The money already existed and the defendant had control of it so it was either let her keep it all or find some way to divide it. The judge didn't have the option of confiscating the money because they were both frauds. Albeit the judge probably notified proper authorities to investigate a fraudulent scam between these two people.

@@allMinabe --- You're wrong. This is an Arbitration. Learn what Arbitration and Adjudication are and how they are set up and what legal authority they have or don't have. FYI- Anyone can be an Arbitrator and if all parties agree, sign the legal documents the ultimate verdict has the same legal binding but that doesn't mean law was followed. Every state has a system for Arbitration and as long as a personal liberties aren't violated and certain laws are followed it cannot be appealed. Some laws ignored or personal rights ignored can result in appeal. A simple internet search will tell you all you need to know about Arbitration.

They can however write an order that goes to an actual court where both sides argue their cases again. You are a dumb ass for not knowing that fact. The verdict is only based on the messages between both parties. When one says something and the other acknowledges that statement. It clarifies they both understood the agreement and that’s why the judge looked at the December text where they both agreed what should be paid and went off that for the verdict. No matter who’s lying and who is a bigger scammer. The bottom line is who said what and what was the agreement. If you watch her enough she says all the time it’s a contracts case. When there’s nothing in writing she always goes back to messages where both talk about the agreement and as long as they both are communicating about the agreement acknowledging the agreement. You can always determine who was supposed to get what

I think the Judge completely missed the mark with this one. The plaintiff took complete advantage of the defendant. She literally scammed the pet store out of thousands of dollars. What happened to coming into court with your hands clean? And the defendant was expected to use her own commission to pay for the care of this woman's guinea pigs? She's literally working for free at that point. Case should have been dismissed.

The judge has stated in many other cases that she rules on contracts and what’s presented as legal proof that can be used to prove someone is entitled to the money they’re asking for. Whether or not what the plaintiff and defendant did was morally correct, the judge did say that based on the proof the defendant presented in court, the defendant did agree to pay the plaintiff some money. It was never specified how much exactly which is why the judge did some Rough Justice. And I’m sure that by the testimony the defendants gave about admitting they did commit fraud for the plaintiffs, the judge ended up punishing them by having them pay a little more with the Rough Justice. And I’m sure the Plaintiffs also received the same rough justice as they came to court asking for $3,960 but instead left with only $990. That’s a huge loss in court rewards. Bottom line, the judge rules based on contracts, agreements (that can be proven) and presentation of proof. So that’s what she based her ruling on for this case: the presentation of messages between the two parties showing that there was no set agreement, but that there was an agreement of monetary exchange that kept getting changed throughout their interactions. And because it came to light that both parties were frauds in the business the judge served them with a harsh Rough Justice to punish them by. The plaintiffs got a huge court reward loss and the defendants had to pay quite a hefty amount for a small business that’s just starting out. I believe the ruling was fair given the circumstances. But that’s just my opinion.

So many charitable organizations are complete frauds but they do just enough to legally exist. I am always very leery of charities I haven't studied. Military Veterans charities might be the worst for trying to scam the VETS donations. I was sad to learn donating blood is highly profitable for some organizations while others truly are a not for profit.

The plaintiff phrased the adoption fee issue so poorly. She needs the adoption fees to run her business and the defendant wasn't giving them to her. THAT'S ALL SHE NEEDED TO SAY but she made herself come off as a shady dealer.

I agree that any individual starting a not-for-profit organization (like a rescue or charity) starts out with the best of intentions. Though in my experience, they use it to substitute business sense, which is what gets them into trouble. For instance, the girl thought "omg, slaughtering cute fuzzy blobs is cruel, I want to save them" and expected a cat shelter (whom admits they use guinnie pigs as trade goods for cat vets) to teach her what she needed to know, rather than doing some foot work on her own, such as calling the Animal Rescue Bylaw Officers (given they will be able to direct one to local legal requirements and warnings) or doing research. It is sad, but businesses cannot only focus on the good they do, but the footwork they need to have done (such as hiring an accountant, book keeper and business manager) to assure what good they do can be done in the long term.

There was definitely fraudulent activity going in both parties and I thought that courts do not enforce contracts where the laws may have been broken. The room goes dark and the officers shoes echo on the cold pavement with every step... He leans in close to the bars where the smuggler lies.. "And believe me... you will have all the time in the world to run around your little cell like a plastic ball in a child's hands..." The officer moves away and walks down the hall... the sound of his shoes only muffled by his cursed, crooked laugh...

