Medyo nahihirapan po kasi ako sa OBLICON Cristal obliged himself to construct a rip-rap wall along the west-side of kevin’s property in order to prevent further soil erosion. it was agreed that the measurements are 5 meters deep and 400 meters long to cover the whole wet portion of the property.What are the remedies of cristal?

Ma'am I just want to know the difference of Art. 1165 in Art. 1221. Nalilito po ako kasi sa Art. 1165 if the damage is caused by fortuitous event, without the fault of debtor he is still liable to the creditor. But in Art. 1221 if the cause of damage or loss is due to fortuitous event without the fault of the debtor, then there is no liability or the obligation is extinguished. Di ko po magets or mali lang yung understanding ko.

Hi po, Ang sinasabi SA art. 1165 is UNG instances na kung sana, Hindi maeextinguish UNG obligation ni debtor kahit pa may fortuitous event. If guilty ka NG delay, fraud or negligence or contravene SA tenor chuchu, liable ka pa rin kahit pa may fortuitous event.
