The Inquiry, while being ran by a Judge, is not a court and must deliver its findings to the parliament. The police can start at any time but they must not interfere with the inquiry or jeopardise it. If they went out and made arrests now on someone who has not been before the inquiry yet that person won't say anything at the inquiry because they know they'll jeopardise their criminal trial. That's not quite how it works, but yes I agree in principle. The failure of PO Ltd to disclose documents which they knew would have assisted the defence, could certainly harm any prosecution case to the point where it is deemed unsafe. Perjury is a different offence.

Some thoughts here, the failure to disclose will be based on the advice of solicitors and barristers who at this time must be aware that they are at risk of being struck off by the SRA or other regulatory bodies. Failure to disclose exculpatory evidence or information is a crime and also full disclosure of unused material is also a crime as far as I can discern. As for the POL team in front of the select committee, this falls more squarely the realms of perjury as per erskinemay they are lay witnesses or witness of fact and are covered by the parliamentary oaths act 1871, the perjury act 1911. If the evidence given in parliament is given under oath then perjury attaches, if not given under oath then contempt of parliament attaches. This contempt is punishable by imprisonment for the life of the parliament so in this case a maximum of 5 years. The House of Lords has the additional powers to levy a fine. There is no statute of limitations for perjury in UK law. The law on the work product used to prepare for a committee hearing that is under oath would also be interesting as they are witnesses then any work product produced or methodology used and also all notes of meetings could be classed as work product and if it could be established that this work product was not retained then there is a possible that an offense of destruction of evidence is warranted.
