He was an asshole. The accident didn't add one cent to the bill he was going to pay anyway, he even admitted that. So he was lucky that there was an accident, now he can split the bill with someone else. Without the accident he would have had to pay more, the accident ended up saving him money. The defendant was definitely hoping this guy would just forget about it. That being said, the damage by the deer had been done 6 months earlier. I don't think the plaintiff had any plans on getting that damage fixed, but then thought he'd get the defendant to fix the whole thing. I think splitting the cost was fair. I still doubt if the guy will fix the car.

That’s exactly what defendant was thinking. The guy had a busted up panel, never got it fixed because he would have had to pay. Now he saw the chance to blame the other guy and force him to pay for half the cost, even though if he had wanted it fixed he would have had to pay the same amount before or after the accident. Getting hit was like hitting the lottery.

The deer damage look like it cost more to fix than the dent the defendant caused. A photograph is not good evidence in a case like this. I would have ruled 70% plaintiff responsibility 30% defendant.

So something similar actually happened to me. I got hit in the back bumper. It was slightly dented in with some paint transfer. 4 weeks later, I get full on rammed into from the back just before I was going to get the car fix (already got the estimates and was out of town for a work trip). So that last guy that hit me insurance actually paid for the bumper to get fixed caused his damage was even more severe than the previous one.

Some accidents are SO CRAZY!!! One time, as I was about to pull into my driveway, I got rear-ended. The guy had some kind of an excuse about thinking that I was going to be taking a LEFT. Fyi: my driveway is on the RIGHT. Another time, a guy pulled out of a gas station right into the side of my car because he wasn't paying attention where he was going. I actually got spun around 180 degrees by that hit, but I thankfully was able to pull into the gas station myself before I could get into a second head-on collision. Another time I rear-ended someone on my way to the dentist. I learned that day that I needed a Root Canal by the way and that was a whole other mess. I exchanged information and what not with the other driver, but apparently, they never pursued it as I never heard from them again. I didn't bother doing anything with my own car: it wasn't seriously damaged and so it just wasn't worth it.

Plaintiff had zero intention of getting his bumper fixed, then when defendant hit his car he saw dollar signs. After you hit a deer, most people *would* take a picture of the damage caused by a deer: to see how much (or how little) damage it did, maybe that the engine still runs, maybe take a pic so you'd have some evidence in case you end up in court....(yup!), maybe if the deer was able to walk away-- even if you didn't have insurance to get it fixed. Added: I saw the Defendant raise his nose several times (near the end) and even blink his eyes like he's so full of himself, and so "above this!"
