The plaintiff says he brought his dog to the defendant for boarding while he was on vacation. He claims she was limping and her leg was dislocated when he picked her up, so he’s suing for the cost of surgery, lost wages, and pain and suffering. The defendant says she’s owned a pet resort for 10 years, and the plaintiff’s dog is quite elderly and suffers from arthritis, which isn’t her fault.

The kennel's responsibility should have been to immediately call/text the owners when they noticed their dog limping and then discussed with the owners the action to take.

i wonder if vets ever lie for their clients that they have known for many years ? that defendant needs to have everyone sign a waver or she is gonna go broke and be out of business from all the lawsuits she will lose , because pet owners LOVE to get others to pay their vet bills .

Now if I was watching one of your love one/family members and they started to have a physical problem, would you want me to contact you or even take them to the hospital?

I'm a certified veterinary technician. I assure you it takes a fair bit of force to dislocate a femur. I worry that someone kicked or dropped that poor dog. My clinic has a boarding facility in it. I can't think of any normal boarding activity that would have caused that dislocation. I hope these owners left a detailed review online so other possible clients can find out about this incident. I wish the judge would have awarded punitive damages because the facility was so negligent and possibly committed abuse on that little pup. Awful!

The defendant is a straight up irresponsible business owner. No wonder she didn't want her business name shared! Didn't she even pay attention to what the doctor said or the X-ray? That dog received trauma that injured that leg. She needs to be questioning her employees and looking at any unsafe conditions in her facility. Will she open her eyes when a dog gets fatally injured in her facility? Probably not, because I'm sure she makes sure she gets that waiver that'll free her from all responsibility. Smh

She dismissed the vet's diagnosis! The vet said obvious trauma, and she still insisted that when a dog gets old, their hips dislocate themselves !!! She's insufferable! I wish they'd say the name of that kennel.

Pretty sure from a quick search I have the business name, location, and all the owners name. Business registrations are public record. When these people try to hid their details makes me what a dig it up even more.

Thank you!! I managed a Dog Social Play Boarding for 8 years, ANY sign of ailment the dog was brought up to the front office area, (if upset stomach, something minor), separated and cared for until better, if the stomach wasn't better by the next AM, vet or taken directly to the vet if injured. That woman should NOT be caring for people's animals. I'm scared to think what actually happened to the dog.

This is one of the reasons I NEVER leave my dog at a kennel. If my dog doesn’t go with me they only stay with trusted family members or I don’t go

Same. I postponed my trip to new zealand because our cat needs meds every other day and I don't trust anyone to do it except for us. Just not willing to risk it and that's what you do for your pets, they're family and sometimes you gotta make sacrifices to ensure their well-being.

That poor pupper had a dislocated hip and wasn't seen for days. Even someone that doesn't care for dogs would have said to themselves, "I better have the dog checked". It's actually really disturbing.

They literally took every step correctly and took their dog to be checked out a couple times before they even dropped Lily off at the kennel. The Vet wrote exactly what she saw and the defendant still doesn’t want to take responsibility. Ma’am the dog got hurt at your facility unfortunately but you gotta pay up. What does she not understand?

That dog would've been in so much pain, I can't imagine. I hope nobody puts their animals in her care again. She should be shut down. I also hope the people online that are smart and know how to find stuff out, blast her because she didn't want her business name shared. No wonder !

Defendant is irresponsible. But she made herself look even worse by continuing to insist that nothing happened to the dog in the exit interview with Doug after hearing the vet report, seeing the xray, her own testimony that the dog did not start limping until a couple of days before the end of her stay, AND her own testimony that they are not veterinarians, yet they misdiagnosed the dog!

I don't trust kennels. The owner attitude is "not our faults". If i needed a pet sitter or boarding, i preferred a private party in their own home.

Lol JM was half yelling at the plaintiffs about proving the dog was injured at the kennel, and that she knew exactly what the defendant’s response would be… what she got instead was her admitting to the dog limping while there😂😂😂 TOO FUNNY!!! It sucks the poor doggo was injured, plus, no waiver was signed making her(def.)liable. Honestly though, KUDOS to the defendant for telling the truth 👏🏽 Sadly, other crooked ppl would’ve denied this, which we’ve seen time and time again. So then you have the ones who deserve to win end up losing on a legal technicality supported by a lie from the other party.

the owner himself said that the dog had a mild limp when he picked up the dog. The next day the dog was on 3 legs. The owner hardly stayed up all night to watch the dog..the trauma easily could have happened at home. Dogs will throw out their hips just jumping up on furniture.

