This is the with how warrants are granted and executed. You have government agencies who are presenting possibly misleading, incomplete, or even false "evidence" to a court without the ability for the defendant to respond. It becomes especially problematic in situations like this where the damage from the process of the warrant can't be undone, and Mark had no ability to defend himself or correct any error made unintentionally. I mean, do we we really need warrants like this in situations where violent crime or major felonies aren't involved?

I think you completely misunderstood what I was saying. Your insurance company or the hospital’s insurance company can then otherwise handle the rest. If you wanna be a doctor and don’t wanna go to school, that’s fine too that when laws would take some effect. You simply have to inform your clients. Also obviously no insurance company would cover you so you’d be outa business darn quick or not all as the state could require persons practicing medics obtain insurance.

Texas does this. My friend bought a row house in Texas that had just been built. Shortly after they moved in, the foundation cracked under several of the houses. The builders said that if they had to fix it, they would go bankrupt. When the homeowners went to sue the builders to fix the foundation, they found out that the builders lied about having insurance that would cover such things. Now how were these builders able to lie? The government office that was supposed to verify that builders had the proper insurance wasn't funded, so many of the builders in that county simply lied about having insurance because it was cheaper. My friend ended up loosing $70,000 because of those foundation issues.

In Queensland Australia we have the national parks and wildlife service which is a government department and unfortunately public funded, they are like the Gestapo in their dealings with the general public, if a licensed professional kangaroo shooter gets caught with a animal on his processing vehicle that is half a kilogram under the minimum weight he is threatened with court action and is fined heavily but then they blanket stamp so called mitigation permits for landowners that they never check on, the landholder can use calibers less than the mandated amount with not a single check ever done, if you hit one on the highway and it’s injured it’s your responsibility to so called help the animal but if it’s broken beyond help and you pull out a firearm and euthanase it you are committing a crime under the animal cruelty act and also a firearms offence, so in our country the educated idiots are well represented.

While living in NYS, my dog (as a puppy) caught and killed a squirrel before he was old enough to have his rabies shot. I took him to the vet the next day, asking about the possibility of rabies. The vet's response was: squirrels don't generally carry or transmit rabies. They are too small. If they get infected, they usually don't survive the transmission (being bit by a larger animal). The likelihood my dog would get rabies from that was almost zero, but to watch the puppy for a week and see if his behavior changed. The answer wasn't to immediately kill the dog...crazy, right? Makes you wonder why they had to kill the squirrel to see if it had rabies rather than watch them for a time.

Yep, the CDC's literature says "People might worry about rabies in animals that don’t often carry the virus, like opossums or squirrels. But these animals hardly ever have rabies." There has not been a single known case of a human contracting rabies from a squirrel in all of recorded history. And as you noted for your puppy, testing the brain is not the only way to test for rabies. Merely holding/watching the animal for 7 days will answer that question without any harm to it.

With humans involved, it's a little different. Typically, the animal suspicious of rabies is put in a 10 day quarantine, and the human involved is IMMEDIATELY put into treatment (shots, pills, medical observation etc) just in case. Killing the animal almost never happens, especially when it comes to pets. About none of the things mentioned above happened at all so I call BS on them even being concerned to begin with. They killed them to kill them.

I got the rabies vaccine when I was rescuing and rehabbing wildlife; and never once did I encounter an animal with rabies.

Or how about the fact they said "several plain clothed" agents were also there... Hmmmm, no number given, but the report says there were 3 clothed agents, and 3 biologists... who wants to take bets there were 4 to 6 plain clothed agents there? And the head of the agency didn't know what was going on? They have "several" agents doing a raid on a well-known target, and she wasn't aware? It's the same process used to get an indictment or to convince the public to give up their rights. You give as little detail and truth as possible in order to make it appear completely justifiable. There are people that keep illegal wildlife and it has created problems in the past which is the reason for the law. I caught a squirrel when I was 16. Asked a vet if there was a threat of rabies, and they said squirrels will almost never, like 0.01% chance, have rabies because if they come in contact with a rabid animal, it's going to kill a squirrel outright.

This! Firstly, they're incredibly elusive. Second, they don't tend to survive the attack. Rabid animal or not. Predators just kill and eat them,so there wouldn't be a squirel left to have rabies and as you mentioned, an attack from a rabid animal is going to destroy that things tiny bone structure.

