The plaintiff says she was transporting a horse for the defendant, but the animal kicked her so hard she had to go to the hospital and eventually a hand specialist. She claims the horse has a history of kicking, so she’s suing for medical bills. The defendant says he sold his gentle horse to a woman and the plaintiff was transporting for her, not him. He says his sweet horse has never kicked anyone, and he had her for 18 years, so the plaintiff must have done something.

yes, she did hit the horse. I knew she was lying when she said , the horse kicked her in her hand . I grew up around horses, as well horse people since i was very little. Sadly, a lot of horse people aren't alright in the head . my aunt who has horses has delt with so many of these people that the stories are so crazy that it's scary.

First off by your logic the messages between plantiff and Mary Kate should not have been used as evidence as well. Mary Kate is not the one being sued. However, it doesnt matter because its not relevant to the case for several reasons. One he had sold the horse to someone else and two he did nothing wrong.

I believe she wasn’t at the end of the lunge line, I believe she was close to the rear of the horse, hit the horse and the horse kicked her. If the horse was a kicker the horse would have kicked at some point when she first tried to load the horse.

I think she got frustrated with the horse not loading so she thought she'd lunge her. She got more frustrated when the horse wouldn't lunge properly and I think she came in closer around the hind quarters to try to get her to move forward by either swinging the end of the lunge rope at her or whipping her with it. Never pressure a horse like that or back it into a corner where it feels it has no other escape than to go through you. However it happened it was her fault

The judge made the right decision. The plaintiff went against all of the advice from the defendant and I believe that whe whipped the horse with the lunge line. Also, the defendant didn't own the horse at the time.

As soon as Mary Kate said, "she hit her with the lungeline", I knew immediately that she couldn't have been at the end of it, more likely somewhere in the middle, with enough in her other hand, to reach Tess's hind quarter. I'm glad the Judge worked that out despite not knowing much about horses. This woman made a fatal flaw, over confidence, and unfortunately it cost her. BTW that owner was lovely, you could tell he loved Tess.

The plaintiff was given fair amount of warning about this horse. It was her decisions that caused the kick. I don’t believe she’s as experienced as she claims to be. I believe she lost patience with the horse and made a careless mistake. It’s no one’s fault but her own and is just the risk of the business. Sedation should have been suggested from the beginning if it helped so much the second time. Why cause a horse so much stress when their known for not handling it well.

Any horse or pony can kick. You are responsible for minimizing your own risk. HOrses kicking each other has nothing to do with kicking a person. Even the gentlest horse is capable of causing grievous injury if it kicks you for whatever reason. Whipping the hindquarters is a good stimulus for a kick. She lost because the judgement was correct.

If you promote yourself as a handler of horses (any animal) then you have to be knowledgeable enough to know what behaviors you might be faced with and how to avoid them or manage them. Vets don't sue clients when they get bit. Knowing beforehand that the horse "might be difficult to load", and knowing what might be involved in getting her in, you'd charge more than $100. I was taught that when working with a horse, you stand far enough away not to be kicked, or close enough in that a kick would have no power.

So far all I have listened to is the intro. I'll tell you right now, it is never the horse's fault. A person that knows horses knows how to watch for signals. A horse never kicks or bites without a warning first. Sometimes it's lightening fast between the warning and strike, but it's there. You never rush a horse into a trailer or out of a trailer. so here is my thoughts she got frustrated the horse would not trailer. decided to lunge , against the owners advice, then got frustrated the horse would not lunge properly (despite being told the horse does not lunge) 10/10 she was behind that horse and tagged her with the lunge line to make her run, and the horse, already have a bad day from her perspective, kicked out at this stranger who is making her life very difficult today Lunging is not how you trailer a spicy horse. You simply keep turning them in a little circle , talking gently and keep attempting the trailer. walk inside on a long lead and show the horse you aren't getting hurt. Patience is the key here. Horses sense emotions and feed off them.

Well.. lunging can be a very effective training method for trailering. There are several reputable trainers that do that (you can find here on youtube) and the theory of making the horse work and allowing the trailer to be the easy option is used quite successfully. That being said, I don’t think this lady in any way shape or form used the method correctly. I think she was trying to force the horse to lunge and popped her on the butt and she kicked.

I think the plaintiff is lying, I grew up on a ranch where we trained horses exclusively. It is extremely common practice to use a lungline to whip a horse on the butt if they are being non compliant when lunging. That is probably exactly what she did. There there are certain safety precautions that you should take when doing this, and it sounds like she probably did not because she was over egotistical.