And she kept saying that there was no way blunt force trauma could have happened at her kennel. The vet NEVER said BLUNT force trauma, just trauma...She was still denying it until the end even though the vet said it was an injury dislocation not old age. And the fact that she admitted that the dog had been limping for 2 days was even more damning...Poor little pooches had 2 sit through it for all that time...

@@Pepper9873 nah, the dog was probably sore with arthritis just from lying on the cement kennel floor. It happens with older dogs all the time. The hips of these smaller dogs slip in and out all the time when they're older. Cheers anyways!

Small dogs age differently than big dogs. That dog will probably live to 18 years old. To call it an old dog limp is irresponsible.

This is why I loved the fact that my vet alsp does boarding. We always boarded our dog there, so if anything did come up, the vet was there.

The dog probably was dropped down from a kennel. And I don't believe the defendant when she says, the plaintiff was called about it. Because, then he wouldn't have said why is she limping?

I worked for a rescue that offered boarding. The judge is acting really weird in this case. She seems to think the plaintiff is in the wrong for not leaving the dog longer, which would’ve left the dog more injured and more in pain. He did nothing wrong by taking the dog, noticing the hotel lied about the severity of the limp, and taking the animal to the vet as soon as possible. Also the waiver doesn’t absolve the resort of any wrongdoing even if they found one. It had no relevance to the case. Waiver or no waiver it’s their duty to notify the plaintiffs of the condition of the dog and ask them if they wish to seek vet care or not (a digital waiver can be sent at this time to approve this). However since the vet said it was due to trauma, regardless of waiver, the defendant would be responsible for vet costs. At my rescue if we noticed a limp, we would’ve contacted the owners ASAP. No wonder she didn’t want the name of her shitty resort on tv. That poor dog was in such pain and they could not care less.

My dog never goes to anyone he's a rescue that has behavior issues because he was abused 💔. And he's only use to me . But I don't mind I love being around him. He's my baby

So true one of the persons response. I had all my dogs groomed and the groomer always told me if they had some possible issues. I then took them to vets an asked to be checked.

The assumption that a 12 year old dog is by default "crippled" or has arthritis is simply wrong - it varies from dog to dog just as it varies with person to person the condition they are in at a given age and not every older dog has arthritis. I've had several dogs that I couldn't force into "retirement" from work at 11, 12 and even 13 years old because they weren't ready, and their bodies were still strong and healthy. Now if the plaintiffs dog had shown to be fat and stove up prior to the injury then I wouldn't hold the kennel 100% responsible, but when a dog is in good weight and otherwise healthy and a vet states it was caused by traumatic injury, then the care provider, in this case the kennel, is absolutely responsible. And for those who board, train, groom - you NEVER "wait and see" if a change occurs when an animal is in your care - that's not your call to make, owners should be contacted IMMEDIATELY, preferably via text, so that you have their decision as to what you are to do in writing. This kennel owner seems to think she knows better than the owner who has lived with the dog for 12 years, and a practicing vet who did x-rays and surgery to repair the damage. The vet has nothing to gain by making false statements and everything to loose so IMO the vets assessment carries all of the proof and weight needed to hold the kennel responsible in this case.

Harvey explained this once and it was basically that it could be capped at the value of the dog but judges are humans and give you the vet bills so you’re not out since the dog is a living creature

My dog is 12 and her hip pops out of place from time to time. The vet showed me what to do to get it back into place. My dog will be 13 soon.

So the defendant admits that they knew the dog was limping for a couple of days before the owners were due to pick it up, she should have had taken it to a vet immediately. And then to claim that they normally have the dog owners sign a waiver, to say that the kennels are not responsible for anything, this woman should not be allowed to look after animals, she is just plain despicable...

Harvey summed up the defendant’s side succinctly. But the ignorant defendant thinks the dislocated hip is from a congenital defect or arthritis, doesn’t want to admit that a blunt trauma injury happened under her watch. I bet Stephanie lost her job for not getting a waiver signed.

If she had cameras where’s the footage she could have submitted that to the court and some clerk could have watched it prior to trial and confirmed they didn’t see the dog get injured by negligence

It takes alot to dislocation any arm, leg in any creature or even a human being. Don't say it did not happen, for it did. You just did not witness it. Like the judge said, you can not see it all. You may or may not have a employee what caused this, or dropped the dog.

They likely put that 12 year old dog in a room with a more hyper active dog - her bones are not young - it’s entirely their fault and it clearly is trauma

Unfortunately, dogs don't dislocate a hip out of nowhere. Most likely, the dog was either tripped over, playing with a larger dog, or no blankets in kennels.