I live in MO. As a kid squirrel babies blew into our backyard. My father was mowing and couldn’t kill them. We put them in an incubator my father bought. Rosco lived. We fed him with a dropper bottle. He was kinda wild to be honest but a squirrel. He would sit on your shoulder, give you kisses and if you handled him too strong he’d bite your ass. He was a great pet to us kids. Loved that squirrel.

You are right about the biting. They fight with each other A LOT, so if they view you as a a fellow squirrel they WILL bite you, but they aren't really dangerous.

We do have some unique pets around here. When I worked at Bass Pro, I saw pet monkeys, raccoons, lemurs, birds, and things I didn't even know the names of. In the Knife Shop, we had a squirrel named Earl holding a Swiss Army knife carved into the post leading into the sharpening booth.

I had a striped squirrel named "Dicker" which loosely translated into "Fatso" from german. ( HE WAS kinda fat...) Yes, it was 50 years ago when you could still use words. No one complained that we had a pet squirrel. Even had a tiny little black mouse named "Goliath". No one had rabies. Though I do froth at the mouth at the idiocracy going on today.

Heck they could have talked to him and used the entire thing for a actual PR coup. Waive the fine for some good publicity and a video on the topic of how to register such animals and why you should. You now look like you are legitimately trying to do good and seem reasonable to the average person. True its unlikely to have had a massive effect but just being seen as somewhat reasonable would have done a lot to help their image as most DEC's and other similar bodies are seen as at best as evil.

While we're asking questions, I have one from personal experience. When the DEC contacted Mark in January, did they bother to tell him what he needed to do and, more importantly, HOW to jump through all the hoops? I was trying to help a friend get a boat registered because the former owner had never bothered to do so. It took me days of looking through terrible government websites to even figure out which department to contact, then when I did, once by phone and once by email, I was given two DIFFERENT answers on which forms to fill out and where to file them. The older and grumpier I get, the more I realize: no matter how much you hate the government, you don't hate it enough.

Did the "bit" officer get full rabies vaccine schedule? Cause he's due his 6 week follow up. By NY state law he's a rabies vector the entire time unless he wants to isolate. Was he put on medical isolation leave or continued working (FOIA PEOPLE TIME CARDS), in accordance with NY state FOIA laws, was this a communicable disease of public interest like RABIES (literally in the statutes) for why Medical Privacy isn't a factor? My point is the problem with shoving your BS into the rules is eventually they snap. "Just following orders isn't a defense" forgets who ordered it to happen

I live in Missouri a 1/4 mile from the local creek where the locals swim and catch fish, I was down there catching crawfish and teaching some of the local kids about them before releasing them a few minutes later. The Missouri department of conservation showed up and asked if I had a fishing license, I said I don’t at this time as it had expired. They were ready to write me a ticket for catching crawfish, as a veteran and a human I don’t take well to stupid threats from someone that doesn’t know what was going on. I noticed he didn’t say anything about the out of town people that where throwing there trash on the ground right in front of them. I asked him about it and he placed his hand on the grip of his service rifle. I said write me a ticket for catching crawfish even though I don’t have a single one in my possession and I’ll make sure every local parent here reports that you felt the need to use your service rifle to write a ticket to someone that is teaching the local kids about the ecosystem they live in. He was about to say something where the local sheriff showed up and started asking him about the issues. The Conversation officer left after. I’m well known in the town I live in and loved by many as I have been in trouble “legally” a couple of times for threatening a couple chomo’s and smacking one around a bit that was at the park. It’s sad that in this world they are more worried about people trying to do good things and handle it poorly.

I hope this makes it to the Supreme Court, and I sincerely hope the Supreme Court dissolves the NY DEC completely. It is, as Justice Gorsuch has said, *the* definition of government overreach and has on countless occasions massively exceeded both its mandate and the natural limits of state government; in so doing, it has impeded the functions of other essential services and private enterprise.

Absolutely, and do not stop with the NY DEC... you need paperwork at your local town hall to put a ceiling fan in your own home in New York (really the whole tri-state area.) Government needs a HUGE downsize.

1 - There is NO record of squirrels transmitting rabies. ENCON should've known this. 2 - Both animals were indoor pets, with no exposure to rabies.
