The plaintiff hired the defendant to make custom shades, but she learned she was being overcharged and took her business elsewhere. Unfortunately, the plaintiff claims the defendant refused to return the deposit, so the plaintiff is suing. The defendant insists she did a ton of work designing the shades, measuring windows, and “running around like a chicken” for the plaintiff, so she deserves every penny from the deposit.

Splitting it is not ok yes plaintiff made a mistake but letting her keep 950 for maybe at most 5-6 hours of talking is ridiculous and I don't know why any judge or person would find that reasonable or ok obviously the lady said her friend the neighbor usually gives people the information when getting her in touch with clients so to me I believe what happened is she jacked up her price so high so they both could get paid out of it and the neighbor being a friend probably makes people less likely to price match...... I have just been so happy lately that the peoples court is ending JM has been making bad judgement calls for a long time now

I can't believe an interior designer that had been in business for 12? years hadn't encountered other problems before this using contracts without specifics. Clearly there's a lot of $$ involved! I think the ruling was fair - they both learned a valuable lesson!

Absolutely asinine! She said that she never used a contract in a proud bragging way…..that’s not something to brag about, that is a horrible business practice. I ran a very successful business for 18 years, when I started out at 21 years old with just walking dogs I had a contract and liability form even then…cover your ass people.

I would have given her $900 back, because the most responsibility lays with the person who writes the contract, or lack thereof. The business person should know better. However, any person with the tiniest amount common sense should know not to give a deposit towards something when you don't know the total price. My brother did that, and he's not rich, because he wanted something. I couldn't believe he was so stupid. He did have a major stroke, so that might be part of it, but he was never good with money.. You NEVER agree to buy something / pay the deposit when you don't know the total amount you'll be paying. That also applies to anything where you're making a monthly or weekly payment, like a car. Do the math and figure out what the total amount is that you will be paying when you take all the interest into account. You should never buy a car without knowing that. In fact, I personally think it should be law (except governments WANT you to buy things).

The judge knows that the lady got scammed and just let it ride because of how gullible she was in general. The split was punitive for the plaintiff, the logical judgement was subtract a second $250 for the 2nd consultation and award the plaintiff $1150

Sometimes I wonder how certain adults get by in life. How could you do something so STUPID as to pay a deposit when you don't know the total amount that's being charged?? She "trusted" a complete stranger?? Well, she was my neighbor's friend. You CAN'T charge someone a consult fee, if they don't agree to it prior to the consult. I had a garage do that to me. For years, there was no consult fee, then all of a sudden there was, and they didn't tell me about the change prior to looking at the car. I freaked out on them, and did not end up paying that. I changed my garage after that. It's a shame, because they were pretty good garage besides that.

IN MY VIEW 1. I go over with the designer a simple explantion of what I am looking for over the phone. 2. Arrange a consultation meeting, always asking if their is a consultation fee. 3. We meet in person to go over the business at hand and any contracts involved.

It never ceases to amaze me how ignorant people are. Especially when we live in a time where everyone has a cell phone in their pocket or purse, so if you really want to educate yourself on a topic it's really not that hard. But seriously it should be common sense that whenever you're dealing with anyone on a business level, everything you're expecting to be done and the total price should be done in writing. If I had someone after the fact try to charge me a consulting fee I would absolutely laugh in their face. It blows my mind how many people just hand over money with no specific terms laid out then cry to a judge.

It seems to me a lot of 'professional' businesses in America don't write up proper contracts because half the time they are not declaring their full income, because it seems very strange that an interior decorator doesn't establish in a contract, exactly what she will be doing for her client. The plaintiff was so naive, I'm surprised she has survived this long...

Typically a deposit is non-refundable because when you’ve committed to a contract, the contractor purchases the goods for the work. It could be custom choices that the contractor won’t be able to use on for any other client. If it’s not stock items the contractor should keep the deposit and the plaintiff gets the purchased items.

Hmm I had a sprinter company come out to give me an estimate to zone sprinklers for us. This joker tried to tell me it was a $ 80 charge for him to give me estimate.. I literally laughed in his face and told him to piss off.. No one said anything about a charge for him to come out to give me estimate.. I called the number and I told the lady that this crazy ass joker was trying to charge me $80.. I told her i'm not paying shit because no one told me about the charge, I would of NEVER had him come out in the first place.. He literally sat out in front of my house for a 1 or 2.. But, I didn't give a rats ass.. It was his time he was wasting... Let people know up front if there is a charge don't wait until your done... Thats a damn scam!

For that price. I'd buy flat king size sheets and make my own curtain. I made all my home curtain sheets into some beautiful curtains . In our 3 bedroom home. Living room , dining room bathroom. There were 5 other ladies that had done their homes. We all lived in a nice mobile home park . We were neighbors next door to each other. And just became friends. We made other decor for our homes. Back in the early 70's. It's just that was the thing.

Defendant is a person that stabs people in the back . The neighbor had very poor judgment in recommending this person . If I was the judge , I would have returned all the money to the plaintiff , including the $250. The defendant didn’t do anything except show how greedy she is, and how stubborn she is in keeping money for doing nothing. Legally, if there was a contract, the defendant would be compensated for her damages . There is none. To say that she agreed to pay by a contract , is like saying the plaintiff gave the defendant a gift for nothing , which is certainly not the situation for deposits . The person is rather tricked and agree because of hastiness .

The plaintiff could've gotten shades online because she already knew, what she wanted. The plaintiff was "more" interested in impressing her neighbor. That's why she got herself into this mess.
