Ish is Right on paper. But Joe is right in the sense that most companies paying the amount hes paying wont modify the contract & the clauses in place are non-negotiable. So essentially Ish's only recourse is to ask for more money cuz that part of the contract can be modified but not the legal bylaws in place to protect the business. Agree with ish 100% on the contract. Joe could walk in tomorrow and say Spotify offered me a solo show deal making 100 million dollars. They would have to eat it and go back to their previous lives. If they made sacrifices, turned down gigs or quit jobs to be here, there should be compensation. The co host have more to lose than Joe does. We've already seen that all it takes is 2 more people who can talk to keep the ball rolling for joe.

The difference between this job and other high paying jobs is if I’m a great lawyer and get fired another firm will higher me and probably pay me exactly what my previous firm did. Joe is doing everything right from a professional standpoint but by admitting the contracts aren’t binding because of the friendship he’s causing unnecessary confusion. They are both right, in some way. There should be an agreement on how much notice is required to quit/fire. Joe is correct as well, I’m paying you very well for something you knew nothing about, so you can either take less or agree to the terms. No one else would hire him with no experience and pay him what it seems like he’s getting paid there. The pay was good enough for him to cut back at his own business. Great POD ! Nothing protects him. Employers don't typically protect the employee in the event of a firing. That's what Unemployment Insurance is for. An employer might choose to offer a severance package of a couple months salary or something like that, but by no means is that the norm or an obligation.

@@WillieYams Following that parallel though, employees that lack all of those protections have the ability to quit when they want with the understanding that they'd be opting out of the few protections they may have been entitled to if they were fired instead. Budden can't have his cake and eat it too without getting this logical pushback from Ish.

@@OriginalBoondocksXVIII Not necessarily. It depends on their employment contract. An employer may require 2 weeks or some advance notice (that isn’t always just a courtesy). The employee may still choose to quit without notice but that breech may incur a penalty such as forfeiting a final paycheck or not being paid out sick days or annual leave, etc. The point I’m trying to make is this clause is nowhere near as unusual as people are trying to make it sound, and it’s not foul at all. Joe has the right and obligation to protect his business interests. Ish has the right to negotiate, to not sign, or to accept that risk. The dumbest part about this is that Ish said he was willing to take a reduced salary to have Joe leave that clause out; the reduction in his salary is likely to be equivalent to whatever penalty he might incur from breaching the clause.

What I saw in this debate was that JB wants his friends and fellow podcasters to feel trust in him,but it’s really a control thing.JB wants to control the narrative and be able to say how well and fair he was and not allow a legally binding agreement to hold him to an accountable situation that could occur.

Ice made the great point that there are employees making less with less responsibilities which makes them entry level. Not having prior experience does not make it entry level. Joe didn’t get that.

There’s CEO’s that have no prior experience in a specific industry, that get headhunted by Fortune 500 companies cause of what they’ve done In different areas. Literally 0 experience in that industry, and being CEO is as far as you can be from an entry level position in a business.