Remember they can waive negligence, not gross negligence. If no one noticed the limp it is one thing. Not picking up the phone to attempt advising the owner and request direction on how to proceed with the limp, when expressly noticed, is gross negligence.

That hip socket looks eroded and shallow and there is arthritis. This would not be the fault of the kennel. However, as soon as the kennel noticed something wasn't right they should have contacted the owner for instructions. This kind of thing can happen at anytime. Just because there were no clinical symptoms days or weeks or months before does not mean that it was caused by the kennel. The dog could have caused the injury itself. Kennel staff are not veterinarians, probably not vet techs either and cannot make a diagnosis based on symptoms. This is an elderly dog with hip arthritis and it is going to be impaired, even after surgery.

I'd trust the vet's opinion the most. It sounds to me as if a big dog jumped on their small dog and dislocated its hip. That's trauma. It had to have surgery because it wasn't immediately brought to the vet. That cost a lot more. That poor dog had to be in so much pain, even after the surgery.

Actually, he said he noticed when he got her home that she couldn’t even walk, and called his vet. He took her to the vet either same day, or the next morning… 5:13

@@danir6695 but he said she only had a mild limp when he collected her. If the hip was dislocated, she wouldn't have been able to put any weight on it right from the get =go. Judge Milian knows a GREAT deal about contractors ...though her prices are a little low, even for then, but she knows next to nil about dogs and pets and injuries. She should study up. cheers anyways! ps some of those little dogs? When they get older their hip will pop out of the joint just from lying on it in the back seat of the car.

@@kittyfan i was merely pointing out the fact that he never said he noticed the limp the next day. It was the same day. He didnt notice how bad it was until he got home. He said she wouldnt put weight on it even in the car. And i guess youre going to completely ignore, just like the defendant, the trained vet’s comments stating that there had been trauma to the leg. Oh and ps: if a little dog is so fragile at an old age, maybe dont take the responsibility of caring for it. Have a wonderful rest of your day.

Also, my dog has arthritis, the ball of the hip no longer fits well into the socket and they recommended hip replacement. I don't agree with the vet that it could be a traumatic injury. I think the vet is really good friends with the plantiffs. Just my opinion.

That's your dog. The plaintiff's vet knows their dog and knows what happened to it. I'd believe the plaintiff's vet before I'd believe someone who knew nothing about their dog.

@@elaine462 I'm sure that's true. But not always when a dog begins to limp is it trauma. They say nothing happened to the dog. I mean that could be true. How could the vet know if it was trauma for sure, only her opinion. We are all entitled to our own opinion. The kennel owner started to say they have cameras, but she was interrupted by the judge. The dog could have jumped up or down steps, anything could have happened. The only thing I agree with is the kennel should have called the plantiffs as soon as the dog was limping and then take it to the vet.

The dog was injured with the dislocated hip when in the defendant's care. Theres no question about that. The plaintiff knows their animal more than anyone else. But Milian has this way of being combative with litigants when it's unwarranted. Smh

When you go in asking for 5000 dollars instead of the vet bill you just automatically make an assumption that it's greed. You have to think, she's been doing this for YEARS. How many cases has she had in front of her that are just absolute nonsense?

Good verdict. However at the end when the plaintiffs say the dog is doing better, she definitely is not. When they came in they said to this day she’s still in pain. And months later they STILL had not taken it to therapy. They don’t wanna pay for it at all. The dogs is suffering under everyone’s supervision it seems

That waiver would have saved them. I mean a 12 Yr old dog starts limping, it's hardly a surprise.

I don't know about this one. Yes the dog was at the kennel and the defendant should have had it checked by a vet soon after they noticed it was limping. But on the other hand, this is an old, frail, crusty-eyed piece of white fluff. What if it just fell off a step or something and injured itself? Lord knows I take a misstep and my ankle is flaring up for weeks.

Even if the dog injured himself, they should have had him examined by a vet as soon as they noticed the limp...then the hip could have been simply popped back into place. But instead they waited a couple days (while he suffered), which made him require surgery. From PetMD: A dislocated hip is a medical emergency. It causes acute pain and disables the leg until it's corrected. It can also cause secondary injuries to the surrounding blood vessels, nerves, ligaments and tissues. Hip dislocation can cause long-term damage, especially if it's not treated right away.

Well, somebody could have kicked that dog, and that would have caused enough blunt force trauma to knock its leg out of socket. Hate to say it, but that stuff happens.
