Some might also say it’s FLORIDAS tax money because they still use income tax - that state is a rarity - furthermore a life conviction is life in Florida - not 10 years not 15, no parole, it’s done it’s LIFE in that state. The retirees who paid into the system and move to Florida know this and from how the state preserved the crime scene it sounds like they knew it has to be this way. If you’re not from Florida it’s irrelevant, technically.

It’s that he’s plead guilty to all charges. The Prosecution wasn’t going to let a case of this news magnitude to rest until the public heard all the evidence for why this kid became a mass murderer. Maybe some of it is our desire to understand why these mass shootings have become so common; or maybe better, they simply wanted the political capital of being “the people who put away Nick Cruz.” This is the second part of a trail that’s usually short because little more is heard & only decide what sentence to give the criminal…but since he pled guilty they are using this as a full on guilt or innocence prosecution.

The defense attorney has been trying to get off of this trial since the beginning she has asked to be taken off of this case and the judge said no. And to be fair from the beginning of the trial the judge has treated the defense side a completely different way from the prosecuting side

I watched the full video and the defense wanted to submit a boatload of evidence and then pick and choose what they wanted to show the jury. The judge asked them to determine what documents they didn't want to show and the defense said they didn't know. The judge then asked how was she supposed to rule on what is admissible or not if they don't know what they are going to show the jury.

The defense lawyers are doing their job to make sure the court is not biased to whether he gets life in prison or death. That’s still important.

I can't believe the attorney does not stand to address the judge. I'm a paralegal and I've never seen this occur in a courtroom. Lawyers are usually required to show respect to the court by standing when making arguments. This judge runs a very lax court.

Agreed. Particularly if you are addressing the court and requesting a mistrial for your client. The lack of decorum in the mistrial request from the defense does weaken their argument that the court and/or jury is not able to provide justice to the defendant. Treating a mistrial request with such a lackadaisical attitude makes it seem like its more of an informal request rather than a major accusation that the trial is unable to proceed with the defendant's right to fair judgement intact.

I understand where you're coming from, but whether or not he's a monster doesn't mean he doesn't have a constitutional right to this trial in order to potentially avoid the death penalty, just like everyone else. I am in NO WAY supporting him, but sentencing trials are just as crucial to serious crimes like this as the actual trial held determining guilt. With that being said, his defense is grasping at straws and it's not a good look, even if its their job to defend him. Their unprofessionalism during this process has been wild to witness.

If you think about it from the defenses POV, it’s really not that bad. They have careers to grow and uphold. Being a case that is aired live to this magnitude is imperative that they show that they will do anything for their client so that they can give a fair trial for all parties. I agree with you! You can tell by her shaking voice that she's nervous, and probably realizes she's walking a very thin line. I don't think the judge has shown unfair prejudice. The defense, although doing their job, has been the side asking repeatedly for a mistrial. The other day she threatened to withdraw from the case because the judge threatened to hold her in contempt! I realize they have to do everything in their power to keep their client alive, but she has been extremely argumentative in my opinion. She's very snarky, and when she makes snide comments directly to the state, it's extremely unprofessional. From very early on, she has made it clear that she doesn't like the judge, although I think the feeling is mutual. But when you're rude to the court, and go against their orders, that's what you get!

A cynic might conclude that he has been on his best behaviour for the benefit of the jury and the judge in order not to display behaviour in court that may lead the jury to conclude that he is out of control, or cannot control his impulses.

I’m not impressed with Judge Scherer’s attitude throughout this whole process. From her tone of voice, hand motions, to the choice of her words, she has been snapping and scolding at people in the court, as if she were talking to her children in a classroom; her short temper makes no discrimination everyone gets scolded in that courtroom. I think that she is unprofessional and not experienced enough to be a judge over such a monumental trial. I bet the defender finds grounds for an appeal post-trial.

I believe judge Scherer used to be assistant to state attorney in Broward county under Mike Satz. Mike Satz is the lead prosecutor. She is the daughter of a republican lawyer who supported Gov. Rick Scott and it was him who appointed her judge in 2012.

The internals already knew that it's a straight life sentence. I think this is done purposely to torture the perpetrator disclosing everything publicly. Everybody must know where are the big failures of our society. We must amend them in many fronts, otherwise we will be here seeing more crazy kids doing baboonery like the one seen in Parkland. We all agree that this will not be the first case or the last case on the matter. I'm dead sure we will see thousands of these cases in the future. It's a lesson that requires at least 50 years to be learned.

I believe in due process and being entitled to a vigorous defense. I believe in our system though far from perfect. At this point it’s just an exercise in suffering. We get it. EVERYONE has had it tough to one extent or another. It’s already starting to get way out of hand with the neighbor wanting to do a “movie”

I told you that's exactly what they were trying to do. They purposely kept playing games in order to cause a mistrial. It was very evident during the entire trial and they should lose their license to practice. He's already said he wanted the families to decide his fate anyway and either way they want him to fry.

