This is why you do a walk around with a statement signed by both parties when you move in and when you move out. If you can add pictures and/or video pointing out specific things to be done and by who, so much the better.

I’m a bit puzzled by the ruling because in other cases the judge has ruled differently stating the goods were occupying space and therefore not totally moved out and deemed them responsible for rent. Even if they went one day past the 1st of the month they owed for the whole month.

The window was replaced long after the renter moved out. I would not have rewarded her the $70. Defendant should have had to pay extra amount for keeping security deposit without 30 day written explanation with added fees. She's lucky. Then, she accused the renter from lying. She didn't lie. She had an excellent tenant for 5 years and treated her poorly. Shame on the defendant!!

The defendant didn't want to give the money, because she didn't probably have it. I think landlords are required to have a separate account foe the deposit money should it need to go back to the tenant. Like an escrow account. The rent is theirs, but the deposit is held for when the tenant leaves, less any damages, if any.

But this same judge would say if you left anything on the firstbof another month bars a landlord from renting. The Plaintiff should have taken out all her stuff and not left it. That said, the Defendant was not claiming any rent for not renting for two months. JM had ruled in her head before coming to court. The Defendant should have presented herself better and not promised to give it back and then say she did not have it
