this be considered overstayed? Later I Tried for H1 and was approved in US but denied in 2003. Later I got call from US embassy and to reapply to get my H1. But they denied asking the documents of other employees in US. Now after 15 yrs. as my parents r in US and my father is sick, after 2 major brain surgeries in US. I applied for visa along with my daughter (17yrs,) but denied in March 2018. My brother is a US citizen and my parents are green card holders. We have here agricultural lands, house and educational institutes under partnership of my husband. How to show these details in DS-160 form? How can I sow that I gave strong ties in India? This time I will apply alone will this be helpful? Can I say that I want to bring my parents back to India? My father's travelling may be quite difficult. But we can try it. My intention is to see my father along with my daughter for about 1.5 months and return. If I will get visa then my daughter will try separately. Will this be a good idea? Can I say that I want to bring back my parents to India, which can be tried but I am not sure. Kindly guide me. Is my earlier extension for 12 months and my parents and brothers status affecting my visa? She just asked me about the purpose of my trip. Later other question was " why was my H1 denied?" I replied but she denied my H1 without asking any further questions. Kindly guide me how can I get my visitor visa this time as my intention is to see my father who is very sick,

Hi, if in 2007 visa was cancelled with 5 years of penalty out of the USA, is a waiver needed to apply for another visa now in 2016? Thanks in advance.

On a visa given by U.S. Embassy. What is Annotation 212 (SMALL D) (A) WAIVER OF 212 (A)(6)(C)(1) GRANTED on a visa??? Is there something to worry about at the airport?

Hi. I overstayed in the US after arriving there as a child and then returned to my home country on my own a month after turning 19 to be able to continue with higher education. I applied for the tourist visa just recently and got it approved (been at my home country now for 4+ years). Will I still have issues when arriving at the US with immigration even though the visa was approved? I intend to visit friends for no longer then a couple of weeks... Thanks for the info.

When you applied for the tourist visa, did you admit that you overstayed before? Did the immigration officer know that you overstayed? If they didn’t know this information and gave you the visa, then there’s still a chance that you could be denied entry at the border if the officers realize that you overstayed before. Technically, because you overstayed for over 1 year after you turned 18, you are subject to the 10 year bar. We need more information to assess your scenario. Yes, the officer knew that I overstayed. I told him everything and in fact they told me they could not give it to me at that moment. He said he would file an appeal... 6 months later I got a call from the embassy asking me to bring my passport...so I did and they gave it to me.

***** IF this is the case, then you should not have additional issues at the port of entry. You may be asked about it at entry and if you are, you should be honest and tell the officer that your informed the officer at the consulate about the previous overstay and that they gave you the visa after a six-month wait. this is exactly my case except i left at 10 months after turning 18. i am now married to a dutch citizen and i am a permanent resident of the netherlands but i want to go to the states with my husband on vacation so i will be applying in 3 weeks but i am absolutely terrified that my overstay as a child will mean i will vet denied

Sir I have a extension pending on b1/b2 visa. How long can I stay. While it’s pending. It’s taking 12 to 15 months for extension can I stay as long as my extension is pending .. initial i-94 was valid till 4-27-18 ..

You should apply to renew your passport now. If your H-1B petition is not adjudicated by the time your passport expires, USCIS may send an RFE requesting a copy of your new, valid passport. You should have it ready in case they inquire.

I'm Canadian, so if I'm visiting the USA by walking across the border, and I intended to stay for 4 days but I ended up staying 5 days what would happen?

Canadian visitors are generally admitted for up to 180 days or 6 months, unless the period of stay is specifically shortened by the CBP officer at the port of entry. As long as you have not intentionally or willfully lied or made false statements to an immigration officer, staying 1 extra day for a planned trip should not be a problem.

