You can still object to something the judge has ruled on but to object on each and every one of the judges ruling and then to present the same exact argument that she already denied during each witness testimony is just a way for them to draw out the process. The judge caught on to it pretty quickly. If you’re going to object and make the same exact argument that you had already made you can just say continuing objection instead of literally repeating everything you said when she ruled on the objecting earlier.

As a juror in the murder trial I was in, 6 of us (jurors) sent a letter to the judge and requested this very thing. They kept removing us from the courtroom for every sidebar and we were losing our train of thought, which could lead to a mistrial. The judge agreed with us and our assessment. He questioned each of us if we can provide a fair and unbiased decision with all the side bars and the easy answer was "No". The judge was not irritated with us, but he was irritated with the prosecution and defense.

I agree with the judge. 15 minute sidebars are ridiculous. Thus judge has a duty to move this case along and also making sure due process is protected and let's face it the victims rights is a joke compared to the defendants rights in this country so I'm glad she made this ruling. I believe she made sure nothing would jeopardize any appeals before she decided this. Their objections are still heard but she doesn't want the 15 minute sidebars that are exactly the same every single objection on these videos. It's ridiculous and it's a way for these defense attorneys to milk taxpayers. GOOD CALL JUDGE!!!!

@@scottburns2600 the way our system works, the prosecutor tries to crucify the defendant while the defense attorney puts forward the best defense they can muster. In a horrific case like this it can make the public defender look immoral, but they just as well could've been assigned to a case where their client was being railroaded with excessive charges, or completely innocent but the easiest target. It's the nature of the beast.

I'm not against the death penalty here, but consider that in the year 2000, Florida was spending $51 MILLION per YEAR to keep the death penalty active in the state, compared to what would be saved if all death sentences were commuted to life without parole (and LWOP became the only penalty for 1st degree murder). Capital punishment in the US isn't cheap.

Depends what you mean by “as many times as necessary”. Showing the same photo or video more than once is cumulative and prejudicial to the defendant. Once a piece of evidence is published, the jury has access to it during deliberations. If they want to rewatch it, they can ask the judge to let them.

The trick of this is that the jury is to decide based upon the evidence whether or not this is a death penalty case, in most cases when a defendant pleads guilty he or she is given life, because they have admitted their guilt. If it were up to me based on the facts, the evidence, and his demeanor following the act and following his arrest, I’d vote for the death penalty. He knew what he was doing, I don’t see any evidence of insanity, I see no remorse. He has only shown remorse since his arrest due to the fact that he did not get away with it.

It may be the case that Florida appellate courts require that the basis for the objection be laid out as well. Some states have appellate courts that would say “well you objected These 4 times but the 5th Time you didn’t specify what the objection was so that objection was Never Made.” I think his lawyers are just trying to be thorough and do what they can. Cruz is gonna spend the rest of his life in prison or he’ll be killed regardless so I think it best That the process just plays itself out. Now, however, the Defense May well say the trial court denied them the ability to make objections.

The defense attorneys are doing their jobs preserving the record for an appeal. In any trial, if an objection is not made during a trial, it cannot be used on appeal. It is called "preserving the record". It should also be stated, Cruz has pleaded guilty. This phase of the trial is all about punishment: life imprisonment or the death penalty. This discussion outside the presence of the jury shows that the defense attorneys have already conceded Cruz is more likely getting the death penalty. The defense attorneys are preserving the record. While tedious, it is their job.

I like this judge but she's a little too accommodating. In my opinion she needs to be more aggressive and more strict and in control of her courtroom. She shouldn't be going back and forth with the defense she should say that's enough and that's it the next time you do it you'll be held in contempt.

It's taken 4 years most likely because of his lawyers filing every motion possible to draw it out. Basically he's getting his money's worth out of his representation. Also, it kept getting delayed because of COVID.

It’s not a trial, it’s a penalty phase. He is guilty of the crime, but the jury is being presented evidence to prove motive, intent, premeditation, etc. in order to determine the eligibility of death penalty or life in prison. Once the penalty phase is over, there will be a sentencing phase. Then we will likely never hear or see him again.