Thats why the judge should rule and avoid grounds for an appeal. She is showing biased and grounds for unfair trial. Remember this is not whether he is guilty or not is whether he will "rot in jail" as you desire or death. Ruling on this does makes a difference in strategy. You can have a german decent or a jew in the jury and the state alleges they may bring it up in rebuttal. It can make an effect in the decision one way or another but unfairly. Anyways, this is one of the few motions I give the defendant been right. And the judge is opening grounds for appeal.

Sounds like the defense isn't happy that it's likely going to be the death penalty for him. He's ready for either option, but the defense attorneys don't like the death penalty, thinks it's 'cruel and inhumane punishment'.

I live in the UK but met a similar issue to this as a juror here... We spent 2 weeks going through a case in detail, which we were then dismissed from because we were "accidentally" shown evidence which the court had agreed we would not see... I lost my respect for the judicial system that day... The defence here is claiming that they promised to be honest with the jury? ... If so, and justice is the intention of a trial, the jury should be shown ALL evidence!!! ... these symbols were there, on his gun, so hiding them with tape is denying the jury the ability to make a decision based on all the facts, in favour of a skewed version of the facts to suit one side or the other. A shorter version of the defence speech here could have been achieved by declaring, "We call for a mistrial because the jury have seen the truth and it could be devastating to our case!" ... It makes me sick.

That's not how "evidence" works. For example, lets say you are accused of stealing a car and its not true, but your accuser wants to introduce into "evidence" how you took pens from the office, how you have anger issues because you scream at your mom, and that you cheated on your girlfriend. NONE are evidence that you stole a car. It just speaks ill of your character and creates a bias on the jury. Hence, a court will find all of it inadmissible to guarantee you a fair trial. This is the issue with the swastika. Right now the defense argues it can create an unfair bias because his motives were not against jews, so they are waiting for the court to rule on it. If the court decides its relevant, the defense strategy would be different than the current one, hence the bias from the court and the huge opening for appeal.

@@323azteca Yes, and I totally understand and agree with everything you said in your first paragraph, because the "evidence" being introduced is not directly involved with the van theft ... In the case of Cruz however, the gun used in the murders had symbols on it which have been concealed after the fact by the court. They are not preventing additional, unrelated and unfair information to be brought to the Jury, they are removing something from the evidence which was brought to the scene by Cruz himself, in order to influence the decision of the Jury. I know how it works, my point was that it's not true justice.

Besides that, this was related to the location of the crime, considering that he drew these things on his backpack and in school notebooks that he used _in school_ ...therefore it coincided with the crime he committed -also at _school_ it was 100%, relevant, and that's why her claim was dismissed as it should've been. They bit their own noses by even trying to withhold that evidence.

I totally disagree. The defense team has asked to be taken off of this case several times and the judge is making them to find somebody they do not want to. Whether that’s because they don’t want to defend somebody that can make their law firm look bad or they just don’t want to defend somebody because I don’t feel it’s in their best interest. The judge has forced them to can you imagine defending somebody you do not want to and asking seven times to no longer defend them and the judge is making you do something you don’t feel is in your best interest as an attorney or your law firm’s best interest? Whatever impact fetal alcohol had on him (which is contested in terms of severity)... Let's not forget; (1) The level of preparation and planning went through. (2) His Internet searches about cops response time to mass shootings, and the tactics they use to stop mass shooters. (3)Picking up the most perfect time to do it (at the end of school hours when fences are unlocked). (4) His creative lies to elude suspicions (the bag he was carrying was for his music class, basically an instrument). (5) The documentaries he watched about school shootings. (6)The effort to elude capture by commingling with students and (7) The fact that unlike Columbian, Virginia Tech, Sandy Hook and Uvalde, Nick had a desire to live and didn't commit suicide. These all indicts to me that he willingly, intelligently and happily did it for fame. . The most sever punishment is reserved for the most sever crimes. Death penalty is warranted. When will it be carried? I don't know and I don't care. But it's will outrageous that he doesn't deserve it. The message it sends to school shooters wannabes is dangerous. It may encourage them to do it and gain delusional sympathy of commenters on YT.

Whatever happens from here on out is irrelevant. The defense has strong grounds for approval and will easily be granted a retrial. It doesn't matter if the judge says they can't have one. Nor does the jury's decision matter as well. Her assignment to the Nikolas Cruz case was made randomly by a computer program that didn’t consider experience or the fact that no U.S. mass shooting of this magnitude had ever made it to court. Every decision Scherer makes is being scrutinized, at least partly, through the lens of how she was assigned and her inexperience -, particularly compared to the case’s seasoned prosecutors and defense attorneys. Shortly after the shootings, when she was unavailable, the defense asked another judge for an emergency order, which he granted. Scherer overruled him and ordered that all matters except search warrants would be heard only by her. She blasted two Sun Sentinel reporters for publishing a sealed Cruz educational record that they obtained *legally* . She threatened to tell the paper what it could and couldn’t print, but never did. That would have been unconstitutional, lawyers said. A highly trained judge would likely have done better - i.e., kept their composure, avoided obvious mistakes, and given the defense fewer grounds for appeal.