She wasn't 'whipping' the horse. It is normal lunge practice to use a lunge whip (like the lady in the lunge pic of the horse's sister was) to encourage the horse to stay out at the perimeter....or the tail of the lunge line to flick at the horse. It should be a mere tickle (and you can crack a lunge whip, they make a popping noise if you are experienced). BUT.... if the horse was not lunge trained, expecting it to be docile and used to normal lunge signals is very risky. You need a helper to walk the horse or run the horse in circles, or, the guy mentioned a round yard. So just free lunge with no lunge line. I professionally and personally trained horses for 35 years (now moved on to smaller critters). If you advertise your services to load horses into a trailer, you should be able to achieve it. I have loaded at least a dozen difficult horses repeatedly with no sedation and zero injuries. You bandage or boot the horses legs, and with good feed in the trailer and the lunge line to 'winch them in' like a trout with the lunge around their tail (if you are a horse person, you know what I mean), it is not difficult with a horse that is used to general handling.

This lady doesn’t know what she’s doing. Always behave like the horse will kick, ALWAYS. (I can share stories of equestrians suffering head kicks from horses they’ve had over 10+yrs) The horse could get spooked, bitten by a large bug, have pain somewhere, long list for reasons to kick. There’s proper ways to use a lunge whip to encourage movement - to do it hard enough to cause pain will often cause this “cow kick” and frustration. You don’t lunge a difficult horse prior to trailer to tire; you do it as a way to say “You have two options here - work or go in the trailer with your hay; you choose” Your not going to out strength, out endurance a horse - it’s insane how many decide to get aggressively physical with their horse like it will effectively teach anything 😩 Horses kick. Horses bite, buck, rear, trample. Just like dogs growl and bite. It’s major parts of their natural communication

I grew up with horses and it's just an inherent risk working with them. I don't know what state they are in but in Colorado, there is a statute that basically says this and it's at your own risk when working with large animals like horses.

Same. I worked with horses to teach them to load. A stock trailer is a good way to start as they are large and open. Smaller horse trailers are good for animals that are used to being transported as they're much tighter. This woman has no business being around horses. The first thing I always taught people is NEVER assume a horse won't kick a person.

If the plaintiff is a horse professional (eg, getting paid to load and haul horses) then she should have had insurance for these instances. Secondly, I think every state has an equine liability law, where you are not allowed to sue for injuries from a horse. Unless there is gross negligence on the owner’s end. So much wrong with all of this. Horses kick. Shep the riding pony kicks. Horses kick at each other - and are not usually scared of each other because of it. If two horses truly hate each other most horse owners won't pasture them together. If this chick knew about horses she would not try to equate that with "being a kicker". Also - even kicking once doesn't necessarily make a horse a kicker. My mare side kicked at me and got me in the back when I was leading her back out to her herd. It didn't make her a kicker. It made her a diva who was allowed to get herd bound. I owned that mare for 11 years and that was the only time she kicked me or anyone else... or even threatened to do so. This was about 10 years ago. My stallion side kicked me once when I was round penning him. I knew he was pissy - and I let him come in too close because I wasn't paying attention. He kicked once and has never kicked me or anyone else since. I've owned him now for 14 years. This was 12 years ago. If that horse kicked her it was because she got in too close. I can't interpret "whipped" from "swatted" because I wasn't there... but it's not entirely uncommon for them to kick out like then when swatted (or whipped)... especially if they are surprised. When you state that you are used to dealing with problem horses you are setting yourself out as an expert. If you are not that expert you are going to get hurt. This chick comes across like she read a few books and watched a few monty roberts videos and fancies herself a trainer.

Warning a person taht the horse kicks? ALL horses are capable of kicking when cornered, afraid, or spooked. First thing we learn in pony club is don't run behind a horse! they ALL kick. If she's an experienced horse person, she could tell from the get go that the horse was fired up from trying to be loaded, then she further aggravates and upsets the horse by longing it. If she;'s trying to hit the horse with the end of the longe line, she can't be at the end of it, she would have to be half way down. he didn't even legally own the horse when it kicked her, nor was he the one who hired her to move it in the first place. She should have tried to sue the other lady not him.

First I don't believe the Plaintiff whipped the horse. I also don't believe the Defendant is liable for her injuries. She was hired to do a job. It is on her in the course of her duties. It's unfortunate but it's on her/Plaintiff. It's what horses 🐎 do. They can be sweet but they can be large dangerous animals too. The Defendant knows his stuff. Good judgment Judge M! I hope the best for the Plaintiff. 💜✌

She either whipped the horse or got aggressive and in its face, because she wouldn't have been in the kick zone if the horse was just lunging at the end of the line. Horses don't just kick unprovoked, so if you go by her story it doesn't make sense. The defendant's story makes much more sense. If his horse is inexperienced with trailering and lunging, then she probably got upset with the horse and decided to "show it who's boss" and that's when the horse lashed out.

Horses are horses. This is why any equine activity starts with a liability release. It can be dangerous! But horses are also wonderful and can be amazing to work with ❤
