Judge got it 100% correct based on the law. Plaintiff created a lie and brought suit to wit his own evidence proved the Defendant wasn't a thief in any of the videos. Furthermore, showed the Defendant twice closing a window in a dwelling he owns and lives and pays utilities where many municipalities have statutes that allow landlords, especially if they live there to enter and prevent "EGREGIOUS WASTE" even if contracts don't have it written. The garage door and towing is really easy to understand because the law allows and requires landlords to do repairs within a specific time frame and the tenant must comply with allowing the landlord to do those repairs without creating any problems. In this case his parking there prior to having the repair done was a violation! I've experienced almost all of these landlord/tenant issues in my 30 years as a landlord. The landlord might be a creep but he broke zero laws and the Plaintiff's case was based on a lie and hoped the one slang statement caught on film would win him a fraudulent case but in fact got him burned because he hadn't paid the next months rent!
@judgejurylw10264 жыл бұрын
@@nunyabuisness7552 You are 100% incorrect, a landlord can not enter a tenant space without advance notice to the tenant, other than an emergency or tenant have vacated the property, once a tenant pay you rent, then that tenant have what you call [ INALIENABLE RIGHTS ], leaving a window open is not considered an emergency, and can not be used as one to enter the tenants space, unless it was specifically written into the contract, and like i have stated before, this ARBITRATOR, have a habit of being bias against Blacks, yes i said Arbitrator, because she is not a judge, there is a different-look it up.

I hear you, but I feel like he didn’t have sufficient evidence. The landlord is obviously a disgusting, twisted, creep and was clearly violating his privacy and had no business in the room. Once you agree to rent a space out, you should respect it. Unfortunately, the plaintiff simply didn’t have sufficient evidence. The camera was a good idea, but having it on the floor looking up at the ceiling wasn’t a good idea because it doesn’t actually capture what he alleges. It proves that the defendant was in his room, which is a violation of privacy, but no proof of the actions he claims. Is it possible? Yes. Because the defendant is gross. But without direct proof, it’s hard to make a decision in the plaintiff’s favor. Same with the towing bill. He had no proof that the garage was still usable, the defendant claims it was, nobody has evidence, except the video where the defendant tells him to move or he’ll tow. This was a hard case but I think she made the right decision based on the lack of evidence.

"reasonable assumptions" can not be turned into "s/he committed the crime" What if someone were to make a "reasonable assumption" that you committed a crime simply because you were where it happened, but there was no proof? That would suck and it's one of the things that have lead to far too many black men being put in jail unjustly - "reasonable assumption" that they committed the crime because there were near where it happened. So while it was not the desired judgement (for me either), it was the only legal judgement that could be made based on the evidence. Unfortunately the defendant simply didn't have enough evidence to prove his case even though we can all see the landlord is a sleaze and has likely done FAR worse than what he did to this man. Personally, I think the landlord rifled his room more than once before he got the camera, that's why he got it. And it's possible he picked up a think or two and kept them. The guy is a jerk and a bigot - but those things do not turn "reasonable assumption" into proof that he committed any crimes. He's a sly old prick and knows just what he can get away with

Plantif has hands easily on defendant. Restricted access to garage, threats of vehicle tow thereafter as well as convicted gun toting owner entering room w/o CAUSE. Who upholds law Judge😳

The more I watch these shows about renters/landlords, the more convinced I am to NOT rent out a room. Was thinking even about having a "safe room" for battered women, men, etc. I would like to help, but dang. The "needy" person may be owning my home in a few months. Cant do it.

I hate this case .. the plaintiff sounds like an honest person and hte landlord is nuts .. it was unfair what he did to the tenant .. and for her not to find it weird and unfair for him to go in that room .. all the time? WTH

BS ruling regarding the tow ... the Plaintiff should've at very minimal gotten some of his rent back from the months he did pay AND wasn't able to utilize the garage as the lease stated ...

Its illegal for a landlord to enter a tenants residence without prior written notice. The only exception is for emergency repairs like busted water pipes. "Wasting electricity" isn't an emergency situation.

This is why I stopped finding rooms to rent and pay a little extra money and live by myself. That way I don't have to deal with anyone else's drama but my own.

The moral of the story is: Money don’t make you a saint or clean person pertaining to crime. My take on it is the defendant is a down low criminal.

Judge MM failed horribly in this case... A landlord have no reason to constantly enter a tenant's room without permission...He had evidence...Was she having a bad day or something? The verdict was a foolish one...

This case is terrible. The defendant got away with going into plaintiff's room (which is illegal), pulling a gun on him, calling him names, and taking away their agreed-upon parking. What a disgusting person he is. I wish so bad plaintiff had had more proof. A better camera (or multi-camera system) would have been great.

The defendant is sleazy . I dont believe the plaintiff showed him a gun and he should have been reprimanded for calling the man thug!! He is creepy and the plaintiff should have won for plaintive damages. I believe that the landlord stole his stuff. I didn't like this case. This judge is going downhill
@NewDay-fk4jn4 жыл бұрын
The judge gave the wrong verdict and she was barely listening to what the tenant said! The landlord is using derogatory words and the judge said NOTHING about that! He has no business being in his room and it's not ok to get his car towed! Obviously the landlord took his hard drive etc on a different day!!.. Why can't she see that! The landlord guy is a liar and you can see a nasty piece of work!

The judge rubs me all the wrong way! She is very biased in her rulings and in these kinds of cases I wish the plaintiff would go to Judge Mathis! The defendant is pure racist. 🗑
@brandonm44713 жыл бұрын
Just curious, how was she biased? 1. He was there on july 1st, by law he is required to pay full rent 2. he didnt have enough proof the guy stole his hard drive 3. he was blocking the guy from leaving his house since the garages are perpendicular to each other. Judge even calls the defendant a jerk How is she biased?

To stand your ground doesn't mean you go back and get a gun and then confront the person again! And even as the landlord, this does NOT give you the right to come into your tenant's home without prior notice. And if it's in the agreement that you have the right to park in the garage and that is being denied (for whatever reason, deliberate or otherwise) then it's for the landlord to repair the garage door, and in between time let you use his garage, you shouldn't have to park in the road. There is something VERY off about the defendant and I am shocked that he won outright, what was the judge thinking...
@medicalsecrets25042 жыл бұрын
I'm baffled, she asked him about the gun he was trying to conceal by his arm, and he stated, I didn't have a gun, then turned around and said he went to get his gun, however, if you own a $4 million dollar home, why would you need to sublet rooms? People with their fake flossing, what a liar he is... Shalom~
@Lame813 Жыл бұрын
A lot went left with this case & I think the plaintiff got shorted. If the landlord was constantly in the room unsupervised and they had issues isn’t it more likely than not he stole it ? Isn’t that what she always says? And if the gate to the garage was broken why wasn’t he obligated to fix it as the landlord ? And she saw none of his shady check behavior as a indicator to his character as a propensity to steal ? Plus lying about having the gun initially ?

I believed every word the plaintif said, he was so calm and put up with that crazy guy who was constantly in his room. How did the judge not rule in his favor, unbelievable!

This is the kind of case that proves, judges can’t be unbiased. She definitely made the wrong judgement. Clearly not listening, and letting the Spanish guy make microaggressions towards a black man. She probably doesn’t even think Spanish people can be racist.

Odd case. Isn't a landlord suppose to give 24 hours notice before entering? Entering for just an open window is petty. An emergency, Yes, but that's it. Think the judge at times cut off the the plaintiff, so he couldn't explain, the videos or answer her questions. Think the plantiff got a raw deal. Loved his voice tho..should go into broadcasting.
