The plaintiff used to live with the defendant, and she argues the woman was a hothead. The plaintiff says the defendant won’t return her security deposit, so she’s suing. The defendant claims the plaintiff is a slob, and she’s withholding the deposit to cover the plaintiff’s unpaid rent and cleaning fees.

Why wasn’t the plaintiff awarded double since in her state she’s supposed to be notified in writing why her security is being withheld?? The judge said that Florida laws state that it has to be in writing. I don’t get it.

I disagree with Judge Milan. The police were called on the 8th for the plaintiff being locked out. The defendant was told by the policy she can't lock her out. So it was an illegal eviction! Listen to about 8:35 in the video. When the Judge said the plaintiff was confusing being picked up and thrown out as opposed to having an actual eviction notice. It IS an illegal lock-out when the defendant locked her out!! That's why the cops were called!!! Even people on a month to month have a right! So on the 18th, the plaintiff decided she can't live there for obvious reasons. Florida statute states for a month to month either party can terminate by giving not less than 30 days notice. Title VI chapter 83, 83.57. The defendant locked her out without notice. I also don't like that the Judge glossed over the fact that the defendant told her she videod the plaintiff's room in July. Judge commented but did not take that into consideration.

The defendant like so many other people in these landlord situations should have just been honest and said the reason why I didn't give her deposit back is because I'm broke, I didn't have it. Instead of nitpicking.

after my first rented room I stopped giving deposits. People rent out space in their house when they're having financial problems, generally speaking. They're not going to set that money to the side to give back to you later. They're going to use it to get current on bills or whatever, and tell themselves they'll replace it by the time you move out. Of course that won't happen.

@@brookiegremlin6660Most people don't have multiple options to choose from and the majority of landlords want a deposit. You can't just not pay it in most scenarios unless you have friends or family to take you in. Many people are lucky to find one place they can afford and have no choice but to pay a deposit.

Yeah... her evidence was a video of clutter in the room while the plaintiff was living there, and her "after" pictures were close-ups of corners and windows that need some dusting and caulking. You didn't like your roommate, so you kicked her out and tried to charge her for the maintenance you should be doing on your own house.

That happened with me and Brook Shields. She was waitressing at a restaurant in the Florida Keys using the name Kelly. I said "Your not Kelly. You're Brook Shields." She said "no my name is Kelly". Then she mostly avoided coming back to the table. Years later I saw her in a movie playing a waitress in the Florida Keys. She couldn't fool me.

Right? She could have also looked at her bank statements to find where she purchased it. Many stores will be able to get you a receipt as long as you have the day you made the purchase (I believe there is a time frame though). She could have done it if she wanted to.

This can happen if a landlord doesn't pay accrued interest within 30 days of returning the deposit, or if they don't send a written explanation of deductions within 30 days. Tenants can file a small claims lawsuit if they believe their deposit has been wrongfully withheld"

I think the lease didn't qualify as a "year long lease" because of how it was worded. So technically, the Plaintiff only had a month to month. No double damages on a month to month, only a year long lease. Also, why are both of them filming each other's rooms? Both rooms looked like a nightmare. I can't imagine living with either of them, after seeing that.

If you pay a security deposit no matter on a lease or month to month the landlord has 30 days to give you an itemized receipt why they are keeping the security. If they don’t you can get double

The rent should have been prorated. She paid on Sept 15 and was out on the 18. She should have been given 3 weeks of rent back as well.

I need to find an apartment. I do not want to be in a situation where I am living in someone’s home. People do not want you there. They need revenue and the smallest thing makes them upset. I feel sad for the older lady whose income must be modest. Why would she move into a roach infested place if it wasn’t for that reason. She claimed it was roach infested. The lady obviously needed a place to live that had a modest rent.
