They have their retirement. My first thought was if they can pay you back slowly over time, they could easily refund their retirement. Since they got the money by fraud, lied about what the funds would be used for, you owe them nothing. This isn’t just about money, it is about theft.

Sueing the brother is rather pointless, and only adds to the costs. Not only since he's a do-no-good with no significant income, but more importantly, since he wasn't involved in the fraud - neither did he deceive OP, nor did he even know about it all. Sure, he actually benefitted from it, but he didn't know about the money's origin. Thus, the only way to get anything from him is his promise to pay back "as he can" (like, in ~750 rates, stretched over roughly 80 years). Sueing the parents WILL work out. Given they're close to retirement, they probably own the place they live in - if they can't muster the money from their savings, they'll be forced to take a loan on their house/flat/whatever they live in, max their credit line, sell valuables. OP should be aware though that she'll probably ruin them; they can't affort mere 15k from their savings, and a law suit of this sort will come with court fees and 2x attourney tariffs (since they are bound to lose, they'll have to pay it all. And my colleagues are good at milking money). Ontop, "fraud" is a criminal offense - even without OP to press charges to criminal court, the public prosecutor's office would usually take over and indict them. That'd lead to at the very least an extra fine, in worst case jail time. [if she's fine with that, all power to her. Not as if her parents wouldn't deserve punishment. She should be aware though that children in almost every country have to pay support for their needy parents. Such a move could thus fire back on her since her brother is barely able to support himself - thus he wouldn't be of much help at alimenting their parents.]
