The plaintiff is a wacko if she thought the landlord could make the apartment habitable in a week's time, especially if it was as despicable as she said it was. Yes, the landlord has some nerve renting the apartment out(I'm sure he thought someone would be desperate enough to live there)...but she has no moral compass. He should have pressed charges on her for fraudulently cashing his check knowing she stopped payment on hers.

I don't think the plaintiff should have gotten one penny. She did not come to court with "clean hands" nor was she accountable for her personal decision to rent the place seeing the condition it was in before handing over money and moving in. While the landlord is obviously willing to be a slum lord, at the point where she took the place it was obvious to her what she was getting and she was willing to do it because she was tired of living in a motel.

I'm not going to argue that the property wasn't filthy and that it didn't need a thorough deep cleaning, upgrades, and obviously an exterminator but what I am going to argue is how somebody could go view a property that looked like that and not go back and inspect it to make sure that the list of things they asked for were done before they handed over the money? Many years ago I rented a property that was not so nice when I went in to view the property there were things that needed to be done, I gave a list of things that would need to be done in order for me to rent the property, of course that would be up to the owner as to whether or not they wanted to do it but in my instance the owner agreed, he put new carpet, and a new refrigerator, along with a good cleaning, once I saw that the owner had stuck to our agreement I gave him the money and signed a lease. I just don't understand why she would be so stupid not to do the same!?

I disagree with the judge giving her the money for the U-Haul I think the fact that she cashed that check even though she knew that her check had a stop payment she should have ate that U-Haul bill as a punishment for doing that to him and inconveniencing him, he inconvenienced her but she also inconvenienced him, especially when he agreed to give her every dime back and he did.

ever heard the expression "silk purse from a sows ear"? if you look at a house or apartment for rent and it's a disgusting dump and you opt to rent it, you made what is known as "a choice". Expecting a landlord to have it up to standard in a day is just stupid. And while he shouldn't have even been showing it until it was move in ready, being as she lives in the US, she has this thing called "choices" and should have walked away. People make bad decisions in desperation, I get that, but that doesn't mean they are entitled to visit their bad decisions on others.

The worst part of this case is hearing the plantiff talk about an abused dog in a cage. But it seems to me as though she was in a rush and desperate to find a stable home after living in a hotel for so long. Which is why she didn't know how inhabitable the place was until after she moved in. Best to own instead of rent!!

I bought a house, it was a flipped house. They did less them minimal of grace and repairs to the house. Cheap paint, poor carpentry, and landscaping. I went through updated the master bedroom, main bathroom, hot-water tank, and floor & ceiling molding. I did it in a week and was able to rent the house on day 8. So it was possible for the defendant to get house rentable if he wanted to. He didn’t!