Buying a house in the U.S. does not afford any legal status in the U.S. If you are entering the U.S. as a visitor, you are subject to all limitations on those entering the U.S. with the B-1/B-2 visa or on Visa Waiver. Each time you enter, the CBP officer can and will examine how much time you are spending in the U.S. and how much time you are spending abroad. If the CBP officer thinks you are spending too much time in the U.S. or not enough time in your home country, he or she can deny you entry and/or cancel your B-1/B-2 visa.

My sister got 2 years visa, at the point of entry, 6 month was approved for him but her has been in US going to 2 years, but now he want to returned to her country, what is consequences and would she going to have issue at airport?

She should have no issues in leaving the U.S. Your sister should understand that her visa is cancelled and she cannot use it anymore even if it is valid. You can try to apply, but the Consulate may deny the visa stating that you have “immigrant intent” as your son is a US citizen and can petition an immigrant visa (green card) for you.

You should have him file for you as he’s already over 21 given the years you mention. Also it’s been way more than 10 years so any ban you would have had has long been up. I definitely think it’s worth applying for a visa now if you haven’t already.

If you left the U.S. after overstaying for more than 3 years, your B-1/B-2 visa is no longer valid and was automatically voided when you overstayed. Additionally, you are subject to the 10-year bar. It means you cannot return to the U.S. for at least 10 years because you accrued over 365 days of unlawful presence (which began when your I-94 expired).

I'm from the U.K and overstayed a visa waiver in 2010 by 7 months. My husband is a U.S citizen and I just want to visit him for 2 weeks as can't emigrate yet, with my child sitting exams here in the U.K. He stayed here in the U.K on a spousal visa for 2 years but had to return to the U.S for work. If my current application for ESTA is denied what can I do? I have a return flight booked in 3 weeks time to Michigan. Thanks I am in total panic!

Technically, in this situation, you are required to apply for a B-2 visa at the U.S. Consulate and cannot use Visa Waiver. I suggest you take with you sufficient evidence to show that you are will not remain in the U.S. and will return to the U.K.

I have 5 years us visa 2014-2019the security on the airport gave me 6 month and than i should leave us but I didn't leave the country on the exact date and i overstayed 10 extra month so i remained in usa for a year and 6 month totall time, my question sir what if i tried to return to usa now will i be able to enter the country if I booked a ticket next month , ibleft usa last January..Please i hope you reply thank you so much !

If anyone overstayed in the US for five years and comes back his own country with his own wish, and after staying three years in his own country, he do apply again for US visa after expiring his privious one visa, and embassy do not give him visa and put the bar of 10 years, ...........the question is--- when his time will start of 10 years bar....from the time when I-94 was expired or when embassy put the bar of 10 years...........and one more question, if he apply for Canada tourist visa, then this US overstay will effect to that case....and can he apply for visa waiver overstay for US

You should count the 10-year bar from the day after you left the U.S. Applying for a Canadian tourist visa should be feasible, but if they come to know that you overstayed in the U.S., they may deny the visa. You can apply for the waiver, although it is difficult to obtain, especially if you are simply applying for a tourist visa.

If you were actually removed or deported from the U.S., you may need a waiver to be able to come back to the U.S. You should consult with an immigration attorney.

Once you enter the U.S., your J-1 visa does not dictate your ability to stay or work in the U.S. It’s the DS-2019. Was your DS-2019 extended? Did you have a valid DS-2019 when you were working? If so, you did not overstay. If your DS-2019 was not extended (which could have been very easy for the school to do), you did not only overstay but you participated in unauthorized employment. The US Consulate has the authority to deny your visa application if they think you will do it again. I am a permanent resident planning to apply for US citizenship. My relative is asking me to write a formal invitation letter to US consulate in support for her to obtain a visitor visa. I am afraid it might affect me, when I apply for citizenship if she overstays her visa. Any suggestions?

You are not “banned” from the US if you only overstayed for 1 month. However, if you entered the US with the B-1/B-2 visa, you are no longer allowed to use it and will need to get a new visa before you can come to the US as a visitor again.
