Hi, Mary. My mother recently returned to Canada on a Permanent Resident Travel Document (PRTD). Her PRTD was obtained via an H&C argument-based procedure. Her PR had expired about 7 years ago. She is now in Canada, and I am looking into ways to renew her expired PR. My question is, how should she go about renewing her expired PR? She has no plans to leave Canada in the next few years. Is it better for her to wait two years before starting her PR renewal application? With this approach, I am unsure whether she will have difficulty renewing her Health Card. Depending on the reasons why the PR card expired without renewal, as well as reasons for remaining outside of Canada may qualify the application to be done on humanitarian and compassionate grounds. Otherwise, you will need to wait until the residency requirements have been met. But given that she is still a PR, she should be able to still apply for a health card.

Yes you can apply to renew your card but you have to decide if you will do it under H&C grounds (so in that case and you need to submit a very strong application and put all the docs to demonstrate why you did not meet the residency requirements) but we often suggest if you can to stay in Canada for 2 years physically consecutively and then apply for a straightforward PR card renewal.

Hello, you might be questionned at the border and receive a removal order as you do not meet the residency requirement. We recommend that you enter with a package of documents which explains what happened in the event that you are asked questions. If you are applying for a PR card renewal on H&C grounds, you have to ensure that your application is strong because a refusal can also lead to you losing your status. Hello My grandparents are Canadian pr holders They renewed there pr card and came to india in june 2016 After 3 years in june 2019 they booked ticket to go back to canada But few days before my grand father got ill so they have to cancel there tickets After that due to covid situation they can’t go But now there pr card is going to expire in feb 2022 Nd they are planning to go back to canada in sept. 2021 before there pr card expires So can they enter canada ?

They can enter Canada by plane with their valid PR cards, however they might receive a removal order upon entry as it looks like they have not met the PR residency requirement of 2 years out of 5. It would be beneficial for them to speak to an immigration lawyer to understand this situation and be prepared for questions at the border. An immigration lawyer can also prepare a package of documents to assist.

My condition includes: -My spouse and kids are the citizens of Canada, and they live in Canada, -I have a PR status, but it is about to expire before I complete the mandatory staying/living requirement days in Canada, -I work outside of Canada, -I own a house where my family stay, -I have a bank account in Canada, -I stay in Canada 3 months in every year which is the total leave days that I earn throughout a year from the Company that I work with, Would it be enough to convince the concerned to renew my PR on H&C ground? garip yolcu You have some strong grounds given that your family lives in Canada. We would need to look further into the details of you being outside of Canada and also the personal circumstances of your family. You would need to file a very strong and complete application.

I am not sure I understand your question - the law/case law/manuals/policies allows for PR card renewal applications under H&C grounds if the residency requirement is not met if we can demonstrate that the reason for being forced to be outside of Canada was out of your control. Our office has successfully filed hundreds of these applications. Every case is different, some will be approved and some not. Depending of the refusal reason there is also possibilities of appeal.

Manoulie Brutus h&c has many different factors to be considered, language is one of them. Definitely if you have language skills in Canada it would make your case stronger.

majid hussain yes it’s because of the pandemic, Ircc is only able to process very little cards per week given that they outsource the production of the cards to A third party company

Hello there, Thanks for the informative video. I entered Canada recently when my PR card was about to expire and it's expired now. I have not been physically present in Canada for 730 days over the past five years. If I apply for my card's renewal under H&C grounds (my parents needed my financial assistance over the pandemic period if this can count as H&C at all), and it's gets rejected by the immigration office, will I be deported from Canada? What is your suggestion given my conditions? Regards

@@anureetmangat1938 I came from Iran via Germany. As long as you are holding a valid PR card, nobody can stop you from entering Canada. The last time I was in Canada was 2019 and had been away actually for two years but the officer didn’t say anything.

If you are in Canada now, live 730 days out of 5 years from now on, and apply for renewal after residency obligation fulfilled at the time you apply. even your PR card expires, you don't lose your PR status unless you receive removal order, you then need to appeal to IAD if you still wish to keep ur PR status.
