DETROIT (WXYZ) - The state told a Detroit man: Pay child support for a kid that is not yours or go to jail! On Friday, 7 Action News went with him as he turned himself in at the Frank Murphy Hall of Justice.
“I stayed up all night. Couldn’t sleep thinking about it,” said Carnell Alexander.
Carnell says no matter what the state orders, he won’t pay child support for a child he doesn’t know and that DNA tests prove isn’t his.
“I haven’t even had a chance to speak to him except for one time when we took a DNA test,” said Carnell.
This is a case that started in the late eighties. An ex-girlfriend of Carnell’s had a baby. She needed help providing for the child. She was told that in order to get welfare she had to name a dad on paperwork. She put down Carnell’s name.
The state then started a paternity case against Carnell to collect money for the assistance provided.
A process server turned in paperwork saying Carnell was given notice at a house in Highland Park. It is something the Michigan Department of Corrections says is impossible. At the time, Carnell was incarcerated for a crime he committed as a young man.
Carnell says he would find out about the paternity action in 1991 when he was arrested for being a deadbeat dad during a traffic stop.
He has been fighting it since.

Update: He finally won in 2016. I guess the story goes that the man was in prison and a woman used his name for the birth certificate to collect welfare. When a proof of paternity was sent to his old house he couldn't dispute it being that he was locked up.

Yeah, if a law leads to an unjust result, then what good is the law? Common law cases get overruled when they work injustice. Statutes need to be amended to do justice. The legislature is to blame here. Court have to follow the statutes. The Supreme Court should declare this unconstitutional as a violation of the 14th Amendment substantive due process clause. Laws have to be rationally related to a valid state interest. This law is not rational. It's punitive.

@@mikejames2756in the United States of America if a man's name is placed on the childs birth certificate, regardless if the child is biologically his or not, that man is financially obligated to that child and it's mother for 18 years and can be taken to court to pay for that child and whatever back pay that court feels fit. How much that man pays is determined by how much money he makes yearly. And the minimum amount a man has to pay varies from state-to-state. Also if the mother of said child collects government assistance, the state will go after the "father" with no remorse for reimbursement of that assistance. Oh and some states charge interest on late payments and can take your driver's license and incarcerate you for up to a year for not paying or not respecting the court order giving (example: ordered to pay on the 15th but you pay on the 17th). America is nice and has a lot of stuff, BUT, it's also a fucked up place to live.

Thankfully I threatened to take custody of the child from the woman and she went down and put someone else's name on the birth certificate. The state didn't even question her about changing the name. All they care about is having someone to go after for money regardless if you are the biological father or not.

I saw a story online that was similar. A guy who turned 19 was given money for his birthday. He spent the money on one of the ancestry dna tests. I think a few others in the family took it too. On the results it showed connection to relatives and he noticed that while his mom ws the correct % his dad was only half the % hes supposed to be. But his uncle was the % he asked his mom about it. Turned out she had an affair with her husbands brother. And that the man who he thought was his father was actually his uncle and vise versa. Needless to stay his family tore apart.

My girl and I are unmarried. We have a daughter. Not long after our daughter was born, my girl got notified she needed to fill out custody papers. I went with her. They asked if I should wait outside. She said no. She explained that I was the father, and I was supporting our family. They asked her if she wanted child support. She said no... and that I was supporting our family. They said "are you sure? You can still get child support.". They tried to talk her into it, and implied she might just be scared to accept because I was there. Right in front of me. For my daughter, who I was taking care of... I had no rights. I felt like, to them, I didn't matter. The system is crooked. I hope this man is doing well.

Nope. If you don't get custody, then it isn't your problem. Even IF you're an abuser. By the way, if they're convicted of domestic abuse, they will almost certainly have to pay the victim for that anyways. There's no need to charge child support on top of that. Whoever gets custody has the responsibility for the kid. Nobody else. If they're abused, they can sue.

I'm literally going through the same thing, however in my case I was married and my ex-wife got pregnant during our marriage, she lied to me saying I was the father. I signed the birth certificate under false pretenses, I divorced her, she took me to court for more child support, which violated our verbal agreement. I'd been paying her on time the weekly agreed upon child support for years that she asked me for, kept all my receipts & money orders, the judge told me because it wasn't established through the court, all my previous payments were considered gifts. The Judge said I was in arrears, they increased my child support payments, I got over that BS. Several years had passed, my son got injured, I flew in from another state to the Hospital where he was, I went to his room, he was sleeping, I picked up his patient chart and was instantly shocked. I called for the doctor, the doctor came in and I asked him was my son's chart correct? He said yes, and I said that's impossible because our blood types didn't match up. I'm O+, my ex-wife is A-, and my son is AB+, I have a master's degree in Biology, I knew there was NOWAY that I was the father at that point, I went out into the hall, the doctor followed trying to console me, I cried like a white woman, that truly cut me deep. I called his mother (my ex-wife) she denied having an affair, she said I was lying etc. We took a DNA test, the results came back a few weeks later, I witnessed it on paper this time "O% paternity. I went back to court to have my name removed from the birth certificate, and to have myself removed from paying child support. The judge told me that there was nothing they could do, because their state laws says that if a married woman conceives a child during the marriage that doesn't biologically belong to her husband, ONLY the husband can be recognized as that child's father, so until they change the law I'm financially responsible for him, he was seven years old then, he's now nineteen years old. My ex-wife wouldn't allow me to see him anymore, I literally went to court twice with two different father's rights attorney's, we lost both times, because of the loophole written in the law, which states that only the biological father can be granted custody rights UNLESS he signs over his rights to me. The father refused to do so, and he doesn't do anything for his child, however I beat the shit out of him, I broke his jaw in five places, I broke his arm and leg, I was enraged what else would you expect from me at that point. I typed all this to say, I know this man's pain, and frustration. The family court system is bullshit, they don't care about the child or the man in these situations, it's PRO government monetary interest & woman, no matter how fucked up she might be. I can talk about this now, because it no longer hurts.

This almost happened to me TWICE just because a couple of women wrote my name down on the birth certificates without my consent or knowledge. However, DNA tests exonerated me so I don't understand why the judge is trying to make this poor guy pay the money for a kid that isn't his. It seems like this judge is guilty of legal malpractice.

I feel like sometimes, there needs to be a judge that reviews the judgments of judges. So if some judge's logic is so out of whack they are personally responsible for poor judgments given. Because of biased gender or circumstances. The whole point of child support is paying for your child, the guy has literal proof the child isn't his. Judge still says you aren't going to jail "for now". Wtf.

We do they’re called appeals court judges. No one cares about this issue. The law was never created to help children. It’s only created to imprison specific people. If a man who doesn’t have money to pay child support is sent to jail for that how does sending him to jail help him pay child support after he’s released with a fresh criminal record and no one willing to hire him because of it? You need money from the dad so you put him in jail where he can’t earn any money. Yeah that makes sense.

I've been following this case and this man was instrumental in getting the law changed in his state. He and a few other men got together and took it all the way. That's how you get these laws changed " Get together" put it in the media and make it known to the public. The law obviously needs to be changed. So many stories of this happening to men including when the woman cheats. There is one where the man was being cheated on by the woman, she put his name down on the form and they were married under the pretense that the child was his. The woman cheated on him throughout the entire marriage and he still has to pay for child support for a child that's not his..... I'd rather go to jail cuz that is some flagrant bullshit.

The same thing happened to me. I was in the Navy stationed in Hawaii when child support notified me I was delinquent with child support even though I had no children. Turns out an ex put my name on her child's birth certificate. But when the DNA test came back negative the case was dropped.
