I lived on grapevine road in West linn. The police there are hyper policing. Especially near the jiffy lube and chevron, close to the on ramp to 205. I know exactly where this is. There's no reasonable way to navigate with only a right turn. It's a huge waste of time.

Stupid that they changed a 4 way stop into a right turn only. Chael, you're absolutely right! If I was the owner of the McDonald's or the gas station, I would be pissed! Directing traffic away from my business. The "right turn only" makes no sense. If they're going to change from a 4 way stop for "safety and traffic" purposes, then they should've put in one of those "roundabouts" that are popping up everywhere. Then traffic isn't forced away from the businesses. As far as your ticket, you have a valid argument. But I don't think it will work "because he's seeing the back of the sign." His argument and the court's argument will be that that's the officer's "beat" and he drives it all day long. He knows the speed limits, signs, etc. of his assigned area. Good luck though!! Judge should dismiss it just for the simple fact that you're Chael P!!!

For clarification: if the ticket was specifically for jumping a curb, then you can definitely fight it and win. However, if your argument is the officer “didn’t see the sign” so he can’t issue you for it, you’re going to lose

Why? I’m not disagreeing with you by the way I’m asking why. If the claim is that, I ignored a visible lawful posted sign it would seem that the officer would have to be able to testify that there was a visible lawful posted sign. From his vantage point, that simply would not be possible. Ticket is based on assumption An assumption by definition creates reasonable doubt.

@BadGuyInc I'm taking it that the officer didn't get a photograph of the area including the sign, so the evidence would be in doubt, even though you saw it (the sign) prior to deciding what you're gonna do. A decent prosecutor would ask, what did you see? Was there any graffiti? Was it legible? Did you understand what the sign indicated... Good luck 👍

So you get where I’m going with this? So even though he technically “didn’t see the sign” at that moment. He already knew it was there from past experience

Damn Chael you will definitely win this in court and you might even have a case to sue the officer and the city for loss of your valuable time. I mean 10min on KZbin makes you money, 10min on ESPN, of Fox Sports, 10min in the Octagon, etc. Figure up the most valuable 10min of your life and say That's how much they owe you for the traffic stop alone, then say, how much longer you going to keep me here at court? Would the technicality of the officer not having been able to see the sign have changed if he went back together with you right after the violation to take a shared look at the sign (i.e. to prove that he was right in his assumption)? Difference to the hearsay-story would be that the "cause" for the violation was still in effect. Reg to "jump the curb" it would be interesting if a traffic officer is allowed to use the expression in the broad slang sense of "making a (non-specific) mistake while driving". Anyhow, all the best!

I'm pretty sure this won"t help at all but let's give it a shot. A curb by definition is a stone or concrete edging to a street or path. So the curb is where the concrete that was used to pave the street ends and a different topping like dirt or rocks begin. Just because that particular portion isn't beveled or raised doesn"t mean there isn't a curb there or that you can"t jump it. Now Chael I know what you're thinking. "How can my car Jump? When i was a child I used to jump rope & My car didn't leave the ground or jump anything." No shit captain literal, next time use the process of elimination when reading a definition. So if there is no "Raised" portion of the curb then you would eliminate that part and move to the edge of the street part. Jump implies you overstepped your boundary Jump= to move suddenly or involuntarily : start. I now know why you miscalculate everything inappropriately. Oops I don't want to confuse you... since you're probably thinking hmmmm.. Mrs Calculate? Well there's no female calculator, problems or numbers here. Ok so how do I say this "I now know why you missed that spinning backfist in the 2nd Anderson fight!"

I got pulled over for the same thing. But the sign said "All traffic must turn right" but i went straight, as i was in a town i was not familiar with and it was dark outside. Here is a tip for you. It's got me out of 2 running stop sign tickets. Signs have to be posted at very specific spots by the county. If a sign is 6 inches off from where it should be or there is any thing off with placement. Then it is not a legal sign. I'm sure uncle chael can beat any court case what are we talking about here anyways.