One good thing that came out of this is kind of the FRAUD plaintiff was conducting. I say Defendant was smart, she knew that she has to pay money but made sure that plaintiff will pay the heavy price by bringing about the fraud. She made a huge dent on plaintiff carrier. So let me see if I understand this....the plaintiffs have a contact that she gets unwanted Guinea Pigs from that aren't worthy to be in these Guinea Pig shows and she rescues these Guinea Pigs and rehomes them. She strikes up a deal with this defendant that says she will send these rescued guinea pigs to the defendant and the defendant is supposed to pay THEM $15 for every Guinea Pig she successfully adopts out, plus $10 for shipping them. She can use moneys for the GP's care, but all other funds are to go to the Plaintiff. So my question is....WHY don't they have a contract that stipulates the EXACT terms of this arrangement? And what's really in it for the defendant? I understand she's trying to start a rescue, but she's doing pretty much ALL the work (as far as caring for these guinea pigs and adopting them out) for nothing. Why waste your time doing all that work for nothing? And if the plaintiff sent this girl 65 guinea pigs the first month and she didn't give them any money....WHY then would they send her 48 MORE guinea pigs in October? Why aren't they calling her and asking "Hey, have you sold the 68 we sent you in September? If you've sold the original lot, where is the money you owe us?" They have NO records of her receiving these Guinea Pigs....no records of these pigs being sold. And no record that they are blanketing her to make her rescue legit. The only records they have are the ones showing the plaintiff got the pigs from the original seller who was culling them. The plaintiff is saying they did this for three months and she saw NO money from the defendant. The defendant is saying she would get the pigs on Friday and the plaintiff would pick up the money from the sales on Monday.....in cash. No receipt exchanged. No record of the transactions. What kind of business IS this? AND THEN....we find out that they are FORGING RECEIPTS to make it look like they are selling more pigs than they really are, so they can make a BIGGER profit from these pet store grants. If I were Judge Milian, I would not give either one of these women a single penny. They BOTH have dirty hands. AND, if I were Judge Milian, I would be calling the pet stores and telling them "Hey...these ladies are scamming you. They are showing you fraudulent receipts....so the pet stores can sue them for the money they stole. I am a businesswoman. Every time I make a sale, I create an invoice that shows exactly what I am selling and how much its selling for. And every transaction is done through Paypal. So I have a clear record of every sale I make and my clients have a receipt. THAT is how to run a proper business. Not this....nonsense.

Off topic,,,but a guinea pig story. A young woman took her guinea pig to the vet. The diagnosis was terminal cancer; the vet recommended euthanasia. The young woman panicked; she couldn't face the idea of a pet dying in her care. She asked my friend if she could take her pet in. My friend had two cats. The two cats promptly adopted the little guinea pig. They groomed her, protected her, slept with her, etc. The cats mourned the passing of their little friend.

I’ve seen an episode where she dismissed a case based on the legality of it- the plaintiff was suing the other party for drug money he owed him. And since it was illegal, she stated the court would not make him even so why is this any different? How did she rule to make someone even when this is a fraud? It’s illegal.

I know this is an old case, but when I saw it involved guinea pig rescuing, I knew it was going to be wild. I used to be on a few guinea pig rescue forums back in the early 2000s, and they were always full of drama.

When a person ADMITS they knowingly defrauded an organization (especially on national tv), can the organization then take that fraudster to court and/or sue them? So often you see on these court shows how people took/take advantage (abuse) of the housing authorities, health & social services, auto insurance, social security administration and so many more. It should be dealt with. And swiftly.

This is so hard to watch. I run a 501c3 animal rescue and people don’t seem to understand that we absolutely need all the money we can get. People get really creeped out when you start talking about money and adoption fees but we have to have it. It costs thousands of dollars to vet animals and you can’t save those animals without it. However, if they really did forge adoptions for grant money that is some awful, awful stuff going on there. NO legitimate rescue, no matter how strapped for cash we are, should ever do something so unethical as that. Shame on them!

Judge ruled wrong. Neither of them deserve to walk out with any money. Those Plaintiff's should be audited & they're shady as hell. I wouldn't ever adopt something from her.
