The plaintiff says she rented an apartment, but then the landlord sold it to the defendant, who kicked her out. Now the woman won’t return her security deposit, so she’s suing. The defendant says she bought the apartment and the plaintiff stayed longer than she was allowed to, so she owed the defendant rent.

@@marleonetti7 Luckily the majority if the those who comments disagrees wholeheartedly. The entitled ass of a plaintiff lied and threatened to make the defendants life difficult until January, even though she was only a month to month tenant and she wasn't happy about that. Unfortunately the lie worked and she got to keep her deposit on top of successfully lying and staying longer than she had the right to. I believe the defendant did not know (she bought it from the previous landlord, it's very plausible that she didn't know she had to stay there, live and learn), and when she had to move in, she went above and beyond to help the selfish asshole and got punished for her good deeds. But even if the defendant knew, two wrongs doesn't make a right, the plaintiff was only a month to month tenant, yet the defendant let her stay 60 days longer, took money of the rent and tried to help her find a new home. The crook won in this case, that's just life.

"I was about to be thrown on the street." It's not the landlord's fault you're picky. They're not responsible for you not having anywhere to go because of being picky. Plaintiff really has some audacity coming on here trying to portray the defendant as some evil landlord when she was the reason she had nowhere to go.

The plaintiff's problems about finding a place are not the defendant's problems. I'm not buying defendant's story about being ignorant to having to occupy the home (you have to complete the application as a primary home and you sign several FHA disclosures at the time of application). She has to occupy the home within a specified time or they can call her mortgage due or take the home for mortgage fraud.

Although I understand it I hate this result. The one thing the defendant can take away from this is that she's a home owner and she'll no doubt end up sound in her later years. On the other hand knock off Snookie will most likely be renting for life and making move after move. Future landlords watch out for this one.

Single folks renting for life is not a bad option in my opinion as long as you have a good landlord. You don't have to worry about replacing high cost items when they burn out from age. Homeowner responsibility is a major decision. I am glad the defendant got her first home. I hate that the law rewarded the plaintiff in this case.

the landlord won't wind up safe if she continues to do garbage like this. She literally tried to commit fraud with a govt backed loan, it's a felony. Do people need this to hit them upside the head or what? it's ILLEGAL. Absolutely NO ONE accidentally does this, they have to sign the paperwork specifically for this at the closing. I'm shocked she didn't wind up being charged, that we know of.

She wasn't going to evict her because the defendant was committing a CRIME & had already committed a crime. It's a felony to do that with a govt loan even if she subsequently moved into the property. She attempted to scam a govt backed loan for the money related to the rates & the guidelines, it's called FRAUD. She could go to jail for that.

I like how everyone thinks the plaintiff is in the wrong, when the pandemic made everything more complicated for renters. I would also not look at the landlords suggestions for rentals, she’s not looking out for the tenants best interests, just her own, because she wants her out so she can move in to avoid being chastised for not following her own government issued loan! The plaintiff is allowed to be choosy about where she wants to live, anyone would be! The threat was uncalled for, but she was correct. That defendant has to follow the law too, bottom line. I’m glad the plaintiff got her security doubled and won the case. The pandemic made things hard for everyone, but there was also lots of taking advantage by opportunistic people!

The conclusion really sucks. The plaintiff did a terrible thing. The defendant was giving her more time even though she didn't have to (unknowingly anyways). Just bc you are up against a wall, doesn't entitle you to take from someone else. That absolutely is a test of your character. Threatening her to push it to eviction was a dirty play...and now trying to get triple out of her? I had a very similar thing happen when we rent our condo during COVID. We even checked in on our tenants to get ahead of any possible issues. We asked if their jobs were steady bc we were willing to work with them if need be. We also didn't raise our rent. At the end of their lease, they never gave us a 60 day notice rather 30 and to boot, they wanted to pay only partial rent for staying a part of the month. That's not how rents work. You stay a second into the next month, you owe the entire month. We wrestled with this as we weren't well off either but we didn't want to split with them on bad terms. We compromised that they just let us keep part of the security and took the loss. Owning property is hard when you are a kind person. The judge is right, no one will give u a break, u need to be shrewd and sharp if you want to survive in this world.