The prior phase is called the "guilt phase" and he already pleaded guilty to 1st degree murder charges (1st degree requires intent and premeditation). The penalty phase focuses on the severity of what he did and the aggravating factors. For example, the fact that chased wounded students and killed them. The fact that he showed no remorse after murdered students and went to buy cherry soda.

I think the Judge and the lawyers have to be careful in order to not give grounds for appeal. If the Judge does not allow the defense attorneys to do their best at representing him, that could be grounds to appeal after this trial is over.

No matter what happens in the case. This case will see probably a minimum of 12 appeal hearings. It's extremely expensive to conduct death sentences. Just get rid of death sentences and give him life. We can spend the next 60 years asking him question and figuring out why he did it, and learn how to spot it. (This is how the FBI got good at profiling serial killers, by talking to the ones locked-up.)

Sure, just drag out the inevitable for as long as you can, all the while having the victims and families be dragged along with it. The POS is guilty. He admits he is guilty. Sentence him, lock him away forever and be done with it. None of this BS in trying to find loop holes to postpone or even to declare a mistrial. What a waste of time and money for someone who doesn't deserve the oxygen he breathes.

Honestly, when you're on camera killing someone or multiple people and your trial is nationally televised because it's so high profile and gruesome, you don't have a mistrial coming. In fact, you're actually being railroaded and made an example of. Deservedly so. Cruz nor Chauvin deserve any sympathy. They both killed someone on camera. It's an open/shut case. Even you a person who probably thinks Chauvin did nothing, could prosecute either of these cases. Both of them are guilty as sin. Chauvin deserves to be in prison and Cruz deserves the death penalty.

This is why I decided not to go to law school after getting my degree (even though I took courses that were basically pre-law). When you are an attorney it is your job, obligation, to represent your client to the best of your ability, personal feelings aside. A client could tell you “I’m guilty” in private but if you see a loophole or chance to cast reasonable doubt it’s your job to do so personal feelings aside. Attorney Client privilege is a double edge sword at times. I could not bring myself to imagining I had to represent someone I knew to be guilty or prosecute someone I thought to be innocent simply because it was my job and thus I knew I couldn’t do that job effectively. I can only imagine what his defense team is going through. They’re doing their best knowing he’s the worst

If a defense attorney sees the mountain of evidence against his/her accused criminal client, he/she can withdraw from representing his/her client to preserve his moral integrity and respect of the victims for future reference. He/she can let someone else represent the client.

intervention would have needed to start in preschool in order to save that poor kid, no love in his life, and the world is full of them! Seriously, if I had a child in school now I would get them a bullet proof vest, but as long as they have outdoor recess, it doesn't matter if they keep the doors locked, it's not rocket science, any monster with an AR 15 would find it easy. You don’t need a sidebar for every objection. With the example “Objection, relevance,” Judge can instruct the jury to disregard a certain component of the testimony - or that, “sustained,” in general, nullifies the question or testimony.

I don’t know the law so I premise my thoughts on that. It sounded like they are allowed to object! They are allowed to say put on the record we object. What she is doing, I believe, is not having a sidebar on all the objections. She has ruled. So they can object! Is this correct? Are you all saying it should be allied to argue each objection at sidebar?

This was my take on it too. They weren't objecting and having their objections on the record, everytime they had an issue or thought an issue could come up, they would call a sidebar and they'd go thru the same stuff for 15 min, even if she already ruled on it, even if it hadn't happened and they thought it might happen. So they were just basically wasting everyones time. Like the prosecutors said, they can object and explain why, and if she overrules that objection, when the problem comes up later, they can stand up and say something like "continuing objection" so that its on the record.

Clearly you only see ONE SIDE. IF YOU were the defendant in a criminal matter, WOULDN'T YOU want YOUR DEFENSE TEAM doing anything and everything they can on your behalf????? I applaud the Defense Attorneys for having the courage to CONTINUE to DEFEND a person who has already pled GUILTY. They could easily do nothing BUT THEY DON'T. They continue to be as unbiased as they can and to DEFEND their "client". I cannot imagine how difficult it must be for a Defense Attorney to DEFEND someone in this situation. I cannot imagine the Defense Attorneys wish to see a killer walking the streets again, but it IS THERE JOB to defend their client. In the end, Justice will prevail.