She's an idiot. Sorry Celeste but she is. This is not woman bashing. Compared to judge Peggy in the Depp/Heard trial, she is awful. She's biased, incompetent, combative, rude, and to put it bluntly stupid. She argued that there are "jewish stars" next to the schwastikas. This is her argument for why she just made the ruling that she had been asked to make at 35 different court appearances. She said they were "jewish stars". The star she was looking at had five points surrounded by a circle. Also known as a pentagram which is a satan worshiping symbol. It wasn't a "jewish star" or to anybody who has ever been exposed to even the tiniest amount of Jewish culture could tell you it's called the star of David. Just like Christians refer to the lowercase "t" as a cross or crucifix.

The purpose of this trial is to examine every shred of evidence that pertains to the person, Nicholas Cruz. Court cases have to be thoroughly investigated so that 10 or 15 years from now, a small minute shred of evidence can be used to overthrow his conviction and he walks and is able to resume his life as a killer. It does not matter what we want to happen. In the News, throughout history, convictions are over turned. My Uncle was shot by my cousin's son, oldest son, Brandon, my uncle's grandson. He was distraught about the cruel words my Uncle had said to my cousin's other son, Preston, in the months leading up to the death of my Uncle. B/c tiny shreds of evidence revealed that Brandon had not received a fair and unbiased trial. Nevertheless, Brandon was a murderer but now walks free to get on with his life. Everything has to be revealed. It takes time to reveal every aspect of a trial. In the impulse of Nicolas Cruz to kill those kids and lose his freedom, he most likely never considered the length of the trial, day in and day out for over 3 weeks, plus. Every action a person takes has consequences. I think that is one of lessons I have noticed here. Also, why kill some one else's kids no matter how bad you "feel" about yourself, it is just not worth it. Their lives did not hinge on the circumstances of his own life: violence, prostitution, drugs, alcohol, etc. Those other kids were not involved in his life except at this intersection point. He should have resisted his urge to blame others.

Imagine a person murdering innocent children and having racist imagery all over their personal things, and wanting to omit those facts. I think because the defense is showing that they Repeatedly asked it to be decided on before they selected jury that it was decided after it hurt their Ability to Select the best Jury possible. It’s a really good case, so far I think it’s the only Motion that has a chance to overturn any decision that happens.

A death penalty verdict would be re-affirmed at the appellate court level bud. Florida’s appellate state courts are stacked with conservative judges (who are generally pro-death penalty).

The defense had an avenue to have it heard before the trial but chose not to use it. There is a specific motion that could have been filed to force the hearing if it was so important to their defense. It's called Mandamis. They didn't do it for whatever reason but now want to cry mistrial.

This defense lawyers have literally asked to be taken off of this case several times and the judge has denied every single time. At that point as a defense attorney you are legally obliged to represent your client to the highest ability that is within their legal rights if you do not do that you can end up being sued or a new trial can come back. Because this is televised I’m pretty sure that they’re trying every way that they can to make sure that they represent him to his fullest legal rights. Please stop and think that they have asked to be taken off of this case

I fully acknowledge my ignorance on US law, I'm British, but it seems to me that the defence intentionally left a gap as far as the swastika motions in order to use it as a basis for a mistrial. Is that possible or am I misunderstanding? Genuine question. Ps. If so, I'm not necessarily criticising the defense, I'm just trying to make sense out of what I'm hearing.

It's as the judge said. They have the right to rebuttal which is why they covered them on the gun. The defense is opening the door for the state to address the swastikas so that's just their poor defense in general. The defense is horrible she should stand to talk to judge and not talk to other counsel that's respectful and how court works.

Whether it was intentional or not is conjecture. Maybe it was. Or, maybe the defense is blaming the court for the flaws in their strategy. Maybe it's just a desperate shot at the moon in an attempt to find glory in a case where there isn't any. Whatever they were thinking, the judge's job is to consider the merit of the argument, and here she found it to be disingenuous. She stopped short of accusing the defense of sabotaging the whole case, for what it's worth. However, the way the judge denied the motion seems to indicate that regardless of their intent, leaving that gap was a costly mistake strategically.

I see many comments that the judge has an attitude, is a "mean girl," should be reported, and on. Yes, she got fired up but she has a pitchy-type voice, making it sound worse. Factually I saw nothing inappropriate except of course, the dang attorneys addressing each other directly which btw, is TOTALLY bad form! The Depp attorney wouldn't allow that for a sec & was equally as stern, just w/ a quieter approach. I'm quite certain that if a male judge clapped back or was tired of the BS, comments would be more like, "Wow! Good for him. He's tough!" In fact I've seen male judges bite heads off & comments WERE exactly that. The consequences for this judge to get this right are HUGE & she knows it. It's also a very loooong trial. I really think we need to offer some grace & certainly not let the death of her be her tone of voice or a dirty look here and there. Right?

This is such a fun game for the shooter. Anyone notice at 10:17 how someone handed a brief to the lawyer beside him, she flips it upside down, he keeps trying to look at it and then swats his hand. In my opinion, the defense should’ve worked at getting his to accept the death penalty. People like this are making a mockery by showing how many rights they have. Perhaps when you kill so many people, you forfeit your right to this circus.
