Plaintiff seems like a. miserable pr!ck. Almost nothing worse to have for a neighbor than a miserable, bored old man with money. I don't think there would have been much of an issue if his approach was better.

I think the judge got this wrong. anything that is hanging over "from the earth to the heavens" is the plaintiffs responsibility...not the defendants

No, it’s still the responsibility of the property owner with the tree growing on it. However, if you want to cut the tree as a preventative measure you are in your right to do so. As long as you do so from your property.

❗️AS A SURVEYOR: Get a survey!!!! Always! -Buying a new home? Demand a *recent* survey showing not only the 4 corners of the property but the relation of the house/driveway/any other outbuildings on the property to the boundary lines. -Selling your home? Offering a copy of a recent survey with all 4 pins properly installed and marked and showing the home/other physical assets will give you better leverage and can add a couple thousand to the selling price. -Renting a home with large backyard or acreage that isn’t marked out with a fence? Knowing where the boundary lines are can be extremely helpful. You don’t want to install your kids swing set only to find out it’s 4 inches over the property line and the neighbors flip out. -Have jerk neighbors who live too close to you and always complain about this or that being over the “line”? A survey will *prove* she is wrong and you can tell her to stuff it 😬 This isn’t just for self-promotion either. I’ve seen SO many crazy things happen over boundary lines during my years as a Surveyor. Nothing will make a neighbor dispute more violent or bizarre like a property dispute. It’s peace of mind and legal proof in case you ever need to go to court.

She needs to get a survey done and trim all her trees to the property line, but even that isn't going to be enough because he will probably find another way to sue her once a year. That guy is a tight arse, he probably has very deep pockets and short arms. Also she either needs to keep her pool empty or dismantled during winter because as water freezers it expands and will probably burst the sides of the pool everytime.

Homeowners never want to pay. Owning a home comes with costs for things like this you never expect. Defendant should have paid. She said she did due diligence ie she found 100 reasons to not pay. That was a huge limb.

It may depend on the jurisdiction, but saying that you can cut someone's tree that overhang your on your property all the way to the top is incorrect. You may be able to trim the part that interferes with the use of your property as long as your cutting off limbs doesn't damage or kill the tree.

She should not have hard feeling towards her neighbor when the damages from both incidents were cause by her property. Of course, you are going to lose , as you well should. For you damaged your neighbor. She would want compensated if the circumstances were reversed.
