Holidays and Other Leaves have become very controversial in India. Also, there is tremendous difference between govt and Non-Govt. Mostly these issues are misinterpreted, misguided and on other hand lot of exploitation happen. Total human rights violation. Employers and bichholiyad are enjoying all privileges.

It depends on your company whether you earned leaves can be encashed or not, at my previous organization, earned leaves could be encashed, but at my new company, we cannot encashed the remaining leaves

Hi My company at Maharashtra as per Factory act gives 3 CL 2 SL for 1 year and 1 PL for every 20 days net work attended (days work attended i.e. other than Holiday and any type of leave like CL, SL, PL, Holiday and Week Off ). It further says that No CL and SL days benefit will be given for Probation period (during 6 months probation period an employee neither will be allowed nor will be given CL and SL for probation period). Kindly advise if company is right.

Sir, I work in a company based in India. It handles the operations of another company based in the US. My shift timings are EST and I work Monday-Friday. Saturday and Sunday are off. But we do not have a concept of CL and PL in the company (the one based in India) on whose payroll I am on. We just get 15 leaves a year, i.e., 1.25 leaves per month on pro rata basis. These leaves do not get carried forward to next year. We cannot encash them either. The unused leaves simply lapse once the financial year ends. We work on all Indian National holidays. We get one holiday on Ganesh Chathurthi and one holiday on Diwali. Apart from that, we are off only 5-6 US federal holidays. I am not sure if these leaves and holidays are fair as the HR is not at all helpful. Please advise.

52+52+15+8= 127 Minus 365 days -127 holidays=238 less than 240 days your getting more leaves compare to other companies in india

@@zomoto9577 What is 8 for in your calculation? I feel there are a lot of companies in my city who have full weekend off and more than 30 PL & CL and all major Indian holidays plus state-wise holidays. That's a lot more than what I get.

If an employee worked in a factory for 260 days then he is applicable for EL. Means he earns 13 leaves or after 240 days 1 leave for the 260 working days. Which is correct?

Hii Rishabh and Mandeep, Actually I have a question. My employer did not updated me throughout the employment that all leaves will be lapsed at the end of contract. Now they are refusing to encash the remaining leaves. I would like to understand what our law says on such a scenario. Thanks and Regards, Mahesh

As my own practice in Personnel office i like to say about it if he have any Balance leave that time his half leave is deducted but if he didn't have any balance leave that time it assumed as half day absence careful this half day absence will be calculate in yearly absencisum list

Dear Madam/Sir, please share laws applicable for Election Voting leave policy. My employer is not giving leave for this. In my home town. Election/ voting is on 14th Feb 2022 in Uttar Pradesh. Please confirm, Leave for election will be WITH WAGES OR WITHOUT WAGES. OR WE HAVE TO TAKE IT FROM OUR CL, SL, OR PL.

I have a question, Is it mandatory to work 7 days in a work compensatory leave?? Means i have weekend on Sunday, and in that week i have worked on Sunday. But took a leave on Tuesday in the same week. So my company is saying that you will not get a Compensatory leave since i have not work for 7 days.

Boss i recently join an mining company ABC but under the contract of XYZ i didn't sign anything yet bu i wile hiring the Tod me you have to work 12 hrs 2 day shift, 2 night shift & 2 off it was a good deal so I joined on 23 MAY; as a new joining he told me to come in morning from 9 to 6 8 hours but yesterday he told me to come from 8 to 8 i was ok with it but today he told me you have to come on Sunday i was like ? in my brain didn't say anything to him. I told him my setuation and he was not satisfied from my answer what should I do

My company insisted every employee to sign declaration that he will not join any competitor company for a period of 3 years. This declaration they are asking once again at the time of exit and neither giving full and final nor reliving letter. I have already served full 3 months notice period.

Hi sir can you tell me how many years Earned Leave can be carried forward. For example I have worked for 25 years in manufacturing unit as manager and have not availed a single Earned Leave so am I eligible for the entire 25 years Earned Leave. Awaiting for your positive response.

I am forest guard and in our department we are treated as on duty for all holidays . We only get casual, medical and earned leave and no festival or sundays . Is is right? Please guide Please guide

Sir mai ntpc me 3rd party working hu. Ntpc hamara client h and Hitachi hamari company jisne ki innovsource ko hamara payroll de rkha h. Hamari leave as per payroll company 23.75 h but client not provided. Ntpc and Hitachi hmse 6 days 9 hour per day work krwati h and 12 leave per year deti h. Please btai hm kya kr skte h esme. And after office sun bhi whatsaap group pe kaam krne ko bol dete h subah night kbhi bhi. Please koi help nhi krta hamari na hamari kuch sunte h kahte h nhi kr skte to job chor do.

Sir ji maine LIC me 19.07.89 se 10.07.89 as a temporary Assistant yani total 81 din kam kiya hai.mujhe terminate kar diya gaya tha. Mananiy Supreme Court ne decision diya hai ki jo workmen class -3 me 85 din work kiya hai use absorption kiya jay. To sir mai keval 81 din work kiya hai.to kya mere workdays me Earn leave PL etc. Judega. Please sir reply dene ki mahan kripa karen. Ram Samujh Pal Allahabad se.

Sir ji mai LIC me temporary employee as an assistant ke pad per 81 din kary kiya hai 1989 me. Hum logon ka absorption Supreme Court dwara order hai. jisme 85 din kary hona hai. Kya mujhe EL,Cl,PL etc mere kary diwas me judega. 85 din ki awasykta hai.lekin mera 82 din hi hai. please sir kya mai elegible hun.

Sir ham #EFSfacultyPvtLtd. ki taraf se ek telecom company me as a Gard Kam karte hai. Ham do bande 12-12 ghante Kam karte hai. Koi weekly of nahi Eran leave nahi.. chhutti aaps me adjust kar ke kam karte hai.. Aja Maine chhutti Li to kal mai do shift karungaa.. Salary slip par bas CL Balance dikhaya jata hai... Kya hame job chodne ke baad company Eran leave ka benifit milenge.
