NIGEL!!!!!!! This was my Urban Garden Design instructor!!! Amazing landscaper. We drew landscape designs for our final project similar to the ones he was showing. This man knows what he’s doing 100% and as a certified horticulturist in NYC people really don’t know how much time goes into doing these designs, materials and measurements. So interesting to see him on here hahahaha what a small world. Not sure if he’s right in the case but can’t judge this one case off of his amazing 30 something career. I learned a lot from him.

I almost feel like he wants all the plans and he's going to try to do it cheaper or do it himself. Just my feeling by his pressure for measurements, dimensions, etc.

Of course, he can. He paid for the plans. COMPLETE plans. He never agreed to sign a contract for the work because he did not get the complete plan.

60K is actually reasonable. You're paying for a professional designer, his design team, demo, materials, labor and project management and clean up. The wood alone is very very expensive especially ipe wood and ipe decks are extremely expensive. This guy got a deal here.

It comes down to the wording. He said he didn't get the final plan until four months later. That's actually on him, because he's the one who kept changing it. Had he approved the original, they would have been off and running. The longer the client can't make a decision, the further down the priority list he goes.

This guy I hired a landscaper got the blueprints and then fired him. Basically he has the paperwork now he can do the job himself stole this man's idea/ plan

He didn't get a blueprint because it has no dimensions, construction materials or exact placement. All he got was a drawing.

The backyards aren't really tiny. They are skinny but long. My family still has our brownstone in Park Slope Brooklyn which is my childhood home. We had a barbeque/picnic area and swimming pool growing up. For a $3m home, spending $60k in that area brings your home value up by about $300k. It's ridic!

People taking advantage of artists and getting away with it. The plaintiff clearly just wanted to get a plan for free and was never going to hire the defendant for $60k… he’s now going to take the designs the defendant came up with and try to find someone cheaper to do the work.

There’s something totally missing in this case. Landscape design especially in NY is the same as for a building meaning that you need final design with measurements to get a permit and city approval before construction. The defendant said time wasn’t an issue until tenant moved but that’s not the case. They needed the plans approved before they could do anything.

Sooo, JM doesn’t understand the concept of “sustainability” as it relates to wood, etc. The defendant explaining why he chooses not to use epay wood was not him bloviating about his views on climate change, it was explaining that using epay strictly goes against the basics of sustainability, because it displaces people, and destroys rainforests, which affects us all. It also goes against what the client was requesting, since he himself wanted to use sustainable wood. Epay being “hard as rocks” is actually what draws a lot of people to it, because it will last, and last. Sometimes JM is just rude for no reason.

Just looking at the beforehand concrete. I can't believe people ever filled their backyard with concrete! I get that not everyone likes nature but I couldn't imagine staring at that. If you can afford a brownstone you can afford a gardener so it was literally someone's choice to put in concrete. Oh dear 🙄

Ok, so this is the first time I have ever stopped watching an episode after the first 4 minutes, all because Judge Milian was acting so rude to the defendant! She was shouting and raising her voice and was being downright demanding of him and I had had enough at that point. So unprofessional!!!!

Defendant missed an obvious defence, “couldn’t get into the backyard to do the measurement due to the tenants. They were supposed to leave in July, we would have started the fence and then got the final measurements.”

I like Judge Milian but think she totally got this case wrong. They weren't to the point yet of having a draft design with absolutely everything on it. The defendant had to have the fence measurements first to do anything and was waiting on that. The defendant did nothing wrong and shouldn't of had to pay the plaintiff anything. The plaintiff jumped the gun and fired the designer to early to have a final design. He fired him because of wood type because plaintiff is an idiot.

15:55 you dont win cases because you were mistreated as a contractor. Life doesn’t work that way! I believe that to be a fair judgement. The plaintiff can take the designs he has and add the unknown measurement. Its not that hard to use a tape measure.

I think it's a fair judgement. The plaintiff didn't get a blueprint because it had no dimensions, construction materials or exact placement of everything. All he got was a drawing which was not worth $4500.. Plus the defendant admitted that it was not complete.

yeah, landscaping is cheap. I installed an irrigation system. And the parts alone cost a grip without labor. I can’t imagine that cost.

At 9:15 the judge admits she doesn't know about wood and the environmental impact on the planet, THEN she should educate herself and come back less ignorant. She is so rude (loud and obnoxious) even though she is obviously talking to two educated men, she still can't be anything but crass. Obviously the plan (an ariel view) is to scale, so all the measurement ARE there, so he did ALL the work they agreed on, for $4500, where in the contract did it say that he had to provide all the individual measurements, the judge is ridiculous and should never have made the defendant give back anything, the plaintiff is the one that breached the contract a month before the commencement date...

Unless the contract specifically said the deliverable included a detailed plan with measurements to be provided to the homeowner, I find this to be an unreasonable assumption. The homeowner is clearly trying to get the plans and then other do it themselves or hire cheap labor

The only reason for the existence of a contract is when there is a dispute and it goes to court, so obviously you must provide the ORIGINALS, who in their right mind leaves the most important piece of evidence at home?...

@Crystal Holmes - unpolished? Mm-k sweetie maybe you need to understand this is COURT not Oprah. She doesn't need a 20 min answer to a 2 min question. She doesn't need a long winded reply to a simple yes or no question. She wants the shortest most accurate answer. It's not "unpolished" it's running a courtroom. Have you ever been in a REAL courtroom? She gives these people much more latitude than they ever get in "official" procedings. Just like the speaking out they won't warn you like she does. They'll cite you for contempt. If they want to tell a big long story there's Dr Phil. I think it's hilarious that you call her unpolished. I think she'd take that as a compliment. Watch Judge Judy a case or two and you'll see way more than "unpolished" you'll see RAW😂 Let your delicate sensibilities take that in 😂😂😂

I don't trust the plaintiff. I think Nigel should amend his contract to say that the measurements and list of plants will be part of the second contract for the finished work. There is nothing to stop the plaintiff from using Nigel's design and hiring handyman to do the work.
